2007-26530 Reso RESOLUTION NO. 2007-26530 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE THE NEGOTIATED FINAL RECONFIGURA TION AGREEMENT WITH MOTOROLA FOR THE RECONFIGURATION OF 800 MHZ CHANNELS USED IN THE CITY'S PUBLIC SAFETY COMMUNICATIONS SYSTEM FOR THE PURPOSE OF COMPLYING WITH THE SPRINT/NEXTEL REBANDING MANDATE (PURSUANT TO FCC ORDER NO. 04-168, DATED AUGUST 6, 2004, THAT MODIFIED FCC RULES GOVERNING THE 800 MHZ BAND TO MINIMIZE HARMFUL INTERFERENCE TO PUBLIC SAFETY COMMUNICATIONS SYSTEMS ). WHEREAS, the Federal Communication Committee (FCC) has issued a mandate to reconfigure the utilization of the 800 MHz spectrum so that Nextel can minimize harmful interference to the City's public safety radio communications systems; and WHEREAS, pursuant to the order, the City, a licensee of 800 MHz channels used in its public safety radio communications system, must relinquish its existing channels and relocate its public safety radio communications systems to other licensed channels owned by Nextel; and WHEREAS, Nextel must relinquish some of its owned channels to the City to be used for public safety radio communications systems in exchange for the City's relinquished channels; and WHEREAS, Nextel must provide and pay relocation funds to enable the City to relocate the public safety radio communications systems onto replacement channels and reconfigure the public safety radio communications systems so that they are "Comparable Facilities" per FCC Order 04-168 and FCC issued Supplemental Order and Order on Reconsideration FCC 04-294; and WHEREAS, the City has negotiated the attached Final Reconfiguration Agreement with Nextel to detail the work that must be performed during the implementation phase to accomplish the reconfiguration of the City's public safety radio communications system and the exchange of the licensed 800 MHz spectrum to minimize harmful interference to public safety radio communications systems. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission hereby authorize the Mayor and City Clerk to execute the negotiated Final Reconfiguration Agreement for the Reconfiguration Implementation Phase with Motorola for the reconfiguration of 800 MHz channels used in the City's Public Safety Radio Communications System. Item Summary/Recommendation: On August 6,2004, the FCC issued Report and Order FCC 04-168 that modified its rules governing the 800 MHz band to minimize harmful interference to public safety communications systems. On December 22, 2004, the FCC issued a Supplemental Order and Order on Reconsideration FCC 04-294. Pursuant to the orders, certain licensees of 800 MHz channels used in public safety or other systems must relinquish their existing channels and relocate their systems to other licensed channels. The FCC has appointed a Transition Administrator (UT A") to assure that the rebanding initiative proceeds on schedule and in a planned and coordinated manner so that disruption to a licensee's system is minimized. The City has selected Motorola to provide the Reconfiguration Planning Phase services. The Administration recommends that the Mayor and City Commission execute the negotiated Final Reconfiguration Agreement with Motorola for the reconfiguration of 800 MHz channels used in the city's public safety communications system for the purpose of complying with the Sprint/Nextel rebanding mandate. Pursuant to the orders, certain licensees of 800 MHz channels used in public safety or other systems must relinquish their existing channels and relocate their systems to other licensed channels. Also pursuant to the orders, Nextel must relinquish some of its existing channels and must provide and pay relocation funds ("Relocation Funds") to enable affected licensees to relocate their systems onto Replacement Channels and reconfigure their systems so that they are "Comparable Facilities". The table below shows all the channels in the City's 800M Hz Public Safety Communication System and highlights the three channels that will be affected by this mandate. In the TA's published "Reconfiguration Handbook," the two major phases to accomplish the reconfiguration are described as the "Reconfiguration Planning Phase" and the "Reconfiguration Implementation Phase". Motorola has provided the Reconfiguration Planning Phase services, and will be providing the Reconfiguration Implementation Phase services. The Mayor and City Commission approved a resolution, introduced June 6, 2006, dealing with the Reconfiguration Planning Phase of the project to execute a reconfiguration planning phase agreement with Motorola for the reconfiguration of 800 MHz channels used in the city's public safety communications system. This resolution deals with the Final Reconfiguration Agreement of the project thereby authorizing the Mayor and City Clerk to execute a Final Reconfiguration Agreement with Motorola for the reconfiguration of 800 MHz channels used in the City's Public Safety Radio Communications System. CONCLUSION The Administration recommends that the Mayor and City Commission execute the Final Reconfiguration Agreement with Motorola for the reconfiguration of 800 MHz channels used in the city's public safety communications system for the purpose of complying with the SprintlNextel rebanding mandate (FCC order FCC 04-168 dated August 6,2004 that modified its rules governing the 800 MHz band to minimize harmful interference to public safety communications systems).
