A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
RETROACTIVE APPLICATION FOR A GRANT, AND IF FUNDED,
AUTHORIZING THE APPROPRIATION AND EXPENDITURE OF
FUNDS UNDER THE STATE OF FLORIDA, MOTOR VEHICLE
THEFT PREVENTION AUTHORITY FOR THE PURCHASE OF
ELECTRONIC INVESTIGATION AND SURVEILLANCE EQUIPMENT
FOR THE MIAMI BEACH POLICE DEPARTMENT IN THE AMOUNT
OF $12,140.00.
WHEREAS, the City of Miami Beach Police Department conducts
intensive and proactive investigations into the thefts of automobiles
and other related crimes; and
WHEREAS, the City of Miami Beach Police Department desires to
enhance it's ability to conduct such investigations by the use of
newly developed electronic investigation and surveillance equipment;
and
WHEREAS, the state of Florida, through the Florida Motor
Vehicle Theft Prevention Authority, has funds available for the
purchase of this type of equipment; and
WHEREAS, the total estimated funds necessary for this purchase
is $12,140.00 and the state of Florida, Florida Motor Vehicle Theft
Prevention Authority Financial Assistance is required for this
project. There is no cash match required by the City.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
section 1. That the City of Miami Beach Police Department
through the Office of the City Manager, is authorized and directed to
make application to the State of Florida, Florida Motor Vehicle Theft
Prevention Authority for grant funding for the City of Miami Beach
Police Department to purchase electronic investigation and
surveillance equipment, provided there is no cash match required for
this project from the City of Miami Beach.
section 2. That the City of Miami Beach Police Department
certifies that it will accept the terms and conditions set forth in
the Grant Agreement for any assistance awarded under the proposal for
grant funds; and the city of Miami Beach Police Department is in
complete accord with the proposal and will carry out the grant in the
manner described in the proposal and any plans and specifications
thereto unless prior approval for any change has been received.
section 3. That the City of Miami Beach Police Department
will not discriminate against any person on the basis of race, color,
or national origin in the use of any property or facility acquired or
developed pursuant to this proposal, and shall comply with the terms
and intent of the Title VII of the civil Rights Act of 1964, P.L. 88-

352 (1964) and design and construct all facilities to comply fully
with statutes relating to accessibility by handicapped persons as
well as other federal, state, an local laws, rules and requirements.
Section 4. That the city of Miami Beach Police Department
will maintain adequate financial records on the proposed grant to
substantiate claims for reimbursement.

The growing trend in Auto Theft investigations has
pursuit of organized individuals (those engaged in
stolen vehicles, chop shops, etc.) in lieu of amassing
arrests, i.e., arresting persons who are driving
vehicle. Research has shown that:

Theft Investigators.
b) The Criminal Justice System does not sanction
single auto theft cases. Adults need 5 convictions
before being sentenced to 1 day in State Prison.
H.R.S. criteria does not include auto theft as a
detainable offense. Officers must immediately
release juveniles arrested for auto theft.
c) Charging an individual responsible for numerous
ongoing thefts per week resulting from more
technical (title fraud, renumbering stolen
vehicles, exporting) investigations result in more
severe penalties has a strong potential to "put him
out of business" and has an impact reducing auto
thefts.
This trend or strategy is supported by the F.D.L.E. 1995 report
which shows that the auto theft in Florida dropped 10.8% even
though law enforcement made significantly less auto theft arrests
(11,408 in 1995 vs. 14,292 in 1994). It is further supported the
approximate 45% reduction of auto thefts in Hillsborough County
(Tampa city Area) after the establishment of a County Auto Theft
Task Force who employed the aforementioned strategy.
The Auto Theft Unit intends to utilize two items of specialized
equipment, a Fiber Optic Scope and a Trac Man Vehicle Direction
Finder, to investigate and apprehend organized auto theft rings.

Part A. Statement of Need
Auto Theft is a big problem in the City of Miami Beach. In 1995,
2,656 auto thefts were reported. Miami Beach ranks tenth in the
state for the number of auto thefts and fourth in Dade County.
Auto Thefts comprised 2.42% of all thefts in Miami Beach in 1995.
The Auto Theft Unit needs to enhance it's ability to investigate
and apprehend organizations of persons who are in the business of
auto theft.

TERMS OF THE GRANT

ADMINISTRATION RECOMMENDATION
Approval of the Resolution.
BACKGROUND
The Miami Beach Police Department Auto Theft Unit conducts extensive
and on-going investigations into thefts of automobiles and related
crimes. A great amount of man-hours are spent in both investigations
and surveillances.
The Florida Motor Vehicle Theft Prevention Authority (FMVTPA) has
grant funds available for the purchase of electronic investigation
and surveillance equipment.
The police department proposes to purchase two items that would
greatly assist in their efforts. The first is a Fiber Optic Scope.
The equipment is used in the location of hidden Vehicle
Identification Numbers (VIN's) found on all automobiles. This device
will reduce an investigators time to locate hidden VIN numbers from
hours to minutes. The second item is a Trac Man 180. This equipment
is a mobile transmitter that is placed in decoy vehicles. It enables
investigators to track the vehicle without having to actually follow
it by traditional surveillance means.
CONCLUSION
This grant will allow the City of Miami Beach to receive $12,140.00
in grant funds to pay for the purchase of this much needed
investigation and surveillance equipment. There is no cash match
