A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,
APPROVING REVISIONS TO THE JACKIE GLEASON
THEATER BOOKING POLICY, AND APPROVING SAID
BOOKING POLICY, AS AMENDED.
WHEREAS, the City owns the Jackie Gleason Theater of the Performing Arts (TOP A) and
is desirous of facilitating the continued presentation of high quality entertainment events at that
venue; and
WHEREAS, the City has previously had in effect a Booking Policy to provide guidelines
for the management of the TOP A facilitating the booking of such entertainment events; and
WHEREAS, the Booking Policy has not been reviewed or revised since its inception
approximately five years ago; and
WHEREAS, the Mayor and City Commission have instructed the Convention Center
Advisory Board and user groups to review said policy; and
WHEREAS, the Convention Center Advisory Board, Spectacor Management Group, and
user groups for TOP A, have reviewed and deemed necessary revisions to the Booking Policy in
order to adequately facilitate the scheduling of entertainment events at the facility; and
WHEREAS, the Administration would recommend that the Mayor and City Commission
approve the attached revisions to the Booking Policy, as reviewed and recommended by the
aforestated groups, and further approved said Booking Policy, as amended and attached hereto.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve the revisions to the attached Jackie Gleason Theater Booking Policy,
and approving said booking policy, as amended,

As you are aware, at the direction of the Miami Beach City Commission, the Convention Center
Advisory Board, along with SMG, has undertaken a review of the Jackie Gleason Theater
Booking Policy, originally adopted in 1992. A subcommittee of the Board has recommended
certain revisions to the policy in order to accurately reflect and facilitate the programming and
booking of the venue. Members of the Board expressed their agreement with the proposed
changes at a non-quorumed meeting of the CCAB on June 12, 1997, and the Miami Beach City
Commission approved in concept the changes, pending additional user review, at its meeting on
June 18, 1997.
I have attached a copy of the Jackie Gleason Theater Booking Policy as revised by the CCAB
subcommittee and tentatively approved by the City Commission. This policy will be formally
considered at a special call meeting of the Convention Center Advisory Board on Monday, June
23, 1997 at 4:00 pm in the Executive Conference Room at the Convention Center. I would
respectfully request that any comments or concerns you may have regarding this policy be
presented at that time, so that the Board may present a complete and acceptable recommendation
to the City Commission at the July 2, 1997 meeting. Should you be unavailable for the June 23,
1997 meeting but desire your comments to be introduced at that time, please fax them to our
offices at 305-673-7435 prior to 3:00 pm on June 23, and they will be distributed to the Board
members.

BOOKING POLICY
L Statement of Purpose
The Jackie Gleason Theater (JGT) is a regional multi-purpose theater owned by the City of Miami Beach and operated by
Spectacor Management Group (SMG). The facility was IGeentl, ledG!igncd and I Gmoddcd redesi~ned and remodeled
in 1990 with the proceeds of a $22 million bond issue. The City of Miami Beach is committed to operating the venue
according to policies which will:
. Produce the highest possible income and operate the theater in a fiscally responsible manner.
. Encourage artistic events that interest the entire community, which include, but are not limited to, Broadway shows,
symphony presentations, ballet, opera, popular presentations and revues, etc.
. Make the JGT available to as many producers as possible so as to maximize the number of days during which
events are held
. Contribute to the image of Miami Beach as a cultural destination and support the above policies by developing and
implementing a strong marketing plan using the new image of the theater as a cornerstone of this effort.
. Assist programs from small, local community arts groups and educational institutions by offering incentives.

Presenters usilll: the facility shall be classified within the followin~ priorities:
First Priority - Users who contract to present at least twenty performances over at least four separate
events in a subscription series each year for more than one year
Second Priority - Users who contract to present at least twenty performances over at least four separate
events in a subscription series in one year
Third Priority - Users who contract to present at least four performances of a sin~le event OR users who
contract to present at least one performance each of at least four separate events in one year
Fourth Priority - Users who contract to present at least one performance of at least one event
Within each catel:ory. determination of priority shall be made by amount of proposed rental income returned to

dates to the blockbuster event. the presenter of the blockbuster event will execute a contract
within forty-eil:ht (48) hours of notification and be responsible for the full rental as outlined in the
contract. Any deposit from the displaced presenter currently held by the theater manal:ement
may be refunded to the party who provided the deposit. At the discretion of the General
Manal:er. established first priority users may be afforded revision of deposit requirements.

policy enumerated below, the booking hold will expire automatically after 30 days unless the prOOtleer presenter provides
a non-refundable deposit in accordance with the following schedule:
1. For a series of at least four events during a theater season - $1000
2. For an event with at least six performances during a theater season - $750
3. For a small community arts group or educational institution programs - $300
4. All other bookings - $500
The paid non-refimdable deposit will entitle the presenter to an additional 60 days extension period. Any rebookinl: of the
same date by the same presenter within 30 days of releasinl: said date shall be considered an extension and be
subiect to the required deposits as outlined in this section. If the presenter enters into a contract prior to the expiration
of the extension period, then the deposit will be applied to the contract. If the tentative date or dates are challenged and
another party goes to contract within the extension period, then the deposit will be refunded to the presenter who paid the
deposit.

V. Contract Deposits
A) The minimum contract deposit required will be Y:z of the base rental for all users.
B) New clients will pay a contract deposit offull rent at the management's discretion.
C) Small community arts groups and educational organizations will pay as contract deposit the minimwn
rental.
D) The remainder of the base rent is due two weeks prior to the event.
E) Producers with a series will be allowed to deposit the base rent for one performance, which will be
credited to the fmal performance of the series.
F) Deposits are non-refundable. Any producer who believes that its event was canceled due to exigent
circwnstances may request a partial or full retwn of the deposit, which is subject to the approval of the
Convention Center Advisory Board.
VI. Rental Rates
A) Not-For-Profit, Section 501 ( C ) ( 3 ) organizations (as defmed below) - $3,000 flat rent per
performance. Flat daily rent for more than one performance per day is $4,650. Events with more than
four performances per week are subject to negotiation with management.

VII. Community Arts and Educational Prol:rams
Small local community arts groups and educational institutions (as defmed below) - will be offered use of the
facility, when available, between the hours of9:00 A.M. - 5:00 PM at a discounted rate of $ 1.00/seat - minimum
rental - $600, with a cap of $1,000 plus front of the house and back of the house expenses. These groups may be
eligible to apply for a subsidy for a portion of the expenses from the appropriate City sources or other granting
agencies.
vm. Definitions
A) "Not-For-Profit, Section SOl (C) (3) Organizations" are defmed as organizations which meet all of the
following qualifications:
I) Current exemption letter from the IRS.
2) Current state certificate of incorporation and good standing.
B) "Small local community arts groups" are defmed as organizations which meet all of the following
qualifications:
I) Annual cash budget under $250,000$500.000
2) A year-round presence in Dade County
3) A track record demonstrating successful presentation of cultural and/or educational
programs.
C) "Educational institutions" are defined as organizations meeting the definition set forth in Florida Statutes,
Section 212.08 ( 7 ) ( 0 ) ( 2 )d, as amended from time to time.
D) A "Commercial organization" is defmed as any organization which does not qualify as A), B) or C)
above.
IX. General Mana~er's Discretion
The purpose of the bookinl: policy of the Jackie Gleason Theater is to provide the manal:ement with
~enerall:uidelines for the efficient operation of the facility. Nothin~ contained within those l:uidelines is
intended to limit the General Mana~er's discretion in the bookin~ or ne2otiation of contracts that in his
or her professional jud~ement would be in the best interest of the Jackie Gleason Theater and the City of
Miami Beach.

This is a follow-up report; no action is necessary.
BACKGROUND:
At the Commission meeting of June 18, 1997, the amended Booking Policy for the Jackie
Gleason Theater of the Performing Arts was approved, subject to having it circulated to the arts
community and endorsed by a quorum of the Convention Center Advisory Board (CCAB). These
actions have now been completed.
ANALYSIS:
On June 19, 1997, approximately two dozen user groups were provided copies of the revised
Booking Policy and invited to comment (Attachment 1). Responses were received from Miami
City Ballet, Ballet Etudes, Florida Philharmonic, Fantasma Productions, Community Concert
Association, Metro-Dade Cultural Affairs Council, and Miami-Dade Community College. The
only substantive change made in response to the users was the revision of the blockbuster clause
to allow for a challenge to an existing date hold, such clause changed from the previous version
which allowed the blockbuster event to supersede such existing date hold. The changes in the
policy, approved by the Commission, are shown as shaded in attached copy of the Booking
Policy (Attachment 2). Subsequently, the CCAB, by unanimous vote, endorsed the Booking
Policy in the form submitted today at a special meeting held on June 23, 1997.
CONCLUSION:
The stipulations set forth by the City Commission action of June 18, 1997 have been satisfied,
and the Jackie Gleason Theater of the Performing Arts Booking Policy shall be effective
immediately as per the attached form.
