A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE
RECOMMENDATION OF THE CITY MANAGER AND
AUTHORIZING THE ADMINISTRATION TO ENTER INTO
NEGOTIATIONS WITH JOHNSON CONTROLS, PURSUANT TO
REQUEST FOR QUALIFICATIONS NUMBER 38-96/97, FOR
ENERGY CONSERVATION PERFORMANCE CONTRACTING.
WHEREAS, the City is seeking the services of an experienced and qualified
organization to provide energy conservation performance contracting; and
WHEREAS, the City issued a Request for Qualifications (RFQ No. 38-96/97) for
providing the required services on December 16, 1996; and
WHEREAS, specification packages for the Requests for Qualifications were issued
to eight firms, and resulted in three responses; and
WHEREAS, an Evaluation Committee appointed by the City Manager which met
on May 23, 1997, unanimously voted to recommend Johnson Controls as the top-ranked
firm; and
WHEREAS, the City Manager herein recommends that the Mayor and City
Commission accept the afore stated recommendation of the Evaluation Committee.
NOW, THEREFORE, BE IT DUL Y RESOLVED BY THE MAYOR AND
CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor
and City Commission herein accept the recommendation of the City Manager and authorize
the Administration to enter into negotiations with Johnson Controls, pursuant to RFQ No.
38-96/97, to provide energy conservation performance con acting.

Request for Qualifications No. 38-96/97 for Energy Conservation Performance

BACKGROUND:
The City of Miami Beach issued RFQ Number 38-96/97 on December 16, 1996, to request
qualifications from qualified performance contractors for the implementation of energy conservation
measures at the following City of Miami Beach facilities: City Hall, Police Station, Scott Rakow
Youth Center, Convention Center, Theater of the Performing Arts, South Shore Community Center,
21st Street Community Center, Fire Stations #1, #2, #3, and #4, Holtz Tennis Stadium, Flamingo
Park Football and Baseball Stadiums, Public Works yard facility, Fleet Management facility, and
any other buildings that the City determines should be evaluated as part of this energy savings
project. The objective in issuing this Request For Qualifications (RFQ) was to select the most
qualified contractor to engage in a Guaranteed Energy Savings Contract pursuant to Florida Statue,
Section 287.055, Consultants Competitive Negotiation Act.
Thirty-five notices and eight specification packages were mailed, resulting in the receipt oftrnee
responses. A Mandatory Pre-Qualification Conference was held on December 31, 1996.
Amendment No. I was issued on January 9, 1997, extending the opening date from January 21,
1997, to January 30, 1997. Amendment No.2 was issued on January 22, 1997, requiring respondents
to provide to the City of Miami Beach a comprehensive energy services program including:
complete energy audits, design and installation of energy efficient equipment and systems,
maintenance of HV AC mechanical equipment and installed systems, monitoring of energy costs,
financing for the project, and a written energy guarantee that total program costs shall be 100 percent
(100%) covered by program energy, maintenance, and operational savings.

All three respondents were found to be in compliance with the RFQ specifications and were invited
for presentations before the Evaluation Committee. The Evaluation Committee met on May 23,
1997, to hear presentations from FPL Services, Landis & Staefa, Inc., and Johnson Controls, and to
discuss and evaluate each firm's qualifications:
Brad Judd, Property Management Director, City of Miami Beach, (Chairman)
Isadore Binstock, Internal Auditor, City of Miami Beach
Jorge Chartrand, Construction Manager, City of Miami Beach
Steve Clark, SMG Director of Operations
Oscar Sklar, Architect, Gambach-Sklar Architectural Firm
The Committee's report for the City Manager is attached.
ANAL YSIS:
Specific items in the RFQ that were addressed in the presentations included experience and
background in performance contracting, financial stability of respondent companies, technical
approach to needs analysis, technical approach regarding equipment service and repair, savings
calculations and monitoring, standards of service and comfort, guarantee documents, City of Miami
Beach employee training, and project management.
Committee members ranked the three respondents on several key elements. Johnson Controls, Inc.,
was the top-ranked firm for the following key elements: performance contracting experience,
equipment service and repair, City employee training, City of Miami Beach experience which
includes existing service contracts in multiple facilities, and other benefits to the City, such as water
conservation and air-quality control. All three respondents received equal scores for other key
elements.
The Evaluation Committee unanimously voted to recommend that authorization be granted to
conduct negotiations with Johnson Controls, Inc., giving that firm the top ranking. Johnson Controls
is a company with headquarters located in Milwaukee, Wisconsin, and with a local office located
in Hollywood, Florida. This company has been in business since 1885 and has been involved in
Energy Conservation Performance Contracting for thirteen years, with over $750,000,000.00 in
performance-based contracts.

ANALYSIS: (Continued)
One of Johnson Control's Performance Contracts recently completed is the Broward County Judicial
Complex in Ft. Lauderdale, Florida. This was Johnson Controls' first performance contract
completed with a County government. Contractor provided improvements in lighting, heat pipe
installation for indoor air quality, 1750 kw emergency generator, facility management system
upgrades, and air-quality monitoring. The project included the main courthouse and the new North
and East Courthouses, totaling over 800,000 square feet. The contract also included a 10-year
Service Agreement and training. Another performance contract completed by Johnson Controls was
with Florida International University in Miami, Florida. This was its first performance contract
completed with the State University System. Johnson Controls provided retrofits which included
lighting, central chiller plant modifications, equipment upgrades, and enhancement of Landis & Gyr
and Barber Coleman energy management systems. The project encompassed 20 buildings with 1.8
million square feet. A 10-year Service Agreement was also included in the contract.
Additionally, Johnson Controls is currently involved in the following performance contracts, which
are not yet completed: Broward County Government Center, Dade County Public Schools, City of
Miami, Florida State University, University of Florida, Brevard and Alachua County Schools, and
the NEFEC (Northeast Florida Education Consortium)
CONCLUSION:
The City Manager's recommendation is that the Commission accept the ranking ofthe Evaluation
Committee and authorize the Administration to commence negotiations with Johnson Controls, Inc.,
the top-ranked firm.
