2007-26428 Reso RESOLUTION NO. 2007-26428 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 3 TO THE EXISTING AGREEMENT BETWEEN THE CITY AND PERKINS + WILL, INC., DATED APRIL 14,2004, FOR PROFESSIONAL AlE SERVICES; SAID AMENDMENT FOR THE PROVISION OF ADDITIONAL PROFESSIONAL SERVICES, IN A NEGOTIATED AMOUNT OF $96,630, FOR SPECIAL AND THRESHOLD INSPECTIONS AND TESTING SERVICES FOR THE PROPOSED MUL TI- PURPOSE MUNICIPAL PARKING FACILITY (MMPF); WITH PREVIOUSLY APPROPRIATED FUNDS AVAILABLE FROM FISCAL YEAR 2006-2007 CAPITAL BUDGET PARKING OPERATIONS FUND NO. 480. WHEREAS, on September 10th, 2003, the Mayor and City Commission approved Resolution No. 2003-25332, authorizing the execution of a Development Agreement between the City and the New World Symphony (NWS) for the development and construction of an approximately 50,000 square foot educational, performance and internet broadcast facility with an exterior screen ("Soundspace"), and an approximately 320-space (+/-) public parking garage facility; and WHEREAS, on April 14, 2004, pursuant to Resolution No. 2004-25543, the Mayor and City Commission approved and authorized the Mayor and City Clerk to execute an Agreement with Perkins + Will, Inc. (Consultant), for professional AlE services for the new Multipurpose Municipal Parking Facility to be developed on the site of the existing City Hall surface lot (the Project) pursuant to Request for Qualifications No. 69-02/03; and WHEREAS, Amendment No.1 to the Agreement, in the amount of $167,980, was also approved pursuant to Resolution No. 2004-25543, for a total fee of $1 ,368,768; and WHEREAS, Amendment NO.2 to the Agreement, in the amount of $415,216, was approved pursuant to Resolution No. 2006-26327, for a total fee of $1 ,783,984; and WHEREAS, the special and threshold inspections and testing services are required for the construction of the MPPF; and WHEREAS, at this time, the City has negotiated Amendment No.3, for the provision of additional services relative to special and threshold inspection services and testing of materials; and WHEREAS, Amendment No.3 increases the Agreement amount by $96,630, for a total fee of $1,880,614; and WHEREAS, funding for this Amendment has been previously appropriated in Fiscal Year 2006-2007 Capital Budget Parking Operations Fund No. 480. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the Mayor and City Clerk to execute Amendment NO.3 to the existing Agreement between the City and Perkins + Will, Inc., dated April 14, 2004, for Professional AlE services; said Amendment for the provision of additional professional services, in a negotiated amount of $96,630, for the services of special and threshold inspections and testing services for the proposed Multi-Purpose Municipal Parking Facility (MMPF); with previously appropriated funds available from Fiscal Year 2006-2007 Capital Budget Parking Operations Fund No. 480. In approving the execution of the Agreement, the City Commission also directed the Administration to proceed with developing a new Multipurpose Municipal Parking Facility (MMPF) on the site of the existing City Hall surface lot. On April 14, 2004, the Mayor and City Commission approved Resolution No. 2004-25543 authorizing the execution of an agreement with the Architect, in an amount of $1 ,200,788, for the provision of Planning, Architecture, Landscape Architecture, and Engineering Services required to design the Multi-Purpose Municipal Parking Facility project. To ensure the quality of the projects construction, it is required that special inspection services be internal by the City to inspect and test various aspects of the work, specifically the inspection and testing of augured piles and construction materials and a Threshold Inspection of structural components (Threshold Inspection) and materials. This services are required for the construction of the MPPF, the negotiated fee of $96,630, for the additional scope of services will increase the P+W contract from $1,783,984 to $1,880,614 and funding for this task has been previously appropriated in Fiscal Year 2006-2007 Capital Budget Parking Impact Fees Fund No. 480. PROJECT FUNDING Funding for this task has been previously appropriated in Fiscal Year 2006-2007 Capital Budget, specifically Parking Operations Fund No. 480. ANAL YSIS On September 10th, 2003, the Mayor and City Commission approved Resolution No. 2003- 25332 authorizing the execution of a Development Agreement between the City of Miami Beach and the New World Symphony (NWS) for the development of a portion of the surface parking lot, bounded by 17th Street to the North, North Lincoln Lane to the South, Washington Avenue to the East and Pennsylvania Avenue to the West, for construction of an approximately 50,000 square foot educational, performance and internet broadcast facility with an exterior screen ("Soundspace"), and an approximately 320-space (+/-) public parking garage facility. In approving the execution of the Agreement, the Commission also directed that the Administration should proceed with developing a new Multi-Purpose Municipal Parking Facility (MMPF) on the site of the existing City Hall surface lot. Throughout the negotiations with the NWS, the Administration has consistently stated that replacement parking must be built before displacement of either of the 17th Street surface parking lots. Consequently, the Municipal Multipurpose Parking Facility must be built and completed, or an alternate acceptable replacement parking location must be identified, prior to the commencement of construction of the NWS project construction. At that time, the estimated schedule called for substantial completion of the MMPF by November 2007, and final completion by February 2008.
