AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, AMENDING THE LAND
DEVELOPMENT REGULATIONS OF THE CITY CODE BY
AMENDING CHAPTER 130 "OFF-STREET PARKING," ARTICLE 111
"DESIGN STANDARDS," SECTION 130-68 "COMMERCIAL AND
NONCOMMERCIAL PARKING GARAGES" TO PERMIT ROBOTIC
PARKING SYSTEMS IN MAIN USE GARAGES IN THE GU AND
CCC DISTRICTS; PROVIDING FOR REPEALER; CODIFICATION;
SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, the regulations governing off-street parking spaces contained in Chapter
130 of the City Code, Sections 130-61 through 130-65 of Article II "Design Standards"
delineate the requirements for parking space dimensions and layout; and
WHEREAS, the use of robotic parking systems, to be used within parking garages in
order to increase parking capacity in Miami Beach has come into question; and
WHEREAS, the City Commission is concerned that the approval of mechanical
parking systems could have the effect of increasing density and intensity of development
within the City; and
WHEREAS, The City wishes to permit main-use stand-alone parking garages using
robotic parking mechanisms in order to increase parking capacity, and not to allow robotic or
mechanical parking systems in garages to be used to satisfy off-street parking requirements;
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. That Chapter 130, Off-Street Parking, Article III, Design Standards, Section
130-68 entitled "Commercial and Noncommercial Parking Garages" is hereby amended as
follows:
Commercial and noncommercial parking garages as a main use on a separate lot shall be
subject to the following regulations, in addition to the other regulations of this article:
(8) For main use parking garages within the GU and CCC districts, Robotic Parking
Systems may be used, notwithstanding the provisions of Article III "Design Standards"
referencing minimum parking space dimensions, drive width, interior aisle width, and
required markings. Robotic Parking System means a mechanical garage using elevator
systems to hoist individual vehicles from receiving areas to separate auto storage areas.
Under this provision, accessory off-street parking spaces requirements may not be satisfied
through the use of robotic parking systems.
SECTION 2. REPEALER.
All ordinances or parts of ordinances and all section and parts of sections in conflict
herewith be and the same are hereby repealed.
SECTION 3. CODIFICATION.
It is the intention of the City Commission, and it is hereby ordained that the
provisions of this ordinance shall become and be made part of the Code of the City of Miami
Beach as amended; that the sections of this ordinance may be renumbered or relettered to
accomplish such intention; and that the word "ordinance" may be changed to "section" or
other appropriate word.
SECTION 4. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the
remainder shall not be affected by such invalidity.

This proposed ordinance would permit robotic parking systems in main use parking garages in the GU
Government Use and CCC Convention Center zoning districts. It would permit these systems to be
approved without variances, by declaring that within the GU Government Use zoning district and the CCC
Convention Center zoning district, robotic parking systems could be utilized without regard to the parking
space dimension and layout requirements in the City Code.
A variance or waiver would not be needed to implement robotic systems in these garages. This could
encourage robotic parking for City parking projects, without resulting in its use as a means to increase
density or intensity for private development projects.
The proposed change would be consistent with the needs of the City, and should help to ensure that
additional public parking is provided without resulting in additional density or intensity over and above what
would normally be allowed utilizing normal parking methods.
Advisory Board Recommendation:
The Planning Board recommended approval of the ordinance at its December 19, 2006 meeting.
The Land Use Committee moved to send the ordinance on to the full commission at its May 14, 2007
meeting. The City Commission approved the ordinance on first reading at its June 6, 2007 meeting.

BACKGROUND
This proposed ordinance, permitting robotic parking systems in City sponsored parking
structures without the need for variances or waivers, was requested by the Planning Board.
It was approved on first reading by the City Commission on June 6, 2007.
ANALYSIS
This proposed ordinance amending the City Code would permit robotic parking systems in
main use parking garages in the GU Government Use and CCC Convention Center zoning
districts.
The regulations governing off-street parking spaces are contained in Chapter 130 of the City
Code. Sections 130-61 through 130-65 of Article II "Design Standards" govern off-street
parking space dimensions, drainage and maintenance, interior aisles, drives and marking,
respectively. These sections clearly delineate the requirements for parking space
dimensions and layout.
Since the City Code does not make provision for robotic parking systems, and such spaces
created by these systems would not be in strict conformity with the parking design standards
in the Code, requests for mechanical lifts or robotic parking systems have to be directed to
the Board of Adjustment as variance applications.
As a means towards providing as much public parking as possible, the Planning Board has
suggested that City owned parking garage projects be encouraged, when feasible, to use
robotic parking systems to maximize the number of parking spaces offered to the public.
This proposed ordinance would permit these systems to be approved without variances, by
declaring that within the GU Government Use zoning district and the CCC Convention
Centerzoning district, robotic parking systems could be utilized without regard to the parking

space dimension and layout requirements in the City Code. A variance or waiver would not
be needed to implement robotic systems in these garages.
The ordinance is written to permit robotic systems in "main use" garages only, and only in the
GU and CCC zoning districts. This is to ensure that these systems are used to provide
infrastructure parking for use by the general public, rather than to meet the Code required
off-street parking requirements for new development.
Planning Department staff has been concerned that the use of robotic or mechanical parking
to meet the parking requirements for new development would have the negative effect of
increasing density and intensity of development, which runs counter to the City's growth
management goals. While the Planning Board and the City Commission have both
discussed the matter in the past year, there is still a variety of opinion on the subject, and the
Planning Department is looking into ways to permit intensified parking for development
without resulting in extra density or intensity.
As a first step, the Planning Board has requested that a first step betaken by the introduction
of the subject ordinance, which would encourage robotic parking for City parking projects,
without resulting in its use as a means to increase density or intensity for private
development projects.
The Planning Board has also been discussing these issues in the context of a Parking
Workshop, held at its last two meetings. At its June 26, 2007 meeting, the Board heard from
representatives of the development community and the mechanical parking industry, and
further examined the relationship between the parking requirements, allowable intensity and
densities. The possibility of permitting private sector development projects to use
mechanical or robotic parking was discussed at length. The Board concluded that an
amendment to the Code that would permit the beneficial use of mechanical or robotic
parking systems in orderto reduce the size and bulk of buildings, butwithout also resulting in
unwanted increases in density or intensity resulting from such systems, is worthy of further
study. A draft ordinance will be prepared by the Planning Department staff and presented to
the Planning Board and the City Commission at a meeting in the near future.
PLANNING BOARD ACTION
At the December 19, 2006 meeting, a motion was made and approved by a vote of 6-0
recommending that the City Commission adopt the Ordinance. At the May 14, 2007 Land
Use Committee, the Committee moved to send the proposed ordinance on to the full
commission.
FISCAL IMPACT
The proposed ordinance should have no associated negative fiscal impact upon enactment.
CONCLUSION
The proposed change would be consistent with the needs of the City, and should help to
ensure that additional public parking is provided without resulting in additional density or
intensity over and above what would normally be allowed utilizing normal parking methods.
