97-22461 RESO RESOLUTION NUMBER 97-22461 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE ISSUANCE OF A CHANGE ORDER INCREASE IN THE AMOUNT OF $65,000 TO MCS OF TAMPA, INC. UNDER STANDING ORDER NO. 7442 TO PROVIDE FOR WORK COMPLETED AT THE MIAMI BEACH POLICE FACILITY AS PART OF THE EXTENSION OF CONTRACT NO. 71-94/95. WHEREAS, it has been determined that MCS of Tampa, Inc. (MCS) has completed the cabling work at the Police facility in the time agreed upon; and WHEREAS, the cost increases for the project were beyond MCS's control and were due to unforeseeable complications; and WHEREAS, the work was satisfactorily done; and WHEREAS, the City wishes to pay MCS for services rendered. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the issuance of a Change Order Increase in the amount of$65,000, to MCS of Tampa, Inc., under Standing Order No. 7442, to provide for work completed at the City of Miami Beach Police facility, is approved. UNDER ST ANDING ORDER NO. 7442 TO PROVIDE FOR WORK COMPLETED AT THE MIAMI BEACH POLICE FACILITY AS PART OF THE EXTENSION OF CONTRACT NO. 71-94/95. FUNDING Funding is available from Information Technology Account No. 550.1750.000674 BACKGROUND On May 17, 1995 the Miami Beach City Commission authorized the award of Bid No. 71-94/95 to MCS of Tampa, Inc. (MCS), for installation/modifications of cabling for telephones, computers, and cable television. MCS was the lowest bidder that met the bid specifications. A portion of the contract provided set fees for standard cable runs; other work was to be performed at time-and- materials rates. During the course of this contract, MCS of Tampa, Inc., has installed new phone and computer cabling at City Hall, Parking Department, Sanitation, and other City locations. MCS has also been the primary contractor for "moves/adds/changes" (MACs) necessitated by the changing requirements of City Departments. On June 19, 1996, the City Commission approved an extension to the contract to permit MCS to cable the Miami Beach Police Department facility. Standing Order No. 7442 was created for $195,000. During the cabling installation, events occurred which caused the specifications to change. As a result, when MCS completed the cabling in October, 1996, the original estimate ($195, 000) was exceeded by $65,000. AGENDA ITEM C. 3A DATE ..., - \ L.-q"1 ANAL YSIS MCS provided their $195,000 time-and-materials estimate based upon the City's understanding on the project as of the Spring of 1996. By the time the project ended in October, 1996, certain events had significantly changed the job specifications. These events are outlined below: a) The City Commission approved the Rolm telephone system. The telephone system cutover necessitated extra work for MCS. b) The City requested that MCS accelerate the Police Department cabling project. It was to be completed in twelve rather than sixteen weeks. As a result, MCS had to pay overtime to its workers. c) Cabling "MACs" continued at City Hall during the time-frame of the Police Department cabling projects. Therefore, MCS technicians were diverted to work on the City Hall remodeling. d) The air-conditioning system was out of order for approximately a week during the Police Department cabling installation. MCS technicians were delayed by this outage. e) Certain materials, ordered under a separate City contract, did not arrive as soon as scheduled. CONCLUSION The City Commission should authorize the issuance of a retroactive Change Order in the amount of $65,000.00 to MCS of Tampa, Inc. for the work already completed in cabling the Police facility.
