2007-26663 ResoRESOLUTION NO. 2007-26663 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING USER FEES FOR LIGHT POLE BANNERS, AS APPROVED AND INSTALLED PURSUANT TO SECTION 82-411 OF THE MIAMI BEACH CITY CODE BY ESTABLISHING A FIFTY DOLLAR ($50.00) PROCESSING FEE, AS WELL AS A PER POLE FEE OF FIFTY DOLLARS ($50.00) FOR COMMERCIAL EVENT PRODUCERS, AND TWENTY-FIVE DOLLARS ($25.00) FOR NON-PROFIT (501(C) 3) EVENT PRODUCERS; WITH SAID FEES TO BE EFFECTIVE ON OCTOBER 1, 2007. WHEREAS, pursuant to the procedures for same in Section 82-411 of the City Code, the City allows street pole banners, in conjunction with permitted special events to be temporarily installed within the City limits: and WHEREAS, on July 19, 2007, the Finance and Citywide Projects Committee discussed the Fiscal Year (FY) 2007/08 proposed operating budget, and recommended in favor of establishing additional light pole banner fees; and WHEREAS, the current fifty dollar ($50.00) processing fee will continue to be charged, and an additional per pole fee of fifty dollars ($50.00) for commercial event producers, and twenty-five dollars ($25.00) for non-profit (501(c) 3) event producers, shall also be established, effective October 1, 2007. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYORAND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that Mayor and City Commission establish user fees for light pole banners, as approved and installed pursuant to Section 82-411 of the Miami Beach City Code by establishing a fifty dollar ($50.00) processing fee, as well as a per pole fee of fifty dollars ($50.00) for commercial event producers, and twenty-five dollars ($25.00) for non-profit (501(c) 3) event producers; with said fees to be effective on October 1, 2007. Item Summary/Recommendation: Per the City of Miami Beach Code, Division 6 sec. 82-41, Sign Regulations, street pole banners, in conjunction with permitted special events, can be temporarily installed on select street poles within the City limits. The purpose of the banner program is to promote special events and banners promoting local public institutions or districts. The city does not permit commercial marketing/advertising banners. Currently, the Tourism and Cultural Development Department (TCD) receives applications for the placement of light pole banners and charges a fifty dollar ($50.00) processing fee at the time of application submittal. TCD reviews the application to ensure that it meets the requirements of the City Code. Design is reviewed by the Planning and Zoning Department. Subsequently, the permit is signed off by the City Manager's office. The applicant works with the banner company on identifying available locations, ,and coordinating production and placement once an application has been approved. It is proposed that in addition to the app-ication fee, a per banner fee be charged. ANALYSIS Per the City of Miami Beach Code, Division 6 sec. 82-41, Sign Regulations, street pole banners, in conjunction with permitted special events, can be temporarily installed on select street poles within the City limits. The purpose of the banner program is to promote special events either occurring in the city or outside the city if there is a reciprocal program, and banners promoting local public institutions or districts. The city does not permit commercial marketing/advertising banners. Examples of these banners are those installed to advertise the Boat Show, Art Basel Miami Beach or the Miami International Film Festival. The public institutions or districts include banner signs for the Bass Museum, the Wolfsonian, for the Arts district, and CANDO. According to existing City Code, these banners are all installed for a limited time, not to exceed 30 days. Currently, the Tourism and Cultural Development Department (TCD) receives applications for the placement of light pole banners throughout the City. A fifty dollar ($50.00) processing fee is due at the time of application submittal. TCD reviews the application to ensure that it is an eligible event for promotion; to review the dates the banners are proposed to be placed; to ensure no conflict with pole banner signs already placed; and to ensure the banner design meets the guidelines, which is also reviewed and approved by the Planning and Zoning Department. Subsequently, the permit is signed off by the City Manager's office. The applicant works with the banner company on identifying available locations, and coordinating production and placement once an application has been approved. Banners may be displayed for up to 30 consecutive days in a calendar year • Banners must be 3 feet in width and 7 feet in length • Banners may not be any longer than 21 square feet in area • No more than 25% of the banner may be used for identification (name/Logo) of an event sponsor, unless the text constitutes the overall image of the banner • Banners must be constructed of lightweight, pliable and durable fabrics especially designed for outdoor display and use (wind slits are required) • In case of a of a hurricane all banners must be removed within 24 hours before making landfall or upon an issuance of a hurricane watch • Banners must be attached to pre-approved metal street light poles capable of withstanding wind loads generated by banner attachments (poles with traffic signals are not eligible) • Banners must be at least 12 feet above grade, unless it overhangs a roadway, in which case it must be at least 15 feet above grade • Banners must not project more than three feet from the pole onto which it is mounted On July 19, 2007, the Finance and Citywide Projects Committee discussed the FY 2007/08 proposed operating budget. The Committee discussed several potential revenue enhancements and recommended in favor of establishing light pole banner fees. The proposal maintains the current fifty dollar ($50.00) processing fee, but adds a per pole fee. The additional per pole fee is recommended to be fifty dollars ($50.00) for commercial event producers and twenty-five dollars ($25.00) for non-profit (501(c) 3) event producers. Based on FY 2005/06 actuals, the City is projecting a net increase of $72, 000 in additional revenue. CONCLUSION The Mayor and City Commission should adopt the resolution establishing user fees for street pole banner advertising and further establishing a fifty dollar ($50.00) processing fee, as well as a per pole fee of fifty dollars ($50.00) for commercial event producers and twenty-five dollars ($25.00) for non-profit (501(c) 3) event producers.
