2007-26679 ResoRESOLUTION NO. 2007-26679 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH THE STATE ATTORNEYS OFFICE, PUBLIC DEFENDER'S OFFICE, CLERK OF COURTS, ADMINISTRATIVE OFFICE OF THE COURTS, AND MIAMI DADE COUNTY ASSOCIATION OF CHIEFS OF POLICE ESTABLISHING THE TERMS FOR THE USE AND OVERSIGHT OF THE E-NOTIFY SYSTEM. WHEREAS, the Miami Beach Police Department is responsible for enforcing local codes, ordinances, and State laws in the City of Miami Beach; and WHEREAS, the enforcement of these codes, ordinances, laws, and the prosecution of violators, assists in ensuring a superior quality of life for the residents and visitors of the City of Miami Beach, and to maintain and improve the health, safety, and welfare of this community; and WHEREAS, the prosecution of these laws requires the presence of Miami Beach Police Department personnel to appear at judicial proceedings pursuant to a subpoena issued through the Miami Dade County Clerk of the Court; and WHEREAS, all the local agencies involved in the prosecution of offenders in the 11`h Judicial Circuit, to include the State Attorneys Office, Office of the Public Defender, Clerk of the Court and supported by the Miami Dade County Association of Chiefs of Police, have entered into an agreement to, and participate in, the implementation of an electronic notification subpoena and court notification management system, also known as the E-Notify System; and WHEREAS, this E-Notify System is a more efficient subpoena notification and delivery system than the previous system, and will cost approximately a $1000 on an annual basis. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk are authorized to execute a Memorandum of Understanding with the State Attorney's Office, Public Defender's Office, Clerk of Courts, Administrative Office of the Courts, and Miami Dade County Association of Chiefs of Police establishing the terms for the use and oversight of the e-notify system. Item Summary/Kecommenaat~on: The 11 Judicial Circuit of Florida comprises the Miami-Dade State Attorney's Office, the Clerk of the Court, and the Public Defender's Office in addition to all the municipal jurisdictions in Miami-Dade County. All these criminal justice agencies have agreed to support and implement the E-Notify System. The E- Notify System is an automated subpoena delivery system, utilizing electronic a-mail designed to increase the efficiency and timely reception of subpoenas to witnesses and law enforcement personnel. The Miami- Dade Police Department's Court Services Bureau is spearheading this system with the support of the Dade County Association of Chiefs of Police. To participate in this program it will cost the Miami Beach Police Department approximately $1,000 per year. To facilitate the countywide adoption and administration of this system, Miami-Dade County has prepared a Memorandum of Understanding. This Memorandum of Understanding will outline the framework under which all participating agencies to include the Miami Beach Police Department will work together in utilizing a single integrated system to provide consistent and efficient subpoena and court notification services countywide. The Miami Beach Police Department is prepared to implement this system via our Court Liaison Office and is in full support of its implementation.
