RESOLUTION No. 2001-24231
A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING
THE SECOND AMENDMENT TO THE POLICE
CONFISCATION TRUST FUND FOR FISCAL YEAR 2000/01,
IN THE AMOUNT OF $853,021, TO BE FUNDED FROM THE
PROCEEDS OF STATE ($811,979) AND FEDERAL-JUSTICE
($41,042) CONFISCATED FUNDS.
WHEREAS, Section 932,705, Florida Statutes, addresses the purpose and procedures to
be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and
WHEREAS, the Chief of Police of the City of Miami Beach has determined that the
need for appropriation and expenditures exist and the appropriation and expenditure of forfeiture
funds is in compliance with Section 932,705, Florida Statutes; and federal guidelines; and
WHEREAS, such funds are available in the Police Confiscation Trust Fund.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby adopt the Second Amendment to the FY 2000/01 Police Confiscation Trust
Fund Budget for the City of Miami Beach, in the amount of$853,021, to be funded from the
proceeds of State ($811,979) and Federal-Justice ($41,042) Confiscation Funds as reflected in
the attached Exhibit "A",

THE MIAMI BEACH POLICE ANTI GRAFFITI PROGRAM
is a comprehensive effort to reduce and hopefully eliminate graffiti
in Miami Beach through the following efforts:
I, Enforcement: through surveillance, aggressive patrol in high graffiti
areas and the use of technology to arrest those individuals committing
vandalism, $20,000 will be allocated to fund this portion ofthis program;
2, Rewards Program: A highly publicized campaign funded through
Crime Stoppers to turn those individuals in who are committing this
difficult to solve crime, $10,000 wll be allocated to fund this portion of
this program; 3, Graffiti Removal: Quick removal of graffiti has proven
to be invaluable in helping stop the spread of graffiti, Currently the City
is pursuing a contract with private vendors to provide this much needed
service; 4, Education: Through partnership with the DARE program,
educate elementary school aged children on the destructiveness that graffiti
causes in their own neighborhood, 30,000

ANALYSIS
Florida Statute 932,705 provides for expenditures offorfeiture funds for law enforcement purposes,
The Chief of Police of the City of Miami Beach has reviewed and identified the need for the
appropriation and has established that the expenditures of forfeiture funds is in compliance with
Section 932,705, Florida State Statutes and Federal guidelines, These forfeiture funds have been
deposited in the Police Confiscation Trust Fund, The City has complied with all statutory
procedures involved in the transaction of these funds,
The Administration requests authorization to adopt the Second Amendment to the operating budget
for the Police Confiscation Trust Fund for Fiscal Year 2000/01 and to appropriate $853,021 from
State ($811,979) and Federal-Justice ($41,042) Funds to provide for the the expenditures listed in
Exhibit "A",
