2000-24199 RESO RESOLUTION NO. 2000-24199 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE PLACEMENT OF EIGHTY (SO) BANNERS FROM JANUARY 20 TO FEBRUARY 12, 2001, FOR THE MIAMI BEACH FESTIVAL OF THE ARTS, AS REQUESTED BY THE APPLICANT AT THE FOLLOWING LOCATIONS: MACARTHUR CAUSEWAY, FROM THE COAST GUARD STATION TO ALTON ROAD; 5TH STREET, FROM ALTON ROAD TO OCEAN DRIVE; COLLINS AVENUE, FROM 43RD STREET TO 62ND STREET AND 71ST STREET TO 87TH STREET; HARDING AVENUE, FROM 87TH STREET TO 73RD STREET; 7lST STREET AND NORMANDY DRIVE, FROM COLLINS AVENUE TO BAY VIEW DRIVE; ABBOTT AVENUE, FROM 73RD STREET TO 69TH STREET; OCEAN TERRACE, FROM 73RD TO 75TH STREET; ARTHUR GODFREY ROAD, FROM ALTON ROAD TO PINETREE DRIVE; AND CONVENTION CENTER DRIVE, FROM 17TH STREET TO 20TH STREET; SAID BANNERS TO BE AFFIXED TO LIGHT POLES IN THE PUBLIC RIGHT-OF-WAY, MEASURING 36" X 7 " AND HAVING COpy AND DESIGN AS SHOWN ON THE ATTACHED DRAWINGS; THE ADMINISTRATION FURTHER RECOMMENDS THAT THE BANNERS BE INSTALLED NO EARLIER THAN JANUARY 20, 2001, AND REMOVED BY FEBRUARY 12, 2001. WHEREAS, the 27th annual Miami Beach Festival of the Arts (Applicant) will be held on February 10 & 11, 2001; and WHEREAS, in order to publicize the event and draw the attention of the media and the public at large, the Applicant has requested light pole banners, measuring 36 inches by 7 feet; and WHEREAS, said banners will be installed no earlier than January 20th, and removed by February 12th, 2001; and WHEREAS, the Applicant has requested approval and authorization for the placement of a total of eighty (80) banners; and WHEREAS, the Applicant will post a performance bond to ensure the removal of the banners, will ensure that any damage to light poles will be repaired at its expense, and will meet all other applicable City requirements; and WHEREAS, Miami Beach City Code Section 82411 (d) requires that the Mayor and City Commission approve the installation of temporary banners. Light Pole Banners affixed to light poles or other similar structures on the public right-of-way shall be subject to the following regulations: a. The right to install, as well as the number, location and method of installation of banners shall be subject to the Design Review process and approved by the City Commission and the Public Works Department. b. Banners announcing special events, either to be held in Miami Beach or to be associated in some manner with Miami Beach, as determined by the City Commission, may be erected up to thirty days prior to the event being announced and must be removed within seven days after said event. c. A performance bond shall be required to ensure the removal of the banners in case of advanced deterioration of the banners, or if a dangerous condition presents itself, the City may at its sole discretion direct the banners to be removed at any time.
