A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
MIAMI BEACH, FLORIDA, ESTABLISHING THE ANNUAL LEASE
CHARGE, PER PARKING SPACE LEASED, PURSUANT TO THE
AGREEMENT BY AND BETWEEN THE CITY OF MIAMI BEACH
AND THE SENIOR CITIZENS HOUSING DEVELOPMENT
CORPORATION OF MIAMI BEACH, DATED JULY 19, 1976;
SETTING FORTH THE PARKING RATES FOR EACH SPACE.
WHEREAS, on July 19, 1976, the City and Senior Citizens Housing Development
Corporation of Miami Beach (Council Towers) entered into an Agreement, attached hereto, to lease,
on an annual basis, up to 25 parking spaces underneath the Council Towers Development; and
WHEREAS, the option to renew said spaces was on an annual basis, continuing throughout
the term of the lease of air rights between the City and Council Towers; and
WHEREAS, the annual lease price for each space was set forth in the Agreement, at a rate
of $158.00, or $13.17 per month, and the Agreement provided for the lease price to be at that rate
for the term of one year, commencing in 1976; and
WHEREAS, the Agreement further stated in Paragraph 4, "For spaces leased for a term of
one year, commencing in 1977 and thereafter, the annual lease charge per space shall be as
established by Resolution of the City Council of Miami Beach"; and
WHEREAS, during a review of the Agreement between the City and Council Towers, it was
found that the rate had not been adjusted since 1976; and
WHEREAS, the City's lot specific monthly parking program provides for a monthly rate
of $50.00 per permit, and the matter of a potential rate increase that is being proposed via ordinance
was discussed with the representative from Council Towers at the meeting in July 2000; and
WHEREAS, while the Administration prefers to be consistent in the application of parking
rates Citywide, it understands the need to keep parking at reasonable rates for the residents of
Council Towers; and
WHEREAS, the 1996 Agreement between Council Towers and the City provides for the
City Commission to establish the annual lease rate; it is thus recommended that the annual lease rate
be increased from $158/year, as established in 1976, to $180/year, reflecting a new lease rate of
$15.00 per space, per month, and said rate will be increased annually by $ 12/year, or $1/month, until
said parking rate per space equals half of the City's adopted monthly parking rate.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission establish the annual lease charge per parking space leased at $15.00 per space per
month and said rate will be increased annually by $ 12/year or $I/month until said parking rate per
space equals half of the City's adopted monthly parking rate, as provided for pursuant to the
Agreement by and between the City of Miami Beach and the Senior Citizens Housing Development
Corporation of Miami Beach dated July 19, 1976; setting forth the parking rates for each space.

AGREEMENT
In consideration of the sum of one dollar ($1.00) and
other good and valuable consideration, it is this ~ day of
July I 1976, agreed by and between the City of Midmi B(~ach and the
Senior Citizens Housing Development Corporatioll of Mialni Beaell,
hereinafter referred to as "The Development Corporation, " as
follows;
1. The City of Miami Beach docs grant and the Develop-
ment Corporation does accept an option to lease on an annual
basis parking spaces on the municipal parking lot operated by
said City at Eleventh Street and Collins Avenue in the City of
Hiami Beach, being Zone 11.
2. The number of spaces covered by this option sllal1
be up to 25 spaces at said parking lot referred to in paragraph 1
hereof.
3. The option granted herein shall contirlue during the
term of the lease of the air rights between the City of Miami
Beach and the Development Corporation above said municipal park-
ing lot, and any extension~ thereof,

4. The lease price shall be one Ilundred fifty-eigl1t
dollars ($158.00) per annum for each space leased conunencing in
1976.
For spaces leased for a term of one year commencing in
1977 and thereafter, the annual lease cllarge per space slla11 be

5. There is no obligatioll on the part of the Develop-
lnent Corporation to lease any of the spaces covered by this
option.

the leasing of spaces for a term of one year from time to time as
its requirements dictate. up to the maximum number of spaces as

ANALYSIS
Pursuant to the directive of the Mayor and City Commission at the City Commission meeting of July
26,2000, the following is a report on the parking issues surrounding Council Towers. This item was
deferred from the September 27,2000 City Commission meeting.
On July 19, 1976, the City of Miami Beach and Senior Citizens Housing Development Corporation
of Miami Beach (Council Towers) entered into an Agreement, attached hereto, to lease, on an annual
basis, parking spaces underneath the Council Towers Development. The number of spaces covered
in the agreement was for up to 25 spaces. The option to renew said spaces was on an annual basis,
continuing throughout the term of the lease of air rights between the City of Miami Beach and
Council Towers. The annual lease price for each space was set forth in the Agreement at a rate of
$158.00, or $13.17 per month. The Agreement provided for the lease price to be at that rate for the
term of one year, commencing in 1976. The Agreement further stated in Paragraph 4; "For spaces
leased for a term of one year, commencing in 1977 and thereafter, the annual lease charge per space
shal1 be as established by Resolution of the City Council of Miami Beach."

In July of 2000, Council Towers met with the City Administration to discuss the possibility of
installing a security parking control device to deter unpermitted parkers and vagrants. During a
review of the Agreement between the City and Council Towers, it was found that the rate had not
been adjusted since 1976. In January 1997, the Mayor and City Commission adopted by Resolution,
a lot specific monthly parking program and monthly rate of $50.00 per permit. The matter of a
potential rate increase was discussed with the representative from Council Towers at the meeting in
July.
While the Administration would like to be consistent in the application of parking rates citywide,
we understand the need to keep parking at reasonable rates for the residents of Council Towers;
therefore, it is recommended that the City Commission establish the annual lease rate per space, as
provided for in the 1976 Agreement between Council Towers and the City, at $180/year vs.
$158/year, reflecting a rate of$15.00 per space, per month. Said rate will be increased annual1y by
$ 12/year or $1Imonth until said parking rate per space equals half of the City's adopted monthly
parking rate.
It is recommended that the Mayor and the City Commission adopt the attached resolution
establishing the annual lease charge per space, as provided for in the Agreement by and between the
City of Miami Beach and the Senior Citizens Housing Development Corporation of Miami Beach,
dated July 19, 1976.
