RESOLUTION NO. 2000-24190
A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, APPROVING THE CITY'S YEAR 2001
STATE LEGISLATIVE PRIORITIES.
WHEREAS, the City's State Legislative Team has met with the Mayor, Commissioners,
and the Administration relative to the City's needs; and
WHEREAS, the City's State Legislative Team has met with Department heads and City
staff to ascertain their needs; and
WHEREAS, the City Administration has met with the Quality in Education Committee
and with the Legislative Division of Miami-Dade County Public Schools; and
WHEREAS, the City met with the Miami Beach Chamber of Commerce to evaluate
priorities submitted by the Chamber's Governmental Affairs Committee; and
WHEREAS, the City Administration has communicated with the City's representatives
and members of the Florida State House and Senate; and
WHEREAS, the City's numerous state-level needs have been assessed and prioritized in
the attached "Outline ofthe Proposed 2001 State Legislative Agenda for the City of Miami Beach"
to produce the most effective use of its legislative team.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the recommended State
legislative priorities for the 2001 Legislative Session as set forth in the attached "Outline of the
Proposed 2001 State Legislative Agenda for the City of Miami Beach" are hereby approved.

Electrowave Onerations
The City of Miami Beach requests $500,000 in transit operating assistance for the Electrowave
Shuttle Service, on a continued basis, beginning FY 2001-02, For its first three years of operation
(January 20, 1998 through January 19, 2001) FOOT District Six provided from $450,000 to
$650,000/year in Service Development Funds for the Electrowave Shuttle Service,
However, due to the success of the Electrowave project in Miami Beach, several Miami-Dade
County municipalities (Downtown Miami, North Miami, Hialeah, Coral Gables, etc,) have also
begun implementing similar local circulator services in their communities, thereby competing with
Miami Beach for the limited amount of Service Development Funds available each year through
FOOT. Essentially, the Electrowave is being penalized for its own success.
At the same time, the city is being forced to fund an ever increasing portion of the shullle
operating costs each year, As an example, the FY 2000-01 Electrowave Operating Budget is
$1,925,993, Of this amount, $1.050 million come from Miami Beach Parking Enterprise Retained
Earnings, while only $139,993 come from FOOT,
In addition, FDOT District Six has scheduled roadway reconstruction projects for AlA/Collins
A venue in South Beach, from 5th Street to 26th Street, and the City needs to expand the shullle
service to Collins A venue as part of the "movement of traffic (MOT)" for the three segments of
the project, which will take place in 2001, 2002, and 2003, respectively, Additional operating
funds should come from the State level for this purpose, (Transportation and Concurrency

16th Street Imnrovements
We are asking $500,000 in State assistance for the milling/repaving/striping of 16th Street (South
Beach), which has become a major connector between AlA/Collins Avenue and SR,907/Alton
Road, since the building of the Loews' Hotel on Collins A venue, Sixteen Street functions as a
collector road in Miami Beach, is an alternative to 17th Street for east-west traffic, and also
relieves pressure on the State roads, (Transportation and Concurrency Management Division)
West Avenue Improvements
We are asking $500,000 in State assistance for the milling/repaving/striping of West Avenue
(South Beach), from 17th Street to the MacArthur Causeway, West Avenue runs parallel to
SR.907/Alton Road, and helps relieve pressure on Alton Road during peak travel times,

Intermodal
Explore funding options to match the Federal dollars that have been allocated to the Miami Beach
Intenoodal Facility, This project will be submitted to the State's Fast Track Grant Program in
November 2001 for the 2002 Legislative Session.

Adult Dav Care for Seniors With Earlv Alzheimer's
There is a great need for a structured, non-residential program in a protective selling for
Alzheimer's patients who are still continent but demonstrate increased memory loss and confusion,
There are existing adult day care settings on Miami Beach but these do not serve the Alzheimer's
population, a group that is ever-growing, A day care program will enable people to remain in the
community and will give great relief to caregivers, Funding could be provided to an already
existing day care site or to a new facility, (Office of Elder Affairs)

As is often the case, a senior, active in the community, suffers a fall or an illness and after
hospitalization spends several weeks in a rehabilitation facility, Once home and on a fixed income,
services such as housekeeping and shopping are cost prohibitive, If these services could be
provided on a non-payment basis for even two weeks, a senior citizen will then be able to stay in

the community and maintain an independent status, There is a growing population of elders who
stay long term in a nursing facility because they are simply too weak to be independent at home
just yet. This is a crisis situation thai can be greatly alleviated through the grant process, Funds

Within the next few years the first of the baby boomers will hit seniority, Concurrently the
population of Miami Beach has grown younger over the last few years with people living and
working here on a permanent basis, Research must address itself to the expected needs of the
boomers in regard to long term home health insurance, housing, and other vital issues related to
maintaining quality of life, This senior community will be vastly different than lItose seniors now
65 years of age and up, People will be retiring later and will need very different auxiliary services,
To prepare for this tremendous rise in the senior population, the Elder Affairs Program, through a
grant, could be in the forefront of needs and program assessment as well as provider services,

traffic calming, signage, seawall/shoreline restoration, bikeways, street parking improvements,

Reenact the legislation that exempts economic development agencies from public records
Sunshine Law requirements relating to the intentions of a private company to expand or relocate
operations in Florida. Expand the legislation to include the appropriate economic development
deparnnent of a municipality under the defmitions of an economic development agency.

Develop a fonnula whereby jobs given to contract (I099) employees can be included in job

This item centered on changing Florida law to allow our City to share results of our resort tax
audits with the State's Department of Revenue. Likewise, the State would share infonnation

the City while at the same time reducing our audit coverage of the City's resort tax businesses.
Currently, state statute prohibits the sharing of this infonnation between State and City.

Section 108 LoanlEDl Grant
The City is seeking a direct appropriation or dollars from the Economic Development "Road
Fund" to match the $4 million Section 108 Loan and the $1 million ED! Grant received from HUD
for Streetscape and Youth Center improvements in North Beach. (Community Development

The City is submitting multiple grant applications to the Deparnnent of Community Affairs for an
Emergency Operations Center and the Local Mitigation Strategy to assist with huilding or
renovating an existing building to accommodate the city emergency operations center and house a
landfall public safety team. One grant in the amount of $300,000 has already been submitted, and
projects for the other applications are currently being identified. (Fire Department)

The City has submitted a grant application in the amount of $500,000 to the Florida Deparnnent of
State for improvements to the Miami Beach Botanical Garden Center. (Community Development

Urban Infill and Redevelopment Assistance Prol!ram
The City of Miami Beach has submitted a grant application to the Department of Community
Affairs in the amount of $40,000 to conduct a plarming study for the "5th Street Corridor," an area
bounded on the east by Ocean Court, west by Alton Road, North by 7th Street, and on the South

The City has submitted a grant application in the amount of $2,200,000 to the Deparnnent of
Community Affairs for the acquisition of 6000 Collins A venue for conversion of the site into a

Deparnnent of Environmental Protection for improvements to the Tennis Center at Flamingo Park.

Any proposed legislation, which negatively impacts the right of local governments to apply
plarminglzoninglhistoric preservation regulations to private property (including property owned by
religious institutions), should be strongly opposed. (Planning Deparnnent)
Growth Manal!ement Lel!islation:
The process of revising the existing Growth Management legislation should be monitored. Any
proposals to eliminate or seriously weaken the existing legislation (Chapter 163, rule 9J5, etc.)
should be opposed. Emphasis should be placed on distinguishing between built-up urban areas,
which could be exempted from some current requirements, and suburban/outlying areas, which
should continue to be regulated by the state (DCA), with the goal of discouraging urban sprawl
and directing development back towards urban infill areas such as Miami Beach. (Planning

Colonv Theater
The Colony Theater received a Cultural Facilities Grant in the amount of $500,000 in 2000. The
total amount secured for this project at this time is $2,637,000. Total project cost is estimated to
exceed $4,500,000. The City will submit an application to the Deparnnent of State Special
Category Grant program for $500,000 in May 2001 for the 2002 Legislative Session.

A conservator has recently done and inspection and a fonnal assessment is expected shortly. A
national grant Save Outdoor Sculpture may provide a portion of required funds but more will be

Deed to North Shore Park
The City is seeking a deed to the Park and west parking lots with no restrictions. The draft of the
deed, which was rejected by the City Attorney's office, reserved mineral rights to the State. The
Person in charge is Deborah Poppel, Chief, Bureau of Public Land Administration. They have
detennined that the Trustees of the Internal Improvement Trust Fund approved this transfer of title
on September 28, 1993. (Plarming Department)
Altos del Mar
The City is also seeking title to the II contiguous lots in Altos Del Mar that have been designated
by the City Commission for Park use. On February 3, 2000 the Land Acquisition and Management
Advisory Council (LAMAC) approved the following recommendation to the Trustees: "Convey
the II lots to the City of Miami Beach contingent upon the State recouping its investment tluough
sale of the other II lots, and with the restriction that the property remain in recreation and open
space use."
This recommendation will not go to the Trustees until the lot sale takes place. So far, there has
been no action, except that the State has obtained a new set of appraisals. Approximately two
weeks ago, Deborah Poppel infonned me verbally that she intends to change from a sealed bid

method of sale to a negotiated sale through realtors. I have been unsuccessful in reaching her to
obtain further infonnation. Meanwhile, the Planning Deparnnent has prepared a package of
development regulations and design guidelines for the Altos Del Mar lots. The Historic
Preservation Board has approved the guidelines, and the development regulations are awaiting
recommendations from the Planning Board. This department has forwarded the package to
Deborah Poppel with a request that it be included in any infonnation given to prospective buyers

Affordable Housinl! for City Staff and Teachers
Additional programs and incentives are needed to assist City Staff, like the Police and Fire
Department to live in the communities that they serve. This is also the case for public school
teachers that cannot afford to reside in the communities where they work, or would be willing
work in, ifhousing assistance was available. (Housing Division)

Despite the success of the State Housing Initiatives Partnership (SHIP) Program, the program
could benefit from better funding for Administration and monitoring of activities. (Housing

Lead Safe Housinl! Rule
On September 15, 2000, U.S. HUD's implemented its new Lead Safe Housing Rule to protect
children from the hazards of lead based paint in federally assisted housing. The State housing
programs could be standardized to adopt this higher level of protection. However, the issue of
whether there is an adequate supply of approved contractors, trained workers and certified testers
of lead based paint should be addressed first with additional programs for training and

Restructure Affordable Housinl! Prol!rams
The State should act more as a leader and catalyst in bringing about a rethinking of the concept of
affordable housing, since in many communities the issue is no longer that housing is not
affordable to the low and moderate income residents but also to the middle class. (Housing

ADMINISTRATION RECOMMENDATION:
Adopt the Resolution.
ANALYSIS:
On September 19-20 and October II, 2000, the City's State Lobbyists (Gary Rutledge, Fausto
Gomez, and Bob Levy) met with the Mayor, City Commissioners, and Administrative staff to
discuss the Legislative Priorities for the 200 I Legislative Session. In addition to the meetings with
the lobbyists, the Administration met on various occasions with the City's Quality in Education
Committee and the Miami Beach Chamber of Commerce's Govemmental Affairs Committee to
discuss the 2001 Legislative Agenda. As a result of such meetings, the proposed list of priorities for
the 2001 Legislative Session was compiled, and the draft agenda is attached for Commission review,
comment and approval.
In addition to the funding and legislative issues listed, the Administration has identified several other
issues that impact the City and require lobbying assistance at the State level.
The Administration recommends that the City Commission review the proposed legislative package,
establish the priorities, and adopt the attached Resolution.
