A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AND
APPROPRIATING THE EXPENDITURE OF UP TO $30,000 FROM THE $92
MILLION GENERAL OBLIGATION BONDS, SERIES 2000, FUND NO. 373
(NAUTILUS NEIGHBORHOOD STREETSCAPE FUNDING) TO
CONSTRUCT A SIDEWALK ALONG THE WEST SIDE OF PINE TREE
DRIVE, FROM 46TH STREET TO 47TH STREET.
WHEREAS, there is no sidewalk along the section of Pine Tree Drive from the intersection
where 46th Street and Sheridan A venue converge to the intersection with 47fu Street; and
WHEREAS, pedestrians going to the retail shops, bus stops, apartments and Congregation
Ohr Chaim, north of 47fu Street, must walk in the travel lane of Pine Tree Drive to go from 46 UStreet
or Sheridan Avenue to 47th Street; and
WHEREAS, Pine Tree Drive is a County-maintained roadway; and
WHEREAS, the City Administration requested that the County install a sidewalk at this
location, and Miami-Dade County Public Works responded that the request for a new sidewalk has
been added to the current list and will be addressed when other priorities have been met or additional
funding becomes available; and
WHEREAS, Nautilus Neighborhood residents, including two of the four homeowners along
this section, have requested that the installation of a sidewalk be among the neighborhood projects
for the Nautilus Neighborhood; and
WHEREAS, this request was brought before the General Obligation Bond Oversight
Committee on December 11, 2000, and the Oversight Committee voted to approve this allocation
and recommend it to the Mayor and the City Commission for approval.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the the Mayor and City
Commission herein approve appropriating funds up to $30,000, from the $92-million General
Obligation Bond, Series 2000, Fund No. 373, within the Nautilus Neighborhood Streetscape Project
to construct a sidewalk along the west side of Pine Tree Drive from 46fu Street to 47fu Street.
PASSED and ADOPTED this 10th day of January, 2001.

Re: New Sidewalks at Pine Tree Drive
Dear Mr. Alvarez:
Pursuant to your request, please be advised that historically, sidewalks in Miami-Dade
County are constructed by private individuals or developers as part of the building
construction and land development process, and subsequently maintained by the Public
Works Department. In addition, by utilizing various funding sources such as the Local
Option Gas Tax and the Quality Neighborhoods Initiative Bond Programs (QNIP), the
Department is addressing the need to repair broken sidewalks as well as constructing new
ones throughout Miami-Dade County.
The quantity of new sidewalks in need of repair throughout the County is greater than the
available funding; therefore, it has become necessary to establish priorities that will
provide the most benefit to the public at large. The Public Works Department focuses its
sidewalk construction and repair efforts in the immediate vicinity of elementary schools
and parks, as well as other locations of rp.ass public access such as ;vletrorail stations and
other government facilities.
Your request for new sidewalk will be added to the current list and will be addressed
when the priorities mentioned above have been met or additional funding becomes

ANALYSIS
Since before the passing of the G.O. Bonds in November 1999, the Nautilus residents have requested
that the installation of a sidewalk be among the neighborhood projects for the Nautilus
Neighborhood. The purpose of their request is to alleviate a dangerous situation in which pedestrians
going to the retail shops, bus stops, apartments and Congregation Ohr Chaim north of 47th Street
must walk in the travel lane of Pine Tree Drive to go from 46th Street or Sheridan Avenue to 41h
Street. Along this section of approximately 300 ft., there is no sidewalk. There are four residences
along this segment, all of which have shorter front yards than other similar residences to the south.
The roadway pavement along this section is wider, having additional unmarked pavement beyond
the required lane width.

Pine Tree Drive is a County-maintained roadway, and the installation, repair, and upkeep of
pedestrian facilities should be implemented by the County. The City Administration requested that
the County install a sidewalk, and Miami-Dade County Public Works responded in a letter of
October 25, 2000 (attachment), that, the request for a new sidewalk has been added to the current
list and will be addressed when priorities mentioned above have been met or additional funding
becomes available.
It is unlikely that the County will be able to implement this very soon. Since this community has
asked to be a priority, the Administration is recommending that the City's Public Works Department
work with the County to design and construct a sidewalk here, using G.O. Bond funding from the
Nautilus Neighborhood Streetscape. Although this is part of Orchard Park, this small project should
move forward without waiting for the resolution of other planning issues regarding Orchard Park,
because it is to alleviate a dangerous situation.
An allowance of up to $30,000 is being requested to assure that:
1. a sidewalk is constructed within the shortest time possible; and
2. that the sidewalk does not significantly impact the front yard and landscaping buffer to the
4 houses.
The funding would be used for design and construction of the sidewalk, new curb and gutter as
necessary, pavement removal as necessary, small drainage modifications as necessary, and the
improvement or reconditioning of painted crosswalk markings at either end.

This request was brought before the General Obligation Bond Oversight Committee on December
11, 2000. Recognizing that this should be a County-funded project, members of the Oversight
Committee recognized the importance of remedying an unsafe pedestrian situation in the Nautilus
Neighborhood and approve the project.
At the Oversight Committee meeting, the present request was compared to a similar situation 3 years
ago in which a section of Pine Tree Drive near the Hebrew Academy at 23Rl Street was also with out
a sidewalk. At that time, even though it was also a County responsibility, the City Commission
voted to fund the project to remedy the danger to pedestrians without delay.
The Oversight Committee requested that with its recommendation to use G.O. Bond funds, City staff
would seek alternative funding to construct or reimburse construction of the sidewalk, however staff
should proceed to design and construct the sidewalk without delay. The Oversight Committee voted
to appr~s allocation and recommend it to the City Commission for approval.
