A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER
PERTAINING TO THE RANKING OF FIRMS PURSUANT TO REQUEST FOR
PROPOSALS (RFP) NO. 39-05/06 FOR THE MANAGEMENT AND OPERATION OF
CONCESSION STANDS AND BEACHFRONT CONCESSIONS, LOCATED EAST OF
COLLINS AVENUE AT BOTH 21 ST STREET AND 46TH STREET; AUTHORIZING THE
ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH THE TOP-RANKED FIRM
OF TOBY'S CONCESSION SERVICES, INC., AND SHOULD THE ADMINISTRATION
NOT BE ABLE TO NEGOTIATE AN AGREEMENT WITH THE TOP-RANKED FIRM,
AUTHORIZING THE ADMINISTRATION TO NEGOTIATE WITH THE SECOND-
RANKED FIRM OF M 8~ M CONCESSIONS, INC.; AND FURTHER AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT UPON COMPLETION OF
SUCCESSFUL NEGOTIATIONS BY THE ADMINISTRATION.
WHEREAS, because beach tourism is vital to the economic well being of the community
and the availability of accessible restrooms and concession facilities is vital to beach tourism, the
Administration initiated the design of concession and restroom facilities; and
WHEREAS, the Mayor and City Commission at its November 19, 2004 meeting adopted
Resolution No. 2004-25741 approving the construction of beachfront restroom and concession
facilities located east of Collins Avenue at both 21St Street and 46th Street; and
WHEREAS, on July 12, 2006, the City Commission authorized the issuance of an RFP to
solicit proposals for the management and operation of concession stands and beachfront
concessions, located east of Collins Avenue at both 21St Street and 46th Street; and
WHEREAS, at that time, the anticipated completion date for construction was September
2006 for the 46th Street location, and May, 2007 for the 21St Street location; and
WHEREAS, RFP No. 39-05/06 was issued on August 3, 2006, and proposals were sent or
provided to over thirty (30) firms and concessionaires; and
WHEREAS, due to delays in the completion of construction of the concession building at
21St Street, and a beach renourishment project that was underway at the 46th Street location, the
date for receipt of proposals was deferred until March 29, 2007; and
WHEREAS, on the specified due date, the Procurement Division received responses from
M & M Concessions, Inc.; Michael J. Roberts; and Toby's Concession Services, Inc.; and
WHEREAS, on June 4, 2007, the City Manager via Letter to Commission No. 125-2007;
appointed an Evaluation Committee (the "Committee"), consisting of the following individuals:
Ray Breslin, Collins Park Neighborhood Association;
Brad Wilson, The James Group;
Luiz Rodrigues, ECOMB, Inc;
Julio Magrisso, Assistant Director, CMB Parks and Recreation;
Lisa Botero, Environmental Specialist, CMB Public Works; and
WHEREAS, the Committee convened on June 18, 2007, and was provided with an
overview of the project, information relative to the City's Cone of Silence Ordinance and the
Government in the Sunshine Law; and
WHEREAS, the Committee participated in discussions of each of the proposals, and was
instructed to scored and rank each proposal pursuant to the evaluation criteria established in the
RFP, which was as follows, for a total possible of 100%:
• Financial -Financial Capability to perform the services outlined in the RFP, and Proposed
minimum guaranteed revenue or percentage of gross - 30 %;
• Experience and qualifications -Experience and qualifications of the Proposer, Management
team's experience and qualifications, and Past performance - 35%;
• Methodology and Approach -Methodology and approach relative to ensuring successful
Concessions, Risk Assessment Plan(s), and Customer Service Plan(s) - 20%;
• Past performance based on Client Surveys -Volume and quality of surveys submitted by clients
- 15%; and
WHEREAS, the Committee unanimously ranked Toby's Concessions, Inc. as the top-ranked
firm; and
WHEREAS, the Committee unanimously ranked M & M Concessions, Inc. as the second-
ranked firm; and
WHEREAS, the City Manager concurs with the Committee's recommendations.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept
the recommendation of the City Manager pertaining to the ranking of firms pursuant to Request for
Proposals (RFP) No. 39-05/06, for the management and operation of concession stands and
beachfront concessions, located east of Collins Avenue at both 21St Street and 46th Street; authorize
the Administration to enter into negotiations with the top-ranked firm of Toby's Concessions, Inc.;
and should the Administration not be able to negotiate with the top-ranked firm, authorizing the
Administration to negotiate with the second-ranked firm of M & M Concessions, Inc.; and further
authorize the Mayor and City Clerk to execute an agreement upon conclusion of successful
negotiations by the Administration.

The 46th Street restroom is completed, and the 21St Street restroom is scheduled for
completion at the end of September or beginning of October.
RFP PROCESS
RFP No. 39-05/06 was issued on August 3, 2006, and proposals were sent or provided to
over 30 firms and concessionaires.
Due to time extensions granted to complete the construction of the concession building at
21St Street, and a beach renourishment project that was underway at the 46th Street location,
the date for receipt of proposals was deferred until March 29, 2007. The RFP resulted in
the receipt of three (3) proposals from the following firms:

Upon deliberating the proposals, the Committee proceeded to score and rank them as

The Committee unanimously ranked Toby's Concessions, Inc. as the top-ranked firm.
Toby's is solely in the concession business, and they have a record of being consistent and
successful. For over ten years, Toby's has maintained concessions at venues that include,
but not be limited to, Crandon Park Beach, Haulover Beach, Miami MetroZoo, Seaquarium,
Hobie Beach, all the City of Parkland parks, the Orange Bowl, the Bank Atlantic Center, UM
Mark Light Stadium, the Palmetto Golf Course, high schools and municipal stadiums,
NASCAR events, the Fort Lauderdale Air and Sea Show, major music festivals, major art
festivals, and several other key events in South Florida.
Toby's proposal communicated their focus on training their staff, with emphasis on customer
satisfaction, which includes a training manager as part of the management team.
Included in Toby's proposal is an environmentally friendly commitment, including providing,
monitoring, and maintaining recycling and refuse bins on site at their concessions. Their
employees are trained in environmental awareness, with the emphasis to control litter in their
concession area.
M & M Concessions' owner, Mr. Wilcox, has over 30 years of experience combined in the
beach concession and food and beverage business, all of which has been on Miami Beach.
His experience includes, but is not limited to, handling the beach and cabana area as well as
being a licensed pool manager and swim instructor at the Doral Beach Hotel, operating
Beaches Bar and Grill, the Tikki Hut Pool Bar and the gift shop at the Days Inn Hotel at 43rd
Street and Collins Avenue, operating the beach area concession at 23rd Street and Collins
Avenue for the owners of the Days Inn, owning and operating Free Spirits Sports Cafe,
Liquor Lounge, Dewey's Tavern, and Bar-B-Q Beach restaurant. The Committee
recognized Mr. Wilcox's extensive understanding of Miami Beach business and local
operations.
The Committee collectively articulated that both Toby's and M & M would be successful in
managing and operating the City's concessions pursuant to the scope of the RFP, given
their years of experience and their qualifications. The client performance evaluation surveys
and letters of reference were positive for both firms, and they are both strong financially.

Toby's proposal to the City includes the following financial offer and approach on providing
management and operation of concession stands and beachfront concessions:
Financial Proposal:
Option A: Entire Concession. All Food and Beachfront Equipment Concessions, 21st and
46th Streets.
• Minimum Guaranteed Annual Concession Fee: $120,501.00, or:
• 31 % of gross receipts, whichever is higher
• First year equipment investment valued at approximately $120,000.00
- If sales exceed $388,712.00, the City will receive a sum greater than the minimum annual
guarantee.
- If sales of $1 million: $310,000.00 of revenue to the City.
Option B: Management and Operation of Food and Beverage Concessions Stands at 21st
and 46th Streets
• Minimum Guaranteed Annual Concession Fee: $75,300, or:
• 25% of gross receipts, whichever is higher
• First year equipment investment valued at approximately $50,000.00
Option C: All Food and Beachfront Equipment Concessions at 21st Street (only).
• Minimum Guaranteed Annual Concession Fee: $65,600 or:
• 28% of gross receipts, whichever is higher
• First year equipment investment valued at approximately $80,000.00
Option D: All Food and Beachfront Concessions at 46th Street (only).
• Minimum Guaranteed Annual Concession Fee: $30,100.00, or:
• 25% of gross receipts, whichever is higher
• First year equipment investment valued at approximately $50,000.00
As only Option A and Option B satisfy the requirement in the RFP of operating the
concessions at both 21St Street and 46th Street, these are the only options that could be
considered by the Committee. The Committee found Option A to be in the best interest of
the City.
Toby's has agreed to provide an estimated $50,000 of new food handling equipment with
Option A.
As part of their agreement with the City, Toby's will be providing the following products:
• Hebrew National Hot Dog Steamers
• Bosco Brand Pizza Warmers
• J&J Pretzel Warmers
• Blue Bunny Branded Ice Cream Freezers
• Coca-Cola sliding door refrigerators
• Brand name ice makers, microwaves, blenders, freezers and cold preparation counters
• Golf carts, two way radios, and employee uniforms

Toby's has proposed to make significant investments in Miami Beach's beachfront
equipment rentals.
Toby's has proposed investing an estimated $70,000 in beachside equipment rentals,
including equipment by Sunburst Outdoor Furniture, and Sole, Inc, both industry leaders in
attractive beachfront furniture.
Additionally, Toby's maintains trucks, golf carts and other equipment necessary to properly
equip and setup beachfront concessions operations.
Attached are letters of reference from some of Toby's suppliers, as well as a letter from
Bank Atlantic certifying their financial stability.
Ranked third, Michael J. Roberts' proposal is his initial venture as a concessionaire. While
the Committee found Mr. Roberts' ambition commendable, his proposal did not demonstrate
any financial backing and he lacks experience as a proprietor. Mr. Roberts was not able to
provide references or have clients submit surveys due to his not yet being established as a
business manager. The Committee expressed that the two new City concessions may not
be an appropriate first business venture, and that perhaps Mr. Roberts should consider
starting out with a smaller initiative and grow his business.
CONCLUSION
The Administration recommends that the Mayor and City Commission approve the attached
resolution, which recommends the acceptance of the ranking of the firms, and authorizes the
Administration to enter into negotiations with the top-ranked firm of Toby's Concession
Services, Inc.; and should the Administration not be able to negotiate with the top-ranked
firm, authorizing the Administration to negotiate with the second-ranked firm of M & M
Concessions, Inc.; and further authorizing the Mayor and City Clerk to execute an
agreement upon the completion of successful negotiations by the Administration.
