ASSOCIATED DESIGN OF ALTERNATIVE PARKING
IN AN AMOUNT NOT -TO -EXCEED $24,900.00 FOR
NEIGHBORHOOD NO. 8 — BAYSHORE AND SUNSET ISLANDS PROJECT.
This Amendment No. 8 to the Agreement made and entered this 1 day of
SPT-EMkEk , 20 oto, by and between the CITY OF MIAMI BEACH, a Municipal
Corporation existing under the laws of the State of Florida (hereinafter referred to as
CITY), having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida
33139, and CH2M Hill, having its offices at 800 Fairway Drive, Suite 350, Deerfield
Beach, Florida, 33441(hereinafter referred to as CONSULTANT).
RECITALS
WHEREAS, pursuant to Request for Qualifications (RFQ) No. 134-99/00, the
Mayor and City Commission adopted Resolution No. 2001-24387, on May 16, 2001,
approving and authorizing the Mayor and City Clerk to execute an Agreement with CH2M
Hill, for Professional Services for the Bayshore and Sunset Islands Streetscape Right -of -
Way Neighborhood Project (the Project); and
WHEREAS, the Agreement provides for the detailed planning services for various
streetscape / landscape / utility improvements within the Bayshore and Sunset Islands
neighborhood; and
WHEREAS, the Agreement was executed for a not -to -exceed amount of
$133,174.00; and
WHEREAS, the planning effortforthe Bayshore and Sunset Islands neighborhood
has been completed and detail design activities are underway; and
WHEREAS, on December 10, 2003, the Mayor and City Commission adopted
Resolution No. 2003-25432, approving additional design services as Amendment No. 1 to
the Agreement, for planning, design, permitting, bidding / award and construction
administrative services for the Bayshore and Sunset Islands neighborhood for a not -to -
exceed amount of $1,913,302.00; and resulting in a revised contract fee of

1 $2,046,476.00, and
WHEREAS, on February 24, 2005, Amendment No. 2 to the Agreement was
executed, to re -package Sunset Islands 1 and 2 from Bid Package 8D to Bid Package
8B, for $0.00; resulting in a revised contract fee of $2,046,476.00 ,and
WHEREAS, on November 8, 2005, Amendment No. 3 to the Agreement was
executed to include the completion of a topographic survey along Pine Tree Drive from
West 28th Street to West 40tri Street along the east side of the road, for a not -to -exceed
amount of $12,850.00; resulting in a revised contract fee of $2,059,326.00 and
WHEREAS, on February 17, 2006, Amendment No. 4 to the Agreement was
executed to include the evaluation, permitting and preparation of construction cost
alternatives for the installation of curbs/valley gutters to Sunset Islands 1 and 2; for a not -
to -exceed amount of $2,500.00 resulting in a revised contract fee of $2,061,826.00; and
WHEREAS, on February 16, 2006, Amendment No. 5 to the Agreement was
executed to include the installation of four (4) drainage test wells to provide additional
information for the preparation of a Letter of Reasonable Assurance to be submitted to
the Florida Department of Environmental Protection (FDEP), as required in the permit
application for the Project; for a not -to -exceed amount of $55,863.00 resulting in a
revised contract fee of $2,117,689.00; and
WHEREAS, on September 6, 2006, Amendment No. 6 to the Agreement was
executed to include the installation of "P3.2" classified water main replacements required
by the City's Public Works Department; for a not -to -exceed amount of $372,230.00
resulting in a revised contract fee of $2,489,919.00; and
WHEREAS, on September 9, 2006, Amendment No. 7 to the Agreement was
executed to include the installation of bike lanes/routes required by the City's Public
Works Department in a not to exceed fee of $58,128.00 resulting in a revised contract fee
of $2,548,047.00; and
WHEREAS, this Amendment No. 8, to include the installation of alternative parking
in the Lake Pancoast area; for a not -to -exceed amount of $24,900.00 resulting in a
revised contract fee of $2,572,947.00; and
WHEREAS, this proposal has been evaluated by Hazen & Sawyer, the City's
Program Manager, and the CIP Office, and
NOW, THEREFORE, the parties hereto, and in consideration of the mutual
promises, covenants, agreements, terms, and conditions herein contained, and other
good and valuable consideration, the respect and adequacy are hereby acknowledged,
do agree as follows:

1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as a part of this
Amendment No. 8.
2. MODIFICATIONS
The Agreement is amended as defined in Schedule "A- 8", attached herein.
3. OTHER PROVISIONS.
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION.
The City and Consultant ratify the terms of the Agreement, as amended by this
Amendment No. 8.

SCOPE OF SERVICES
Schedule "A" entitled, "Scope of Services", is amended as follows:
ADD the following under Task 5 — ADDITIONAL SERVICES, after the language added for
Amendment No.1:
Task 5.6 — Design of Alternative Parking in Lake Pancoast area:
The Consultant shall provide detailed design services for producing contract documents
(specifications and drawings) as needed for the construction of alternative parking in the
Bayshore Neighborhood as noted below. In this effort, the Consultant shall be bound by the
requirements stipulated in TASK 2 — DESIGN SERVICES as adopted via Resolution No.
2003-25432, on December 10, 2003, approving and authorizing the Mayor and City Clerk to
execute an Agreement with CH2M Hill for Professional Services for the Bayshore
Neighborhood Right of Way Improvement Project.
Due to limited parking and permit parking signage added in areas of the Bayshore
neighborhood — Lake Pancoast, new additional parking is required based on the attached
neighborhood map and assumptions.
In general, new alternative parking shall be included as follows:
1. W 24th Terrace from Pine Tree Dr. to Flamingo Place: On one side of the road
(north side). Design to match what is currently proposed on W 24th Terrace from
Flamingo PI. to Flamingo Drive. Design will be based on road cross section sketch A
- attached.
2. Flamingo Place from W 24th Terrace to W 25th St.: Open pavers with 8 inch header
curb on both sides of road. Design will be based on road cross section sketch B -
attached.
3. W 25th St. from Flamingo Dr. to Flamingo Place: Open pavers with 8 inch header
curb on both sides of road. Design will be based on road cross section sketch B -
attached.
4. W 25th St. from Flamingo Place to Pinetree: Open pavers with curb on one side of
road (south side). Design will be based on road cross section sketch B - attached.
Consultant shall re -visit storm water calculation models with the additional impervious areas
being created by the pavers required to implement the new alternative parking. There are no
existing catch basins in these areas. No new stormwater collection system is included as
part of this scope. For the scope of this Amendment, it is assumed approximately 400 linear
feet of exfiltration trenches under the open pavers and eight (8) new catch basins will
address additional runoff. In addition, it is assumed that that the primary physical
components of the proposed stormwater system will not require re -design (no impact to

number of wells, Pump station size, pump sizes, etc). If it is determined that the additional
impervious area created by the open pavers results in impacts to the current stormwater
design, a separate design revision Amendment will be requested by the Consultant.
In addition to revising existing design documents as necessary to accommodate new
alternative parking, the Consultant shall also revisit the encroachment tabulations, as new
removals will result from this effort. Demolition drawings shall be revised to indicate the
removal of additional encroachments. Landscape drawings shall illustrate revised sight
triangle locations. In addition, the new alternative parking improvements shall be added to
the 90% construction cost estimate.
TIME OF COMPLETION
Additional design services contemplated by this Amendment are to be incorporated into
the Bid Package 8B 100% design documents and submitted to the City by July 31, 2007.
PAYMENT AND COMPENSATION
The method of calculating the fees for the aforementioned proposed architectural and
engineering services is established in Exhibit `A8' attached, based on estimated labor plus
direct costs. The total fee proposed for this Scope of Work shall be on a not -to -exceed
basis in the amount of $24,900.00. Invoicing will be monthly and based on hourly rates as
defined in the current agreement between CH2M HILL and the City of Miami Beach.
CONSULTANT's request for additional services is attached for reference purposes.
COMPENSATION
• Original Agreement amount $133,174.00.
• Amendment No. 1 (Design services for the Bayshore and Sunset Islands
Neighborhood) amount $1,913,302.00.
• Amendment No. 2 (Re -packaging of Sunset Islands 1 and 2 from Bid Package 8D to
Bid Package 8B) amount $0.00
• Amendment No. 3 (Completion of additional topographic survey along Pine Tree
Drive) amount $12,850.00.
• Amendment No. 4 (Opinion of design, permitting and evaluation of construction cost
alternatives for the installation of curbs/valley gutters to Sunset Islands 1 and 2)
amount $2,500.00.
• Amendment No. 5 (Installation of four (4) drainage test wells) amount $55,863.00.
• Amendment No. 6 (Design services for installation of "P3.2" water mains) amount
$372,230.00

As per our Negotiations meeting on August 11, 2006, we are pleased to re -submit the
attached fee proposal for additional Design Services for the following item: Alternative
Parking. The fee requested to perform this work is $24,900 as detailed in the attached
Summary Sheet and backup information. The detailed Scope of Work for the Design
Services to be provided is as follows:

The services to be provided for alternative parking are as follows:

o Modify existing Design Documents for the Bayshore neighborhood, as necessary, to
incorporate new alternative parking.
o Modify/re-run existing stormwater calculation models with the additional
impervious areas.
o For Package C, submit alternative parking drawings at the 60% design stage to the
Program Manager for review four (4) weeks for the Notice to Proceed.
o Revise and incorporate the design drawings for the new alternative parking into the
90% Design Documents for Package C within four (4) weeks of receipt of Program
Manager's 60% review comments.
o Revise Opinion of Probable Construction Cost to include alternative parking.
o Revise Storm water Permit application to include exfiltration trendies under open
pavers.
The additional design services to be provided for new alternative parking are based on the
following assumptions:
o There are no existing catch basins in these areas. No new stormwater collection
system is included as part of this scope of work. It is assumed that approximately
400 linear ft of exfiltration trenches under the open pavers plus 8 new catch basins
will address additional stormwater runoff.
o Alternative parking areas will be 8 ft. 6 inches wide and will be placed beside the
existing roads. They will be delineated with an 8 inch header curb along the
perimeter of the open pavers.
o Re-evaluation of encroachments will be required for the new alternative parking.
Demolition drawings will show removal of additional encroachments, existing
aprons and swales. Existing landscaping drawings will be modified; however, no
additional landscaping is required in this area.
o Modifications to the existing topographic survey are not required for the new
alternative parking.
o Modifications to the existing geotechnical subcontract with Nutting Engineers to be
amended. Current project reimbursables from existing task 6.4 Geotechnical to
cover additional percolation tests at proposed exfiltration locations under new
alternative parking areas. Subconsultant's fee not to exceed $1000.

o No special permit applications or costs are included in the fee.
o Additional meetings with residents, City Commission or other City Departments are
not included in the fee.
It is anticipated that the final delivery of the Bayshore/Sunset Islands - 100% Design
Documents for Package C will be submitted to the Program Manager as shown on the
attached time table.
