A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 4,
TO THE AGREEMENT WITH HARGREAVES ASSOCIATES,
INC., IN THE AMOUNT OF $508,210, FOR ADDITIONAL
PROFESSIONAL SERVICES FOR THE SOUTH POINTE PARK
IMPROVEMENTS PROJECT FROM THE PREVIOUSLY
APPROPRIATED SOUTH POINTE CAPITAL PROJECTS FUND
N0.379 CONTINGENCY.
WHEREAS, pursuant to Request for Qualifications (RFQ) No. 39-03/04, the
Mayor and City Commission adopted Resolution No. 2005-25789, on January 12, 2005,
approving and authorizing the Mayor and City Clerk to execute an Agreement with
Hargreaves Associates, Inc. (Consultant), in the amount of $328,505, limited to the
planning of the South Pointe Park Improvement Project (the Project); and
WHEREAS, the Planning Phase has been completed by the Consultant; and
WHEREAS, on July 27, 2005, the Mayor and City Commission approved the
Basis of Design Report (BODR) for the Project, pursuant to Resolution No. 2005-25978;
and
WHEREAS, on October 19, 2005, the Mayor and City Commission approved
Amendment No. 1 to the Agreement, in the amount of $1,322,373, which provided for
additional professional architecture and engineering (A/E) services associated with the
completion of the Design Phase, Permit Processing (as applicable), Bid and Award, Cost
Review, and Construction Administration Services for the Project; and
WHEREAS, on October 11, 2006, the Mayor and City Commission approved
Amendment No. 2 to the Agreement, in the amount of $267,134, for additional A/E
services relative to the Conceptual Design, Schematic Design, development of a Design
Criteria Package, Bid Coordination, and Construction Administration Services for the
South Pointe Pier; and
WHEREAS, the City concurs with the Consultant's recommendation to extend
the Park's improvements beyond its property limits to include a portion of Washington
Avenue to South Pointe Drive fora better intergraded design; accordingly, the
Consultant has requested additional services, in the amount of $50,925; and
WHEREAS, additionally, the Project has experienced delays related to the
commencement of the construction of the Project; and
WHEREAS, there has been a change in the projected Project construction
schedule, as identified by the Project contractor, MCM; and
WHEREAS, the Consultant is requesting additional fees associated with the
above Project construction commencement delays, and changes to the Construction
Administration fee, including additional associated reimbursable fees, in the amount of
$457,285; and
WHEREAS, the Administration recommends an additional appropriation of funds,
in the amount of $508,210, from the South Pointe Capital Projects Fund; and
WHEREAS, the Administration and Consultant have negotiated the following
Amendment No. 4, to the Agreement, in the amount of $508,210, for the aforestated
additional A/E services relative to the Project.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve and authorize the Mayor and City Clerk to execute
Amendment No. 4, to the Agreement with Hargreaves Associates, Inc., in the amount of
$508,210, for additional professional services for the South Pointe Park Improvements
Project from the previously appropriated South Pointe Capital Projects Fund No. 379
Contingency.

South Pointe Park. On January 12, 2005, the City Commission authorized the execution of an Agreement
between the City of Miami Beach and Hargreaves Associates, Inc. (Hargreaves) for the planning of the
South Pointe Park Improvements Projects (Project), in the amount of $328,505. On July 27, 2005, the
Mayor and City Commission approved the Basis of Design Report (BODR). On October 19, 2005, the
Mayor and City Commission authorized Amendment No. 1, to the Agreement with Hargreaves, in the
amount of $1,322,373, for additional professional services for the continuing design development of the
Project. On October 11, 2006, the Mayor and City Commission approved Amendment No. 2, to the
Agreement with Hargreaves, in the amount of $267,134, for additional A/E services relative to the
Conceptual Design, Schematic Design, development of a Design Criteria Package, Bid coordination and
Construction Administration services for the South Pointe Pier, funded separately from the Project.
Additionally, Hargreaves is requesting the following additional services associated with proposed upgrades
along Washington Avenue; additional services associated with additional Construction Administration
services and associated reimbursable fees. The Administration had intended tc, proceed with the
construction of the Project with the Related Group (Related) as part of the Settlement Agreement on the
Alaska Parcel, and the Agreement with Hargreaves was written taking into consideration this un-traditional
approach to the construction of the Project due to Related's involvement. Since then, the City decided not
to proceed with Related, and instead, issued an Invitation to Bid (ITB) to solicit potential contractors,
hence, affecting Hargreaves' Agreement with the City.
The Administration recommends approval of these additional services, in the amount of $508,210. These
will be funded from the previously appropriated South Pointe Capital Projects Fund No. 379 Contin ency

FUNDING
Funding from the previously appropriated South Pointe Capital Projects Fund No. 379
Contingency.
ANALYSIS
In June 1996, the City of Miami Beach adopted a Parks Master Plan that included major
improvements to South Pointe Park. On September 8, 2004, the City Commission
authorized the issuance of RFQ No. 39-03/04 which included a revised scope of architect
and engineering services for the park improvements. Hargreaves Associates, Inc.
(Hargreaves) was the top ranked firm. On January 12, 2005, the City Commission
authorized the execution of an Agreement between the City of Miami Beach and Hargreaves
for the Planning Phase of South Pointe Park Improvements, in the amount of $328,505.
On July 27, 2005, the Mayor and City Commission approved the Basis of Design Report
(BODR), prepared by Hargreaves, as presented.
On October 19, 2005, the Mayor and City Commission authorized Amendment No. 1, to the
Agreement with Hargreaves, in the amount of $1,322,373, for additional professional
services for the continuing design development of the South Pointe Park Improvements
Project.
On October 11, 2006, the Mayor and City Commission approved Amendment No. 2, to the
Agreement with Hargreaves, in the amount of $267,134, for additional A/E services relative
to the Conceptual Design, Schematic Design, development of a Design Criteria Package,

Bid coordination and Construction Administration services for the South Pointe Pier, funded
separately from the South Pointe Park Improvements Project.
Additionally, Hargreaves is requesting the following additional A/E services:
Additional professional services, in the amount of $50,925, associated with proposed
upgrades along Washington Avenue from the Park's current property line to South Pointe
Drive, extending the Park's improvement beyond its property limits. Refer to Attachment B.
Additional services, in the amount of $432,285, and reimbursable fees, in the amount of
$25,000, associated with additional Construction Administration services due to delays
experienced in the commencement of the Project's construction phase, an extension to the
originally projected construction schedule to meet the current projected timeline plus an
additional month to provide for supplemental A/E services should project delays occur;
additional on-site Project Management involvement from Hargreaves as requested by the
City; an adjustment of hourly fees to reflect 2007 rates, as provided for in the Agreement;
and additional fees associated with the extended Project schedule durations from nine (9) to
eighteen (18) months. In addition, the Administration had intended to proceed with the
construction of the Project with the Related Group (Related) as part of the Settlement
Agreement on the Alaska Parcel, and the Agreement with Hargreaves was written taking into
consideration this un-traditional approach to the construction of the Project due to Related's
involvement. Since then, the City decided not to proceed with Related, and instead, issued
an Invitation to Bid (ITB) to solicit potential contractors, hence affecting Hargreaves'

CONCLUSION
The Administration recommends that the Mayor and City Commission adopt the Resolution
approving and authorizing the Mayor and City Clerk to execute Amendment No. 4, to the
Agreement with Hargreaves Associates Inc., in the amount of $508,210, for additional
professional services for the South Pointe Park Improvements Project from the previously
appropriated South Pointe Capital Projects Fund No. 379 Contingency.
