A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPOINTING AND AUTHORIZING,
AT THE REQUEST OF THE MIAMI-DADE COUNTY ELECTIONS
DEPARTMENT, THE MIAMI-DADE COUNTY CANVASSING BOARD
TO SERVE AS CANVASSING BOARD FOR THE GENERAL AND
SPECIAL ELECTIONS OF THE CITY OF MIAMI BEACH TO BE HELD
ON NOVEMBER 6, 2007.
WHEREAS, on November 6, 2007,
General and Special Elections for the
Commissioners in Group IV, V and VI; and
the City of Miami Beach will be conducting
purposes of electing a Mayor, and City
WHEREAS, in the past, the City has designated its own Canvassing Board for
such Miami Beach elections; and
WHEREAS, the Miami-Dade County Elections Department has informed the City
of Miami Beach that there are seven municipalities currently scheduled to conduct
elections on November 6, 2007, and due to the challenges that this will represent the
Elections Department is requesting that the Miami Beach City Commission consider
designating the County Canvassing Board to perform this function on behalf of the City
of Miami Beach as allowed by State Statute; and
WHEREAS, the Miami-Dade County Canvassing Board will be composed of
Lester Sola, Miami-Dade County Supervisor of Elections, a county court judge, and
Miami-Dade County Commissioner Carlos Jimenez (or in his absence, a substitute
member of the Miami-Dade County Commission); and
WHEREAS, the Canvassing Board Members, pursuant to section 102.141,
Florida Statutes, may not be a candidate with opposition in the election being
canvassed, or an active participant in the campaign or candidacy of any candidate with
opposition in the election being canvassed.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Miami-Dade
County Canvassing Board, to be composed of Lester Sola, Miami-Dade County
Supervisor of Elections, a county court judge, and Miami-Dade County Commissioner
Carlos Jimenez (or in his absence, a substitute member of the Miami-Dade County
Commission), is hereby appointed and authorized to act as Canvassing Board for the
City of Miami Beach's November 6, 2007 General and Special Elections, consistent with
statutory membership requirements as referenced abovE

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
Pursuant to Florida Statutes, an election's Canvassing Board is charged with responsibilities
relating to the conduct of elections. The attached Resolution has thus been prepared as a
housekeeping matter for the purpose of formally appointing and authorizing the Miami-Dade
County Canvassing Board to serve as Canvassing Board for the City of Miami Beach's
November 6, 2007 General and Special Elections.
Pursuant to the August 20, 2007 letter from the Miami-Dade County Supervisor of Elections,
Lester Sola, there are seven municipalities currently scheduled to conduct elections on
November 6, 2007. Due to the logistical challenges that this will present, the Elections
Department is requesting that the City Commission consider designating the County
Canvassing Board to perform this function on behalf of the City of Miami Beach (See Exhibit

CONCLUSION
The Administration recommends appointing and authorizing the Miami-Dade County
Canvassing Board to perform this function on the City's behalf.
