PERFORMANCE OF A TRAFFIC IMPACT STUDY FOR THE SUD AREA
OF NORMANDY ISLE, PURSUANT TO A NEIGHBORHOOD-PROPOSED
STREET CLOSURE/ GUARD GATE INSTALLATION PROJECT.
WHEREAS, residents of the Sud Area of Normandy Isle approached the City, the Florida
Department of Transportation (FDOT) and Miami-Dade County with a proposal that a special
district be established, a guardhouse/gated vehicular entry be constructed for their neighborhood, and
certain streets be closed to traffic; and
WHEREAS, as a requirement from both the FDOT and County, a traffic impact study
must be performed for the intersections ofTrouville Esplanade, Rue Bordeaux, and Rue Notre Dame
with State Road 934, known as 71st Street (Study); and
WHEREAS, the Administration wishes to execute an Agreement for the Study with the low
bidder, Civil Works, Inc., in an amount not to exceed $4,790; and
WHEREAS, as recornmended by the G.O. Bond Oversight Committee, at its meeting of July
31,2000, up to $5,000 should be appropriated for the Study's purpose, from the $92 million G.O.
Bonds, Series 2000 funds dedicated to Normandy Isle/Sud Neighborhood Improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby appropriate $4,790 from the $92 million General Obligation Bonds, Series 2000,
Fund No. 373 (Normandy Isle/Sud Neighborhood Improvements), as recommended by the G.O.
Bond Oversight Committee, at its meeting of July 31, 2000; and authorize the City Manager to
execute an Agreement with Civil Works, Inc. (CWI), in an amount not to exceed $4,790, for the
performance of a Traffic Impact Study for the Sud Area of Normandy Isle, pursuant to a
neighborhood-proposed street closure/guard gate installation project.

OVERVIEW
State Road 934 is comprised of Normandy Drive, a westbound 3 lane road and 71 'I Street, an
eastbound 3 lane road within the Isle of Normandy, Miami Beach.
A section of the Island consisting of single family residential properties south of71'I Street, is
proposing to establish a special district with guardhouse/gated vehicular entry. This area, shown
hatched in the above sketch extends from Rue Granville on the west to Rue Versailles on the
East. At present, Biarritz Drive and Bay Drive are closed at Rue Granville to the west and at Rue
Versailles to the east. All vehicular traffic from this area accesses SR 934 through the Rue
Bordeaux intersection and the two signalized intersections at Trouville Esplanade and Rue Notre
Dame.
SCOPE OF WORK
The Scope of Work consists of evaluating and preparing a traffic impact study with
recornmendations if necessary, for the intersections at Trouville Esplanade, Rue Bordeaux and
Rue Notre Dame with State Road 934 as a result of closing Rue Bordeaux and Rue Notre Dame
to vehicular traffic and installing a guard house at Trouville Esplanade. This study should also
take into consideration maintaining the required pedestrian signals and sinal timing due to
pedestrian traffic to and from this area to the nearby shopping and recreational districts.

FUNDING SOURCE
Requested appropriation: $4,790 in $92 million G.O. Bonds, Series 2000, Fund No. 373, Normandy
Isle/Sud Neighborhood Improvements. The fund appropriation was recommended by the G.O.
Bonds Oversight Committee, at its meeting of July 31, 2000.
ANALYSIS
The residents of the Sud Area of Normandy Isle have approached the City, the Florida Department
of Transportation (FDOT) and Miami-Dade County with a proposal that a special district be
established and a guardhouse/gated vehicular entry be constructed for their neighborhood, as shown
in Exhibit A to this Agenda item. The proposed gated district would extend from Rue Granville
on the west to Rue Versailles on the east, south ofSR 934/ 71st Street to Biscayne Bay.
At present, Biarritz Drive and Bay Drive are already closed at both Rue Granville and Rue
Versailles. Vehicular traffic from this single-family residential area accesses the SR 934 couplet
(71 st Street/N ormandy Drive) via the Rue Bordeaux intersection and two signalized intersections
at Trouville Esplanade and Rue Notre Dame.

As a requirement from both the FDOT and County, a traffic impact study must be performed for the
intersections ofTrouville Esplanade, Rue Bordeaux, and Rue Notre Dame with State Road 934. The
study will assess the impacts that the proposed closing of Rue Bordeaux and Rue Notre Dame plus
the installation of a guard house at Trouville Esplanade may have on vehicular traffic in the area, on
Normandy Isle per se, and on the State roadway system. The study will also make recommendations,
if/as needed.
Three (3) telephone quotes were solicited by the City for this under $5,000 traffic impact study,
producing the following results:

The Administration chose the low bid by CWI, and recornmends the appropriation of$4,790 in G.O.

THIS AGREEMENT made and entered into this 27th day of September ,2000
by and between the CITY OF MIAMI BEACH, FLORIDA (hereinafter referred to as City),

CIVIL WORKS, INC. (hereinafterreferred to as Consultant), whose address is 3195 Ponce de

SECTION 1
DEFINITIONS

This written Agreement between the City and Consultant.
"City Manager" means the Chief Administrative Officer of the City.
All services, work and actions by Consultant performed pursuant to this
Agreement and as specifically described in Exhibit "A", on page 8.
SECTION 2
SCOPE OF WORK
The scope of work to be performed by Consultant is set forth in Exhibit "A," entitled "Scope of
Services" (Services).

SECTION 3
COMPENSATION
3,1 Fixed Fee
Consultant shall be compensated at an amount not to exceed Four Thousand Seven
Hundred Ninety and 00/1 00 Dollars ($4,790.00) for the Services performed herein, such Services
as set forth in Exhibit "A" hereto.
3.2 Method of Pavment
Payments shall be made within thirty (30) days of the date of invoice receival by the
City.

SECTION 4
GENERAL PROVISIONS
4.1 Responsibility of Consultant
With respect to the performance of the Services, Consultant shall exercise that degree of
skill, care, efficiency and diligence normally exercised by recognized professionals with respect
to the performance of comparable Services. In its performance of the Services, Consultant shall
comply with all applicable laws and ordinances, including but not limited to, applicable
regulations of the City, County, State, Federal Government, ADA, EEO Regulations and
Guidelines.
4.2 Public Entity Crimes
State of Florida Form PUR 7068, Sworn Statement under Section 287. 133(3)(a) Florida
Statute on Public Entity Crimes shall be filed with the Procurement Division.
4,3 Duration and Extent of Agreement
The term of this Agreement shall be for a period of approximately one (1) month from
receiving a "Notice to Proceed" from the City.

TERMINA nON
Termination for Cause
If Consultant shall fail to fulfill in a timely manner, or otherwise violate, any of the
covenants, agreements, or stipulations material to this Agreement, the City shall thereupon have
the right to terminate this Agreement. Prior to exercising its option to terminate for cause, the
City shall notify Consultant of its violation of the particular terms of this Agreement, and shall
grant Consultant seven (7) days to cure such default. If such default remains uncured after seven
(7) days, the City, upon three (3) days notice to Consultant may terminate this Agreement.
4.4.2 Termination for Convenience of City
Notwithstanding Section 4.4.1, the City may, for its convenience and without cause,
terminate this Agree~ent at any time by giving written notice to Consultant of such termination,

which shall become effective seven (7) days following receipt by Consultant of the written
termination notice.
4.5 Equal Employment Opportunity
In connection with the performance of this Agreement, Consultant shall not discriminate
against any employee or applicant for employment because of race, color, religion, ancestry, sex,
national origin, place of birth, marital status, or physical handicap.
4.6 Entiretv of A~reement
This writing and all exhibits hereto embody the entire Agreement and understanding
between the parties hereto, and there are no other agreements and understandings, oral or written
with reference to the subject matter hereof that are not merged herein and superseded hereby.
The exhibits and the Proposal Documents are hereby incorporated by reference into this
Agreement.
No alteration, change, or modification of the terms of this Agreement shall be valid
unless amended in writing, signed by both parties hereto, and approved by the City Commission
of the City of Miami Beach.

4.7 Indemnification
Consultant agrees to indemnify and hold harmless the City of Miami Beach and its
officers, employees and agents, from and against any and aU actions, claims, liabilities, losses,
and expenses, including, but not limited to, attorneys' fees, for personal, economic or bodily
injury, wrongful death, loss of or damage to property, at law or in equity, which may arise or be
alleged to have arisen from the negligent acts, errors, omissions or other wrongful conduct of the
Consultant, its employees, agents, sub-consultants, or any other person or entity acting under
Consultant's control, in connection with the Consultant's performance of the Services pursuant
to this Agreement; and to that extent, the Consultant shaU pay all such claims and losses and
shall pay all such costs and attorneys' fees expended by the City in the defense of such claims
and losses, including appeals. The parties agree that one percent (1 %) of the total compensation
to the Contractor for nerformance of the Services under this Agreement is the specific

consideration from the City to the Consultant for the Consultant's Indemnity Agreement.
The Consultant's obligation under this subsection shaU not include the obligation to
indemnify the City of Miami Beach and its officers, employees and agents, from and against any
actions or claims which arise or are aUeged to have arisen from negligent acts or omissions or
other wrongful conduct of the City and its officers, employees and agents. The parties each agree
to give the other party prompt notice of any claim coming to its knowledge that in any way
directly or indirectly affects the other party.
4.8 Limitation of City's Liability
The City desires to enter into this Agreement only ifin so doing the City can place a limit
on its liability for any cause of action for money damages due to an alleged breach by the City of
this Agreement, so that its liability for any such breach never exceeds the sum of $4,790.
Consultant hereby expresses its willingness to enter into this Agreement with Consultant's
recovery from the City for any damage action for breach of contract to be limited to a maximum
amount of $4,790, less the amount of aU funds actuaUy paid by the City to Consultant pursuant to
this Agreement.

Accordingly, and notwithstanding any other term or condition of this Agreement,
Consultant hereby agrees that the City shall not be liable to the Consultant for damages in an
amount in excess of $4,790, which amount shall be reduced by the amount actually paid by the
City to the Consultant pursuant to this Agreement, for any action of claim for breach of contract
arising out of the performance or non-performance of any obligations imposed upon the City by
this Agreement.
4.9 Assil:nment. Transfer or Subcontracting
The Consultant shall not subcontract, assign, or transfer any work under this Agreement
without the prior written consent of the City.
4.10 Equal Empl~ment Opportunity
In connection with the performance of this Agreement, the Consultant shall not
discriminate against any employee or applicant for employment because of race, color, religion,
ancestry, sex, age, national origin, place of birth, marital status, or physical handicap. The
Consultant shall take affirmative action to ensure that applicants are employed and that
employees are treated during their employment without regard to their race, color, religion,
ancestry, sex, age, national origin, place of birth, marital status, disability, or sexual orientation.
Such action shall include, but not be limited to the following: employment, upgrading, demotion,
or termination; recruitment or recruitment advertising; layoff or termination; rates of pay, or
other forms of compensation; and selection for training, including apprenticeship.
4.11 Notices
All notices and communications in writing required or permitted hereunder may be
delivered personally to the representatives of the Consultant and the City listed below or may be
mailed by registered mail, postage prepaid.

TASK 3 - TRAFFIC REDISTRIBUTIO~
Under this task. CWI ""ill redistribute the traffic based upon the proposed sueet closures and analyze the
impacts ofrhat redistribution on the intersections and roadways. In addition to analyzing the redistribution
of the existing traffic, CWI will analyze the impacts of the committed project traffic on the redistnoution
of the neighborhood traffic.
TASK 4 - TR.uTIC CONCURRE:\'CY
Existing concurrency conditions (including committed traffic) for State Road 934 ....ill be reviewed along
with a determination of the e:6ting Level of Service (LOS) for the intersections identified in Task:2 above.
Traffic from the neighborhood W11l be redistributed to the roadway netWork and a new LOS for the
roadways and intersections will be calculated. These LOS calculations will be summarized to determine
if the project meets ;>,liami Beach's concurrency requirements.

TASK 5 - EXTER.'\AL TRAFFIC DIPROVEMENTS
Reco=endations will be made regarding the need for any roadway improvements, intersection
improvements, additional traffic control devices or signalization improvements which would mitigate the
project impacts. Locations to be re."iewed include the following intersections and roadway links.
· Trouville Esplanade >'.ith State Road 934
· Rue Bordeaux v.ith State Road 934
. Rue Notre Dame with State Road 934
· State Road 934 east of Trouville Esplanade
· Trouville Esplanade south of State Road 934
These recommendations ""ill be discussed with you before any final recommendation is provided to the City.
Included v..ith this task is one meeting with City staff to review the report and any reco=ended
improvements. A project-specific traffic mitigation plan (if required) is not included in this proposal.

This task "ill include any special meetings that your organization may request during this time.
TASK 7 -DELIVERABLES
CWI will supply to the City six complete Traffic Impact Reports including all computer print-outs. The
report format will be in an 8-1/2" x 11" format acceptable to the City. In addition. one un-bound copy of
the report will be supplied to your office for further reproduction. The cost of reproducing the initial six
copies of the report will be included in this task.. _ ___ ._____n.
COMPENSATION
Based on the deadlines listed above, the fees for Tasks 1 throucll 5 will be for the stipulated sums indicated
below. The fees for Task 6 (project Representation) and any additional services you may require will be
at the hourly rates and categories shown below.
