2007-26591 ResoRESOLUTION NO. 2007-26591 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING CHANGE ORDERS A, B, C, AND D, RESPECTIVALY, IN THE TOTAL AMOUNT OF $358,510.61, TO THE EXISTING CONTRACT BETWEEN THE CITY AND GABLESIGNS AND GRAPHICS, INC.; SAID CHANGE RELATED TO THE FABRICATION AND INSTALLATION OF THE CITY OF MIAMI BEACH CITYWIDE WAYFINDING SIGNAGE AND IDENTITY SYSTEM. WHEREAS, on July 27, 2005, the Mayor and City Commission approved Resolution No.2005-25975, awarding a contract, in the amount of $1,675,7133.00, to GableSigns and Graphics, Inc., for the fabrication and installation of a Citywide Wayfinding and Signage Program, with a two year sign maintenance agreement (the Agreement); and WHEREAS, subsequent to contract award, the Florida Department of Transportation (FDOT) withheld issuance of a permit for the new signs pursuant to federal regulatory requirements, which necessitated the City to conduct further research and field testing ,documenting the legibility of the desired signage font; and WHEREAS, on May 2006, FDOT submitted to the Federal Highway Administration (FHWA), an official "request to experiment" with Wayfinding Guide Signs, including the use of the Futura Font, in accordance with procedures established in the Federal Manual of Uniform Traffic Control Devices; and WHEREAS, on June 23, 2006, the FHWA issued a letter approving the experimentation request; and WHEREAS, the City's consultant, Hiller Architecture, began revisions of the design to comply with the requirements set forth in the FHWA approval; and WHEREAS, GablesSigns and Graphics, Inc. made the required revisions to the shop drawings, and prepared the signed and sealed engineering permit drawings for both FDOT and the City; and WHEREAS, due to the unexpected duration of the FHWA approval process; unforeseen changes due to the FHWA requirements; and subsequent modifications to the signage design, a number of changes needed to be incorporated into the Agreement; and WHEREAS, the Public Works Department, along with the Hillier, has negotiated the attached Change Orders A, B, C, and D, respectively, with GablesSigns and Graphics, Inc.; and WHEREAS, the overall modifications amount to $358,510.61 WHERETO, the Administration recommends that the Mayor and City Commission approve Change Orders A, B, C and D, in the amount of $358,510.61, for the increase cost due to rising raw materials and fabrication costs over the past two years; redesign and reengineering of supporting structure; providing solar power to the Venetian Causeway gateway sign; and modification to vehicular directional sign types. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve Change Orders A, B, C, and D, respectively, in the total amount of $358,510.61, to the existing contract between the City and GableSigns and Graphics, Inc.; said change orders related to the fabrication and installation of the City of Miami Beach Citywide Wayfinding Signage and Identity System. Item Summa /Recommendation: Due to the unexpected duration of the Federal Highway Administration (FHWA) approval process, unforeseen changes due to the FHWA requirements and subsequent modifications to the signage design, a number of changes need to be incorporated into the contract. The Public Works Department along with the Hillier Architecture, the consultant, has negotiated with the contractor the cost for four modifications to the contract totaling $358,510.61. The aggregate sum of modifications, a), b), c) and d) totals $358,510.61. These modifications will be funded from previously appropriated project contingency funds and project capital funds as listed below. The Administration recommends the Commission to adopt the Resolution. ADMINISTRATION RECOMMENDATION Adopt the Resolution. FUNDING Funding is available from project contingency and previously appropriated capital funds. ANALYSIS On July 27, 2005, the Mayor and the City Commission of the City of Miami Beach approved Resolution 2005-25975 awarding a contract in the total project amount of $1,675,713.00 to GableSigns and Graphics, Inc., for fabrication and installation of a Citywide Wayfinding Signage Program with a two (2) years sign maintenance agreement. An amount of $137,205.00 was approved in the contract for contingencies. Subsequent to the contract award the Florida Department of Transportation (FDOT) withheld the issuance of a permit for the new signs pursuant to federal regulatory requirements which warranted further research and field testing documenting the legibility of the desired signage font. In May 2006, FDOT submitted to the Federal Highway Administration (FHWA), an official "request to experiment" with Wayfinding Guide Signs, including the use of the Futura Font , in accordance with procedures established in the Federal Manual of Uniform Traffic Control Devices. On June 23, 2006, the FHWA issued a letter approving the experimentation request. This experimentation included testing the legibility of the Futura typeface for use in the Citywide Wayfinding Signage Project. The research was conducted using temporary signs placed at various locations on Normandy Isle and Normandy Shores. The result showed that the Futura font typeface provided sign legibility and recognition distances that are equal to or greater than standard highway lettering. The wayfinding signage design consultant, Hillier Architecture, began revisions to the original design to comply with the requirements set forth in the FHWA experimental approval letter. The contractor made the required revisions to the shop drawings and prepared the signed and sealed permit drawings for both FDOT and the City. In February, 2007, the signed and sealed drawings were submitted to the Florida Department of Transportation (FDOT) permitting office for review and permit issuance. Initial permit review by FDOT indicated that additional documentations were needed from the contractor. Soon after receipt of the required documents, the City re-submitted the additional documentation to FDOT for their final review and approval. FDOT issued a permit on March 27, 2007. In March, 2007, the signed and sealed drawings were presented to the City's Building Department. The Building Department is in the final stages of permitting process. The unexpected duration of the FHWA approval process, and the unforeseen changes due to the FHWA requirements and subsequent modifications to the signage design, triggered modifications in the contract documents. The Public Works Department, along with Hillier, negotiated the cost for each of the modification with the contractor. They are as follows: Table 1, identifies each modifications and their respective value. Table 2, identifies the already appropriated funding available to offset the additional costs. All available contingency and FY 07 additional capital funding will be used to fund this Change Order Proposal. Future change orders would require additional appropriations. The increase due to rising raw materials and fabrication costs are associated to increases in price indices of gasoline, aluminum and concrete.
