A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA REJECTING ALL BIDS RECEIVED
IN RESPONSE TO REQUEST FOR PROPOSALS NO. 79-93/94, AS
AMENDED, ENTITLED "CITY OF MIAMI BEACH REQUEST FOR
PROPOSALS MULTIPLEX MOVIE THEATER ON LINCOLN ROAD",
TERMINATING THAT REQUEST FOR PROPOSALS AND DECLARING
THAT REQUEST FOR PROPOSALS TO BE NULL AND VOID AND OF NO
FURTHER FORCE AND EFFECT.
WHEREAS, the City of Miami Beach (the "City") issued Request for Proposals No. 79-
93/94, as amended, dated March 31, 1994, entitled "City of Miami Beach Request for Proposals
Multiplex Movie Theater on Lincoln Road" (the "RFP"); and
WHEREAS, four bids were received in response to the RFP; and
WHEREAS, the City and the Miami Beach Redevelopment Agency (the "RDA") conducted
extensive negotiations with the bidder ranked number one but those negotiations did not lead to an
agreement between that bidder and the RDA or the City; and
WHEREAS, the number one ranked bid has been rejected and terminated by the City and
the RDA; and
WHEREAS, it would not be in the best interests of the City for the City to negotiate with
the second ranked bidder for a theater development as contemplated in the second ranked bid
because, among other reasons, the City prefers a theater development with a larger investment by
the private sector, including, but not limited to, a larger investment of private sector property; and
WHEREAS, the City would like to reject and terminate the second, third and fourth ranked
bids received in response to the RFP; and
WHEREAS, the City would like to terminate the RFP and declare it to be null and void and
of no further force and effect.
NOW, THEREFORE, BE IT DUL Y RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that:
1. The RFP is hereby terminated and is hereby declared null and void and of no further
force and effect.
2. The termination and rejection by the City Commission of the bid that was ranked
number one in response to the RFP is ratified.
3. Those bids ranked second, third and fourth by the City Commission in response to
the RFP are rejected and terminated.
4. This Resolution shall take effect immediately upon its adoption.

Declaring that Request for Proposals to be Null and Void
and of No Further Force and Effect.

RECOMMENDATION:
Approve the Resolution
BACKGROUND:
The Redevelopment Agency had previously rejected the number one
bidder for the Lincoln Road Theater Project, pursuant to RFP No.
79-93/94. In subsequent meetings and workshops, the City
Commission and Redevelopment Agency rejected the concept of
offering two City lots and gave the Administration directions to
pursue proposals that are being advocated by private developers
involving lesser City assistance.
ANALYSIS:
As the City Commission/Redevelopment Agency did not take action
officially to reject the number two through four bidders, it is
important that this housekeeping step be taken now. The
Administration is currently meeting with the two project proponents
which had appeared at the workshop, as well as three other
interested groups which had responded to an advertisement placed in
The Miami Herald last month, in response to
Commission/Redevelopment Agency direction to seek out other
interested parties. An oral progress report will be presented at
the Redevelopment Agency meeting of April 2, 1996 on these

discussions. The Administration anticipates it will have a firm
recommendation ready for the April 17, 1996
Commission/Redevelopment Agency meeting.
CONCLUSION:
The Commission/Redevelopment Agency should approve the Resolution.
