RESOLUTION NO.
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC
HEARING TO CONSIDER ABOLISHING THE EXISTING
RESIDENTIAL PERMIT PARKING AREAS AND CREATING NEW
RESIDENTIAL PERMIT PARKING AREAS, PURSUANT TO
SECTION 44-84 OF THE MIAMI BEACH CITY CODE.
WHEREAS, pursuant to Section 44-84 of the Miami Beach City
Code, the City Manager is authorized to determine if a residential
area is impacted by commuter vehicles in accordance with the
criteria set forth in Sections 44-82 and 44-83, and after making
such a determination may initiate the creation of a residential
permit parking area; and
WHEREAS, pursuant to Miami Beach City Code Section 44-84, the
City Commission must hold a public hearing to consider the City
Manager's recommendations for creating residential permit parking
areas, and at the conclusion of the public hearing, may adopt a
resolution creating such areas; and
WHEREAS, pursuant to Miami Beach Code Section 44-84, the City
Commission has created residential permit parking areas in the City
of Miami Beach as set forth in Exhibit"l" attached hereto; and
WHEREAS, the City Manager has determined that in order to
better meet the current needs of residents in the City of Miami
Beach, it is necessary to abolish the existing residential permit
parking areas and to create new residential permit parking areas to
include locations in existing residential permit parking areas as
well as locations not previously included in such areas; and

NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public
hearing to consider abolishing the existing residential permit
parking areas and creating new residential permit parking areas to
include the locations in currently existing areas as well as
locations not previously included, in such areas, is hereby
scheduled to be held on at in the City
Commission Chambers at 1700 Convention Center Drive, Miami Beach,
Florida, and the City Clerk is hereby authorized and directed to
publish and distribute the appropriate public notice of said public
hearing at which time and place, all interested parties will be
heard.

ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission adopt the attached resolution
which establishes the time and place for a public hearing to consider abolishing existing
residential permit parking areas and creating new residential permit parking areas,
SUMMARY:
In accordance with Section 44-84 of the Miami Beach City Code, a public hearing is required
to consider the abolishment of existing residential permit parking areas and creating
residential permit parking areas,
Current residential permit parking areas are described in the attached Exhibit" 1".
The proposed new residential permit parking areas will include locations in currently existing
areas and locations not previously included in such areas as described below:

1. A residential parking permit area is hereby created in

the area bounded on the South by the centerline of Fifth Street,
on the North by the northerly right-of-way line of Fifteenth
street, on the West by the centerline of Collins Avenue and on the
East by the easterly ri9ht-of-way line of Ocean Drive, to be
referred to as "Residential Parking Permit Area t 1".
2. The City Manager is authorized to implement a residential
parking permit program in Residential Parking Permit Area t 1 as

a test area only for a period of six months, after which period an
evaluation of the program will determine its continuation.
3. The City Manager is authorized and directed to create a
residential parking permit for Residential Parking Permit Area II 1
which will allow permitted vehicles to be parked in the following
areas ~:
at any available municipal metered parking space within
Residential Parking Permit Area II 1,
(b) at any available municipal attended parking space at the
fourth (4th) level and above of parking Garage II 17A at
13th Street and Collins Avenue, and
(a)
(c) at any available space in the specific "Residential
parking Permit Only" locations in Residential Parking
Permit Area II 1, as shown on Exhibit "An attached hereto
and by reference made a part hereof, during the following
hours:
- From 6:00 P.M. to 8:00 A.M., Monday through
Friday.
- Twenty-four hours a day on Saturdays, Sundays and
holidays.
4. The permit for Residential Parking Permit Area II 1, shall
D2t be honored at any municipal parking facility (on-street, off-
street, metered or attended) outside of Residential Parking Permit
Area II 1.
5. The cost for the permit for Residential Parking Permit
Area II 1 is hereby established in the amount of $75.00 per vehicle
for the six month trial period.

On March 21, 1990,. the City COl1'l1lission adopted Ordinance No. 90-2690 which
authorized the creation of a residential parking program in the City of Miami
Beach. Accordingly, the first test area was recommended to be between fifth and
fifteenth Streets and Ocean Drive and Collins Avenue (east side). In accordance
with the guidelines set forth in the enabling legislation, the City CommissiDn
adopted Resolution No. 90-19985, scheduling a public hearing for the purpose of
obtaining public input frOl residents of the affected area and establishing a
fee schedule for the permits.
The attached resolution de11neates the specific target area of Residential
Parking Program (RPP) Phase I (fifth to fifteenth Streets, Ocean Drive to Collins
(east) Avenue respectively). The resolution also authorizes the City Manager
to implement this program for a six-month period followed by an evaluation of
the program to determine its continuation.
The resolution also establishes the cost of the six month perm1-t at $75.00.
The RPP Permit would not be honored outside of the target zone. It would, in
effect, be over and above all other permits sold by the Parking Department..
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the CHy Connission of the City of Miami
Beach adopt the attached resolution which authorizes the City Manager to
implement a six-month residential parking program as defined with an evaluation
to be completed at the close of the specified six-month period.

Court are impacted by commuter vehicles; and,
WHEREAS, the residents of the above described area have been
provided with the opportunity to express their considerations at
the public hearing as prescribed by Ordinance No. 90-2690.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, as follows:
1. Residential Parking Permit Area #1 is hereby temporarily
expanded, for - a period of up to eighteen months, to
include the area of the west side of Collins Avenue
between Fifth and Fifteenth Streets and Eighth, Tenth,
and Eleventh streets between Collins and Washington
Avenues.
2. The conditions set forth in Resolution No. 90-20000 shall
also apply to the expanded areas.
3. The cost for the permit for Residential parking Permit
Area #1, including the temporarily expanded area, is
hereby increased from $75.00 to $125.00 for each six
month period beginning January 1, 1993.
4. Except as provided in Paragraph #3 above, Resolution No.
90-20000 shall continue in full f ce and eff

WHEREAS, the Mayor and City Commission of the City of Miami
Beach adopted Resolution No. 90-20000 on June 6, 1990: and
WHEREAS, this Resolution established the operational hours of
the meters in the Ocean Drive corridor in conjunction with the
creation of Residential Parking Permit Area #1: and,
WHEREAS, the City is improving the parking conditions for the
residents, businesses and visitors to the City; and,
WHEREAS, the operation of the meters are currently in effect
seven days weekly, between 6:00 AM and 6:00 PM; and
WHEREAS, it is necessary to revise the operational hours of
the meters south of Dade Boulevard/23rd Street to begin the first
step to improve parkipg conditions in this area,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City
approves an amendment to Resolution No, 90-20000 amending the
operational hours of parking meters in the areas south of Dade
Boulevard/23rd Street from the current hours of 6:00 AM to 6:00 PM,
to 6:00 AM to Midnight, seven days weekly, holidays included.

2. The City Manager is authorized and directed to create a residential parking
permit for Residential Parking Permit Area #4 which will allow permitted vehicles to be
parked in the following areas llI1Ix:
(8) at any available municipal metered parking space within the Residential
Parking Permit Area #4.
(b) at any available space in the specific "Residential Parking Permit Only"
locations in Residential Parking Permit Area #4, as shown on Exhibit "A"
attached hereto and by reference made part hereof, during the hours from
6:00 P.M. to 8:00 AM., Monday through Sunday.
3. The permit for Residential Parking Permit Area #4, shallllQ1 be honored at
any Municipal Parking Facility (either on- or off-street, metered or attended) outside of the
Residential Parking Permit Area #4.
4. The cost for the permit for Residential Parking Permit Area #4 is hereby
established in the amount of $6.00 per vehicle for a peri of six-months.
