A RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, ACCEPTING A DONATION TO THE
CITY, FOR THE BASS MUSEUM OF ART, OF THOSE CERTAIN WORKS
OF ARTS, AS SET FORTH IN EXHIBIT "A" TO THIS RESOLUTION,
VALUED IN TOTAL AT $908,000, FROM ALAN AND ROBERT POTAMKIN.
WHEREAS, the Bass Museum of Art collects works of art as one of its purposes and
encourages donations of works of art it desires; and
WHEREAS, on August 21, 2007, the Board of Trustees of the Bass Museum of Art
unanimously approved acceptance, as unrestricted gifts, of those certain works of art, donated to
the Museum by Alan and Robert Potamkin, which works are set forth in Exhibit "A" to this
Resolution; and
WHEREAS, the Bass Museum of Art has documentation, including deeds-of-gift from the
donors and valuations for the aforestated works, totaling $908,000; and
WHEREAS, the City, as the owner of the Bass Museum of Art, shall have custody of the
donated art works, and shall maintain them as it currently maintains works ofart in the Museum's
permanent collection; and
WHEREAS, as a condition of the City Commission's waiver of the AiPP requirement for the
Fifth and Alton commercial/retail project, the Development Agreement required Mr. Alan Potamkin
(as one of the equity owners of the project) to make a donation of art to the Bass Museum; and
WHEREAS, the City Manager recommends acceptance of the aforestated donation to the
City, on behalf of the Bass Museum.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission accept the
donation to the City, for the Bass Museum of Art, of those certai orks of arts, asset forth in Exhibit
"A" to this Resolution, valued in total at $908,000, from Alan Robert Potamkin.

Various works of art from the collections of Alan and Robert Potamkin were accepted by the Trustees of
the Bass Museum of Art on loan as promised gifts to the Museum on November 14, 2002. On August 21,
2007 the Trustees voted to accept these works as unrestricted gifts to the Museum. Pursuant to the
Agreement between the City and the Bass Family, as amended in September 1990, the Board of Trustees
must submit to the City its tentative acceptance of donated works of art, and "if the City Commission does
', not vote to reject the donation within 60 days of the date of notice, the acceptance shall become final and
the date of acceptance shall become final as of the date of the vote of the board." Maintenance and
insurance expenses of the new acquisitions would not increase beyond that which the City already incurs.
The Administration recommends the adoption of the attached Resolution authorizing the acceptance of
these gifts of works of art, as set forth in Exhibit A and totaling $908,000 by the City on behalf of the Bass
Museum of Art, and further providing that these donated works of art shall be maintained by the City in the
same manner as it currently maintains other works of art in the Museum's permanent collection.

ADMINISTRATION RECOMMENDATION
Adopt the resolution.
ANALYSIS
The itemized works of art listed in the attached Exhibit A were accepted by the Trustees of the
Bass Museum of Art as a loan and promised gift on November 14, 2002. The Museum has been
in possession of these works since that time and has the appropriate documentation for all of
these works. On August 21, 2007, the Trustees voted to accept these works as unrestricted gifts
to the Bass Museum of Art.
Pursuant to the Agreement between the City and the Bass Family, as amended in September
1990, the Board of Trustees must submit to the City its tentative acceptance of donated works of
art, and "if the City Commission does not vote to reject the donation within 60 days of the date of
notice, the acceptance shall become final and the date of acceptance shall become final as of the
date of the vote of the board."
The Museum derives its central purpose from its permanent collection of more than 3,000
objects, including European old master paintings, tapestries, 20th Century and contemporary
paintings, sculpture, graphics, photography, and architectural and design arts. Its collections are
an integral part of the collective cultural fabric of the region, fully reflecting the diversity of the
Museum's constituency and the interests of community collectors. The acquisitions in Exhibit A
are appropriate to the Museum's collecting program. By accepting these works of art, the City
agrees to accept all future obligations relative to preserving, restoring, storing and exhibiting the
works as part of the Museum's permanent collection. Since these works have been on loan to
the Museum since 2002, maintenance and insurance expenses related to these new permanent
acquisitions would not increase beyond that which the city already incurs.
CONCLUSION
The Administration recommends the adoption of the attached Resolution authorizing the
acceptance of these gifts of works of art, as set forth in Exhibit A and totaling $908,000 by the
City on behalf of the Bass Museum of Art, and further providing that these donated works of art
shall be maintained by the City in the same manner as it currently maintains other works of art in
the Museum's permanent collection.
