RECITALS WHEREAS, pursuant to Request for Qualifications (RFQ) No. 134-99100, the Mayor and City Commission adopted Resolution No. 2001-24387, on May 16, 2001, approving and authorizing the Mayor and City Clerk to execute an Agreement with CH2M Hill, for Professional Services forthe Bayshore and Sunset Islands StreetscapeRight-of- WayNeighborhood Project (the Project); and WHEREAS, the Agreement provides forthe detailed planning services forvarious streetscape /landscape /utility improvements within the Bayshore and Sunset Islands neighborhood; and WHEREAS, the Agreement was executed for snot-to-exceed amount of $133,174.00; and WHEREAS, the planning effort for the Project has been completed and detail design activities are underway; and WHEREAS, on December 10, 2003, the Mayor and City Commission adopted Resolution No.2003-25432, approving additional design services asAmendment No.1 to the .Agreement, for planning, design, permitting, bidding /award and construction administrative services for the Project, for snot-to-exceed amount of $1,913,302.00; and Page T of 5 MB:4008 Amendment No.5 06 O7 06 WHEREAS, on February 24, 2005, Amendment No. 2 to the Agreement was executed, to re-package Sunset Islands 1 and 2 from Bid Package 8D to Bid Package 8B, for $0.00; and WHEREAS, on November 8, 2005, Amendment No. 3 to the Agreement was executed to include the completion of a topographic survey along Pine Tree Drive from th tf~ West 28 Street to West 40 Street along the east side of the road, for snot-to-exceed amount of $12,850.00; and WHEREAS, on February 17, 2006, Amendment No. 4 to the Agreement was executed to include the evaluation, permitting and preparation of construction cost alternatives fortheinstallation ofcurbs/valley gutters to Sunset Islands 1 and 2, fora not- to-exceed amount of $2,500.00; and WHEREAS, the following Amendment No. 5 to the Agreement is to include the installation of four (4} drainage test wells to provide additional information for the preparation of a Letter of Reasonable Assurance to be submitted to the Florida Department of Environmental Protection (FDEP), as required inthe permitapplicationfor the Project; for snot-to-exceed amount of $55,863.00. NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment No. 5. 2. MODIFICATIONS The Agreement is amended as defined in Schedule "A-5", attached herein. 3. OTHER PROVISIONS. All other provisions of the Agreement, as amended, are unchanged. 4. RATIFICATION. The City and Consultant ratify the terms of the Agreement, as amended by this Amendment No. 5. David Dermer SCHEDULE "A-5" SCOPE OF SERVICES Schedule "A"entitled, "Scope of Services", is amended as follows: TASK 5 -ADDITIONAL SERVICES, afterthe language added forAmendment No.1: Task 5.3 -Additional Design Services associated with the installation of four (4) drainage test wells Consultant is to comply with the permit application requirements from the Florida Department of Environmental Protection (FDEP) for the Project, including supporting documentation for information included in the DEP Form No. 62-528.900(1). As part of the application for a permit, a "Letter of Reasonable Assurance" needs to be submitted to the FDEP. The letter provides FDEP the assurance that the proposed well drainage system will not adversely affect ground water conditions in a given vicinity. In order to provide this assurance, four (4) drainage test wells must be installed by a well drilling contractor in the Bayshore neighborhood. The wells consist of one dual tube reverse circulation 7-inch diameter test hole to a depth of up to 200 feet, providing continuous formation samples, water quality samples at 5' -10' intervals, including waterquality analysis (TDS), and preparation of a waterquality profile and lithologic profile by a professional geologist. The test wells will yield information which will allow the Consultant to further refine calculations, make necessary changes based on that information and ultimately provide the FDEP with the letter of assurance. TIME OF COMPLETION The test wells shall be completed within one (1) month of receipt of authorization to proceed for each well as noted below. Authorization to proceed for the installation of two (2) test wells in Bid Package 8B and 8C was issued on February 16, 2006. Authorization to proceed for the installation of two (2) test wells. in Bid Package 8A was issued on October 5, 2005. PAYMENT AND COMPENSATION The method for calculating the fees for the aforementioned proposed engineering Page 4 of 5 MB:4008 Amendment No.5 06 07 06 services (Task 5.3) is established in Exhibit `A' attached, based on estimated labor plus direct costs. Note that the well contractors costs increased after the installation of the first two test wells as noted below. Two (2) wells, one (1 } to be installed in Bid Package B (noted as Well No.1 in Exhibit 25} and one to be installed in Bid Package C (noted as Well No.4 in Exhibit 25} for a not to exceed amount of $26,500 ($13,250 per well x 2). Two (2) wells to be installed in Bid Package A (noted as Well No. 2 and 3 in Exhibit 25) for a not to exceed amount of $29,363 ($14,250 per well x 2 + $863 police officer). The total fee proposed for this Scope of Work for the installation of four (4}wells shall be on snot-to-exceed basis in the amount of $55,863.00. Invoicing will be monthly and based on hourly rates as defined in the current agreement between CH2M Hill and the Cityof Miami Beach. CONSULTANT's request for additional services is attached for reference purposes. We will be submitting 90% complete documents f or each package for permit reviews. To this end, with regards to drainage permitting, CH2M HILL has recently learned that the Florida Department of Environmental Protection (FDEP) is requesting that Consultants submit a "Letter of Reasonable Assurance" at the time permit application is made. This document essentially provides FDEP the assurance that the proposed well drainage system will not adversely affect ground water conditions in a given vicinity. In order to provide this assurance, and in support of DEPForm No. 62-528.900(1}, a number of test wells (4) must first be installed by a well drilling contractor inBayshore / Sunset Islands -Neighborhood No. 8. These test wells will yield information which will allow CH2M HILL to further refine its drainage calculations, make necessary changes based on that inf ormation and ultimately provide the FDEP with a letter of reasonable assurance. Attached for your reference are the proposed well locations. Based on the proposal from well drilling contractor, Jaffer Associates, Corp., the cost to perform these services is $13,250.00 per well for a Grand Total of $53,000.00. Attached for your ref erence is a copy of Jaf f er Associates' proposal. Since there is currently no funding appropriated for this task we would like to request that a Contract Amendment be executed by the City in the amount of $53,000.00 to cover the cost of these services.
