A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AND
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
AMENDMENT NO. 2 TO THE AGREEMENT BETWEEN THE CITY
AND CAMP DRESSER 8~ MCKEE, INC., DATED DECEMBER 11,
2002, FOR PROFESSIONAL ENGINEERING SERVICES FOR
CITYWIDE SANITARY SEWER IMPROVEMENT PROJECTS; SAID
AMENDMENT INCREASING THE CONSULTANT'S MAXIMUM
ALLOWABLE COMPENSATION, FROM A NOT-TO-EXCEED
AMOUNT OF $2,000,000, TO ANOT-TO-EXCEED AMOUNT OF
$3,640,000, FOR ENGINEERING SERVICES RELATED TO THE CITY
SANITARY SEWER COLLECTION AND TRANSMISSION SYSTEM
STUDY, AS REQUIRED BY THE DEPARTMENT OF
ENVIRONMENTAL RESOURCES MANAGEMENT (DERM).
WHEREAS, on May 3, 2002, the City issued Request for Qualifications (RFQ)
No. 35-00/01, for Citywide Sanitary Sewer System Improvement Projects (the Project),
and, pursuant to this competitive process, selected the firm of Camp Dresser and McKee
Inc. (Consultant), as the top-ranked proposer in response thereto; and
WHEREAS, on December 11, 2002, the City approved and authorized the
execution of a Professional Services Agreement with the Consultant, with a Maximum
Compensation Limit (MCL) of $1,000,000 (the Agreement); and
WHEREAS, the City is continuing with the ongoing regulatory compliance efforts
and Citywide infrastructure rehabilitation program related to the Project; and
WHEREAS, in January 2003, as part of the Project, the City authorized the
Consultant to proceed with professional engineering services during the rehabilitation of
sanitary sewer lines throughout the City; this work has been satisfactorily completed;
and
WHEREAS, on April 21, 2006, the City authorized the Consultant to proceed with
work relative to the DERM-required Sanitary Sewer Evaluation Survey (SSES) Phase II
flow monitoring and post rehabilitation report, which was delivered to DERM by the
November 12, 2006 deadline; and
WHEREAS, the SSES Phase II Report showed that seven (7) sanitary sewer
basins out of a total of 25 sewer basins were not in compliance with inflow/ infiltration
requirements; and
WHEREAS, on July 12, 2006, Amendment No. 1 to the Agreement, increased
the original not-to-exceed compensation amount from $1,000,000, to $2,000,000; and
WHEREAS, as a result of the SSES Phase II Report, on July 31St, 2007, the City
entered into a Consent Agreement with DERM to complete the basin rehabilitation
associated with the Sanitary Sewer Evaluation Survey (SSES) Phase III, which includes
overall contract oversight, closed circuit televising (CCTV) of non-rehabilitated sewers,
smoke testing, design services for sewer main rehabilitation, bidding and award
services, construction management, post rehabilitation flow monitoring, and updating the
SSES Phase III Rehabilitation report; and
WHEREAS, the SSES Phase III Report must be completed by October 2009;
and
WHEREAS, as part of the SSES Phase III Report, the City is also required to
complete the Peak Flow Management Study by May 8, 2008, in accordance with Miami-
Dade Code Section 24-42.2(1)(c), which includes dynamic hydrologic and hydraulic
modeling of the City's 23 sanitary sewer basins to evaluate the sewer system
performance under peak wet weather flow conditions; and
WHEREAS, in order for the City to meet the mandate to be in full compliance
with federal requirements by October 2009, the City must engage the services of an
engineering consultant immediately; and
WHEREAS, since the Consultant has successfully been the City's sewer
engineer for over ten (10) years, and it has extreme knowledge about the City's sewer
infrastructure and has always provided timely and quality work, the Administration
considers it to be in the best interest of the City to amend Consultant's Agreement to
provide for said services, thereby also increasing the Consultant's maximum allowable
compensation from $2 million, to $3,640,000, in order to complete the time sensitive
work required by the County's Consent Agreement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISISON OF THE CITY OF MIAMI BEACH, FLORDA, that the Mayor and City
Commission hereby approve and authorize the Mayor and City Clerk to execute
Amendment No. 2 to the Agreement between the City and Camp Dresser & McKee, Inc.,
dated December 11, 2002, for Professional Engineering Services for Citywide Sanitary
Sewer Improvement Projects; said Amendment increasing the Consultant's maximum
allowable compensation, from snot-to-exceed amount of $2,000,000, to anot-to-exceed
amount of $3,640,000, for engineering services related to the City Sanitary Sewer
Collection and Transmission System Study, as required by the Department of
Environmental Resources Management (DERM).

On December 11, 2002, the City entered into a PSA with the firm of Camp Dresser and McKee Inc. (the
Consultant) pursuant to the Request for Qualification No. 35-00/01 (Resolution 2002-25086). The PSA
established a maximum compensation limit of $1,000,000, amended to $2,000,000 on July 12, 2006.
The Sanitary Sewer Evaluation Survey Report given to the County in November 2006 showed that 7 of
the 25 sanitary sewer basins were not in full compliance with federal requirements. As a result, the City
on July 2007 agreed with the County to complete, planning, design, and construction of a sewer main
rehabilitation project for the 7non-compliant basins by October 2009. The goal of the project is to
reduce the overall inflow and infiltration in the City's sewer system. In order to meet the October 2009
deadline it is critical to start the planning and design effort immediately.
Since CDM has successfully been the City's sewer consultant for over ten (10) years, it has extensive
knowledge about the City's sewer infrastructure and has always provided timely and quality work. The
Administration considers to be in the best interest of the City to increase the MCL from $2 million to
$3,640,000 in order to complete the time sensitive work required by the County's Agreement.
Increasing the MCL is non-binding and is not a guarantee that the City will contract with CDM for
required future services. Fees for each task or service will be specifically negotiated by the City before
CDM is given a notice to proceed.
The Administration recommends approval of the Resolution.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
FUNDING
Funding in the amount of $500,000 for Professional Engineering Services is available from a
Gulf Breeze Loan.
Funding for additional task orders beyond the $500,000 will be provided at the time the task
order is issued.
BACKGROUND
On December 11, 2002, the City of Miami Beach authorized a Professional Services
Agreement (PSA), Service Order No. 1, with the firm Camp Dresser & McKee Inc. (the
Consultant) pursuant to Request for Qualifications (RFQ) No. 35-00/01 (Resolution No.
2002-25086) for Citywide Sanitary Sewer Improvements Projects. The PSA established a
maximum compensation limit (MCL) of $1,000,000, unless amended by the City
Commission.
The City of Miami Beach is a Volume Sewer Customer (VSC) of the Miami-Dade County
Water and Sewer Department (MDWASD). As such, the City must comply with the
requirements set forth in the VSC Ordinance 96-166 of the County, subsequently
incorporated into Section 242.2 of the County Code.

The VSC Ordinance is enforced by the Department of Environmental Resources
Management (DERM) and stipulates that public and sanitary sewer collection systems that
the following components and requirements must be completed:
1. Annual Report
2. Operation and Maintenance Manual for the Sewer System
3. System Atlas
4. Sanitary Sewer Evaluation Survey (SSES Phases I, II and III)
5. Collection and Transmission System Model
6. Peak Flow Management Study
The City has been complying with all of the above regulatory requirements with the
assistance of the Consultant which specializes in the area of civil engineering. In addition to
the DERM required assistance, the Consultant provides services related to otherwastewater
system technical issues. The City's Public Works Department recommends continuing to
employ the Consultant's services to provide technical assistance in meeting the ongoing
regulatory compliance requirements and to continue to assist in the technical review and
inspections of the sewer infrastructure rehabilitation program.
In January 2003, the City issued the Consultant a purchase order for Professional
Engineering Services during the rehabilitation of sanitary sewer lines throughout the City.
The project has been satisfactorily completed. More recently, the City authorized the
Consultant, on April 21, 2006, to undertake the DERM required Sanitary Sewer Evaluation
Survey (SSES) flow monitoring and post-rehabilitation report, which was submitted to DERM
by November 12, 2006. This study is required to report the completion of required corrective
work on the sewer system and obtain final field measurements of the system to determine its
compliance with infiltration percentage rates. This study gathered flow monitoring data of
the sanitary sewer system by basin size, including the calculation ofInflow/Infiltration (I/I) as
a percentage of rainfall falling on each of the basins.
Over the past five years the City has rehabilitated over 298,678 lineal feet of sanitary sewer
mains, throughout the City, reducing significantly the amount of rainfall and groundwater
inflow and infiltration into the City's sewer system. As part of the 1995 Consent Decree with
the County, in November 2006, the City completed Phase II of the SSES Report which
showed that 7 sanitary sewer basins out of a total of 25 sewer basins were not in full
compliance with Inflow/Infiltration (I/I) requirements.
As a result the SSES Report Phase II, the City on July 2007 agreed with the County to
rehabilitate the sanitary sewer lines in 7non-compliant basins by October 2009. In order to
meet the October 2009, it is critical to start the planning and design effort immediately.
The City must negotiate and issue a Notice to Proceed for the design of the Sanitary Sewer
Rehabilitation Project (Task 1) as soon as possible. Funding for this Task order in the
amount of $500,000 will be made available on October 15t from the Gulf Breeze Loan. As
part of the Agreement requirements the City projects the need for additional professional
engineering services for projects listed on the following page in the amount of $1,140,000.
Funding for additional task orders beyond the $500,000 will be provided at the time the task
order is issued.

The Consultant is swell-established firm having provided services to the City for over ten
years. The Consultant offers continuity in professional engineering services ranging from:
engineering analysis, investigation, program definition, planning, design, preparation of
construction documents, permitting, preparation of construction cost opinions,
bidding/contract award assistance, construction inspections, project management, project
coordination and construction observation/contract administration.
Camp Dresser and McKee, Inc. has successfully been the City's sewer consultant for over
ten (10) years, it has extensive knowledge about the City's sewer infrastructure and has
always provided timely and quality work. The Administration considers to be in the best
interest of the City to increase the
MCL from $2 million to $3, 640,000 in order to complete the time sensitive work required by
the County's Agreement.

CONCLUSION
The Administration recommends that the Mayor and City Commission of the City of Miami
Beach, Florida, approve and authorize the Mayor and City Clerk to execute Amendment No.
2 to the Agreement between the City and Camp Dresser & McKee Inc., for Professional
Engineering Services for Citywide Sanitary Sewer Improvement Projects, said Amendment
increasing Consultant's maximum compensation underthe Agreement, from snot-to-exceed
