Amendment No. 1 Chen & Associates, Inc. t1-tJ ~ 7 - .,2 t 'f 7 7 3//Yjo 7- c78 AMENDMENT NO.1 TO THE PROFESSIONAL ARCHITECTURAL AND ENGINEERING (A / E) SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND CHEN AND ASSOCIATES, INC, DATED MAY 18, 2005, IN AN AMOUNT NOT-TO-EXCEED $73,256 FOR THE PROVISION OF ADDITIONAL PROFESSIONAL SERVICES NECESSARY FOR THE DESIGN OF BIKE LANES/ROUTES WITHIN RIGHT-OF-WAY INFRASTRUCTURE IMPROVEMENTS PROGRAM NEIGHBORHOOD NO. 12 - SOUTH POINTE PHASES III/IVN This Amendment No.1 to the Agreement made and entered this ~day of March, 2007, by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of the State of Florida (hereinafter referred to as the City), having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139, and CHEN AND ASSOCIATES, INC., a Florida Corporation, having its offices at 420 Lincoln Road, Suite 240, Miami Beach, Florida 33139 (hereinafter referred to as the Consultant). RECITALS: WHEREAS, pursuant to Request for Qualifications (RFQ) No. 08-03/04, the Mayor and City Commission adopted Resolution No. 2005-25902 on May 18, 2005, approving and authorizing the Mayor and City Clerk to execute an Agreement with Consultant for Professional Services for the South Pointe Phases 1I1/IVN Neighborhood Right of Way Improvement Project (the Project); and WHEREAS, the Agreement provides for the planning, design, bidding and award, construction administration and reimbursables for the Project; and WHEREAS, the Agreement was executed for a not-to-exceed amount of $2,017,009; and WHEREAS, in December 2006, during the Project design process, the Public Works Department requested the implementation of bike lanes, in accordance with the "Bike Master Plan" that was being developed; and WHEREAS, the Consultant was directed by the City to provide options for the implementation of bike lanes along Alton Road, South Pointe Drive, and Collins Avenue, in accordance with the "Bike Master Plan"; and WHEREAS, on January 10, 2007, a meeting was held with various City departments to review the options prepared by the Consultant, and to make recommendations for the inclusion of bike lanes in the Project; and WHEREAS, these improvements were not originally included in the Project scope; and WHEREAS, the fee being requested by the Consultant for the design of the bike lanes/routes is $73,256; and WHEREAS, the City's Program Manager, Hazen and Sawyer, and the City's CIP Office have evaluated the Consultant's additional services fee proposal and find it to be fair and reasonable; and WHEREAS, the following Amendment NO.1 increases the Agreement fee by $73,256, for a total fee of $2,090,265. NOW. THEREFORE. the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment NO.1. 2. MODIFICATIONS The Agreement is amended to provide for the additional services, as set forth in Schedule "A-1 ", attached hereto. 3. OTHER PROVISIONS All other provisions of the Agreement, as amended, are unchanged. 4. RATIFICATION The City and Consultant ratify the terms of the Agreement, as per this Amendment NO.1. IN WITNESS WHEREOF, the parties hereto have caus thi mendment NO.1 to be executed in their names by their duly authorized officials as of the a e r t set forth above. ~~t rltt~ Robert Parcher, City Clerk ATTEST: -~-~,(~ CONSULTANT: :::gA:S;(L President I 6~ it. d,eY) Print Name APPROVED AS TO FORM & LANGUAGE & FOR CUTION ~ Date SCHEDULE "A- 1" SCOPE OF SERVICES Schedule "A" of the Agreement, entitled, "Scope of Services", is amended as follows: ADD the following under Task 5 - ADDITIONAL SERVICES: Task 5.4 - Desiqn of Bike Lanes/Routes: The Consultant shall provide detailed design services for producing Contract Documents (specifications and drawings) as needed for the construction of bike lanes / routes as required by the Public Works Department within the South Pointe Phase III, IV and V Neighborhood as noted below. In this effort, the Consultant shall be bound by the requirements stipulated in TASK 2 - DESIGN SERVICES, as adopted via Resolution No. 2005-25902, on May 18, 2005, approving and authorizing the Mayor and City Clerk to execute an Agreement with Chen and Associates for Professional Services for the South Pointe Phase III, IV and V Neighborhood Right-of-Way Improvement Project. In addition to revising existing design documents as necessary to accommodate new bicycle lanes, the Consultant shall also revisit the encroachment tabulations, as new removals may result from this effort. The Consultant shall also revise each drawing that is affected by these changes. Landscape drawings shall illustrate revised sight triangle locations. In addition, bike lane and route improvements shall be added to the 60% Construction Cost Estimate. In general, bicycle lanes / routes shall be included as follows: Alton Road The options for Alton Road, from 5th Street to South Pointe Drive, increases the overall width of the existing median, provides two (2) bike lanes and provides for equal sidewalks on both sides of the street. The landscape/swale area will be increased where feasible. Ocean Drive Although not originally included in the "Bike Master Plan", Ocean Drive, from South Pointe Drive to 5th Street, is part of the South Point Phase III, IV and V Project, and was evaluated and accepted by the Public Works Department as a viable and preferred option for the bike lanes in lieu of Collins Avenue. South Pointe Drive Several Options were looked at for South Point Drive. Option 1 a would eliminate parking on the North side of the street. Option 1 b, would eliminate parking altogether. Option 2 would eliminate the landscape median. Option 3 would reduce the travel lanes from two (2)11' lanes East and West bound, to one (1) 11' lane in either direction, and would require the completion of a traffic study. The decision was made to pursue Option 1 a, and to evaluate the potential impact of eliminating the parking on the South side, in lieu of the North. TIME OF COMPLETION May 14, 2007 PAYMENT AND COMPENSATION The method of calculating fees for the aforementioned proposed additional professional architectural and engineering services is based on estimated labor plus direct costs. The total fee proposed for this Scope of Work shall be on a not-to-exceed basis, in the amount of $73,256. Invoicing will be monthly and based on hourly rates as defined in the current Agreement between the City and Consultant. . COMPENSATION . Original Agreement amount $2,017,009. .
