A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 1,
TO THE PRE-CONSTRUCTION SERVICES AGREEMENT WITH KVC
CONSTRUCTORS, INC, DATED DECEMBER 6, 2006, FOR THE
SCOTT RAKOW YOUTH CENTER, IN THE NEGOTIATED AMOUNT OF
$227,000 PLUS A CONTINGENCY OF $11,350, PREVIOUSLY
APPROPRIATED, FOR THE INSTALLATION OF THE POOL
FILTRATION SYSTEM.
WHEREAS, the Scott Rakow Youth Center (SRYC) Renovation Project was initiated by the
Mayor and City Commission in 1994 and was a part of the original $15-million Parks Bond issue
and Phase I of the improvements included the construction of the new ice skating rink; and
WHEREAS, Phase II improvements include a major remodeling and renovation of the
existing facility, presently under design; and
WHEREAS, the scope of work associated with the proposed Amendment 1 to the existing
Agreement with KVC Constructors (KVC) deals with maintenance repair work for the pool
filtration system replacement that is independent of the scope of work contemplated as part of
the Phases I and II improvements; and
WHEREAS, on December 6, 2006, the Mayor and City Commission approved Resolution
No, 2006-26415, authorizing the execution of an Agreement between the City of Miami Beach
and Brown and Brown Architects Inc. for professional architecture and engineering services for
the Phase II renovation of the Scott Rakow Youth Center; and
WHEREAS, on December 6, 2006, the Mayor and City Commission approved Resolution
No. 2006-26416, authorizing the Mayor and City Clerk to execute aPre-Construction Services
Agreement with KVC Contractors, Inc (KVC) for the Scott Rakow Youth Center (SRYC)
pursuant to Request For Qualifications No. 27-05/06; and
WHEREAS, the current pool filtration system is alabor-intensive system, dating to 1976,
which has been experiencing numerous failures that impact operation activities and the
swimming program; and
WHEREAS, prior to the existing KVC Agreement, and separate from the Phase II
renovations, an earlier capital renewal project at SRYC had anticipated performing the
replacement of the pool filtration system with one of the City's JOC contractors; and
WHEREAS, the Agreement with KVC, provides for the City to issue construction services
amendments once the design is complete and a negotiated guaranteed maximum price is
reached; and
WHEREAS, the JOC contractor was unable to begin the project and it was determined that
it would in the best interest of the City to utilize the construction services available through the
existing KVC Agreement; and
WHEREAS, The City and KVC negotiated and agreed to a Guaranteed Maximum Price
(GMP) of $227,000, which falls below the cost estimates provided by the Architect and the
independent estimator; and
WHEREAS, the funding for this work was appropriated in previous fiscal years; specifically,
$77,777 in the Capital Renewal and Replacement Fund fiscal year 2005/06, Account 125-6351;
$93,884 in the Middle Beach Quality of Life Fund, Account 161-6225; and $66,689 in the Pay-
As-You Go Fund, Account 302-2513.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve and authorize the Mayor and City Clerk to execute Amendment
No. 1 to the Pre-Construction Services Agreement with KVC Constructors, Inc., dated
December 6, 2006, for the Scott Rakow Youth Center, in the negotiat amount of $227,000
plus a contingency of $11,350, previously appropriated, for the ins f n of the pool filtration

includes a major remodeling and renovation of the existing facility, presently under design. The scope of work
associated with the proposed Amendment 1 to the existing Agreement with KVC Constructors (KVC) deals with capital
maintenance repair work for the pool filtration system that is independent of the scope of work contemplated as part of
the Phases I and II improvements. On December 6, 2006, the Mayor and City Commission approved Resolution No,
2006-26415, authorizing the execution of an Agreement between the City of Miami Beach and Brown and Brown
Architects Inc. for professional architecture and engineering services for the Phase II renovation of the SRYC. In
conjunction with the Phase II project, on December 6, 2006, the Mayor and City Commission approved Resolution No.
2006-26416, authorizing the execution of an Agreement between the City of Miami Beach and KVC to provide
construction manager at risk services for the Phase II renovation of the Scott Rakow Youth Center. These services
include review of project requirements, existing on-site conditions, review of preliminary budget, project scheduling and
phasing, value engineering, and assisting Brown and Brown Architects in the development ofthe plans. The Agreement
with KVC, provides for the City to issue construction services amendments once the design is complete and a
negotiated guaranteed maximum price is reached. It is anticipated that the City will issue an amendment to the KVC
Agreement to provide construction services for these improvements. Prior to the existing KVC Agreement, and separate
from the Phase I I renovations, an earlier capital renewal project at SRYC had anticipated performing the replacement of
the pool filtration system with one of the City's JOC contractors. However, the previous contractor was unable to begin
the project and it was determined that it would in the best interest of the City to utilize the construction services
available through the existing KVC Agreement. This provided the added benefit of utilizing the same contractor that is
currently collaborating with the Architect and is also familiar with the facility. The City and KVC negotiated and agreed to
a Guaranteed Maximum Price (GMP) of $227,000, which falls below the cost estimates provided by the Architect and
the independent estimator. The construction duration of this project has been negotiated at 120 calendar days. With
the approval of this Resolution, it 's anticipated that this work will commence in November of 2007.

Funding for this amendment was appropriated in previous fiscal years, specifically $77,777
in the Capital Renewal and Replacement Fund Fiscal Year 2005-2006, Account 125-6351;
$93,884 in the Middle Beach Quality of Life Fund, Account 161-6225; and $66,689 in the
Pay-As-You Go Fund, Account 302-2513.
ANALYSIS
The Scott Rakow Youth Center (SRYC) Renovation Project was initiated by the Mayor and
City Commission in 1994 and was a part of the original $15-million Parks Bond issue.
Phase I of the improvements included the construction of the new ice skating rink. Phase II
includes a major remodeling and renovation of the existing facility, presently under design.
The scope of work associated with the proposed Amendment 1 to the existing Agreement
with KVC Constructors (KVC) deals with maintenance repair work for the pool filtration
system replacement that is independent of the scope of work contemplated as part of the
Phases I and II improvements.
On December 6, 2006, the Mayor and City Commission approved Resolution No, 2006-
26415, authorizing the execution of an Agreement between the City of Miami Beach and
Brown and Brown Architects Inc. for professional architecture and engineering services for
the Phase II renovation of the Scott Rakow Youth Center. The Phase II improvements are
presently at the 70% design stage. The scope of work for the renovation of the existing
facility consists of the following components: expansion of the existing parking lot; a new bus
drop-off area that separates vehicular and pedestrian traffic; ADA accessible walkways; new
playground area; conversion of the old ice rink into amulti-purpose room; renovation of the
existing entry plaza; construction of anew entry addition with a new handicapped
accessible elevator; complete remodeling of the first and second floors; new fire sprinkler
and central fire alarm systems; upgrade of existing HVAC system for the new design loads;
a new trash collection area; and a new Zamboni drainage pit for the new ice rink.

Agreement between the City of Miami Beach and KVC to provide construction manager at
risk services for the Phase I I renovation of the Scott Rakow Youth Center. These services
include review of project requirements, existing on-site conditions, review of preliminary
budget, project scheduling and phasing, value engineering, and assisting Brown and Brown
Architects in the development of the plans. The Agreement with KVC, provides for the City
to issue construction services amendments once the design is complete and a negotiated
guaranteed maximum price is reached. It is anticipated that the City will issue an
amendment to the KVC Agreement to provide construction services forthese improvements.
Prior to the existing KVC Agreement, and separate from the Phase I I renovations, an earlier
capital renewal project at SRYC had anticipated performing the replacement of the pool
filtration system with one of the Cites JOC contractors. However, the previous contractor
was unable to begin the project and it was determined that it would in the best interest of the
City to utilize the construction services available through the existing KVC Agreement. This
provided the added benefit of utilizing the same contractor that is currently collaborating with
the Architect and is also familiar with the facility.
The current pool filtration system is alabor-intensive system, dating to 1976, which has been
experiencing numerous failures that impact operation activities and the swimming program.
Presently, it is difficult to maintain the system due to the extreme deterioration from years of
use. The system has poor water circulation and requires more frequent backwash
operations.
The scope of the pool filtration system improvements includes the replacement of the
existing filters, pumps, valves, piping and controls, new chlorinating tank and enclosure, as
well as performing structural repairs to the equipment room. Replacement of the system
with the recommended high rate sand filtration system, similar to those installed at the
Flamingo Park and Normandy Isle Park pools, will greatly reduce maintenance-related labor,
and allow for bulk purchasing of chemicals and supplies for the three locations.
The City and KVC negotiated and agreed to a Guaranteed Maximum Price (GMP) of
$227,000, which falls below the cost estimates provided by the Architect and the
independent estimator. The construction duration of this project has been negotiated at 120
calendar days and currently has a City permit for construction (Number 80604696). With the
approval of this Resolution, it is anticipated that this work will commence in November of
2007 which is the optimal month due to the winter season.
CONCLUSION
The Administration recommends approval of the attached Resolution, authorizing the Mayor
and City Clerk to execute Amendment No. 1, in the amount of $227,000 plus a contingency
in the amount of $11,350, to the Agreement with the firm of KVC Constructors, Inc. for Pre-
Construction Services at the Scott Rakow Youth Center.
