2007-26685 ResoRESOLUTION NO. 2007-26685 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING A REVISION OF BILLING RATES FOR STAGEHANDS PROVIDING SERVICES AT THE COLONY THEATRE AND BYRON CARLYLE THEATER, TO GO INTO EFFECT FROM OCTOBER 17, 2007, THROUGH SEPTEMBER 30, 2008, AND FURTHER PROVIDING THE CITY MANAGER WITH THE ADMINISTRATIVE AUTHORITY TO ADJUST LABOR AND EQUIPMENT RATES FOR THE COLONY THEATRE AND BYRON CARLYLE THEATER IN THE FUTURE. WHEREAS, on July 28, 2004, the City Commission approved a rental and billing rates schedule for the Byron Carlyle Theater and the Colony Theatre; and WHEREAS, said rate schedule for stagehand labor at the two (2) venues has not been adjusted since such time; and WHEREAS, SMG and the City have negotiated an Agreement with the International Alliance of Theatrical and Stage Employees (IATSE) Local 500 which will bring a broader qualified work force available for service provision at the two venues without significant financial burden on the users of the venues; and WHEREAS, accordingly, the City Administration would request that the Mayor and City Commission approve the revised rates for labor and equipment at the Colony and Byron Carlyle Theaters, as set forth in Exhibit "A," attached hereto, and; WHEREAS, the City Manager further requests that the City Commission grant him the administrative authority to adjust said rates in the future. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission approve revisions of billing rates for stagehands providing services at the Colony Theatre and Byron Carlyle Theater, to go into effect from October 17, 2007, through September 30, 2008, and further providing the City Manager with the administrative authority to adjust labor and equipment rates for the Colony Theatre and Byron Carlyle Theater in the future. Issue: Shall the City Commission revise stagehand rates at the Colony and Byron Carlyle Theaters and allow the administration the ability to make future revisions? Lauderdale area from August 2004 to August 2007, which shows an increase of 15.14%. This resolution would allow for future revisions of any rates or fees associated with the theaters, excepting venue rental rate charges, through administrative action and would not require action b the Cit Commission. Gonzalez, City Manager , DATE: October 17, 2007 SUBJECT: A RESOLUTION APPROVING A REVISION OF BILLING RATES FOR STAGEHANDS PROVIDING SERVICES AT THE COLONY THEATRE AND BYRON CARLYLE THEATER TO GO INTO EFFECT OCTOBER 17, 2007 THROUGH SEPTEMBER 30, 2008, AND FURTHER PROVIDING FOR ADMINISTRATIVE AUTHORITY FOR FUTURE LABOR AND EQUIPMENT RATE REVISIONS FOR THE COLONY THEATRE AND BYRON CARLYLE THEATER . ADMINISTRATION RECOMMENDATION The Administration recommends that the City Commission approve the proposed resolution. BACKGROUND On July 28, 2004, the Mayor and City Commission adopted Resolution No. 2004-25646 establishing rental rates and other related activities for the Colony Theatre, the Byron Carlyle Theater, and the Acorn Theater. These facilities have been booked and marketed by the City Tourism and Cultural Development (TCD) Department, and operational and business activities support is provided by SMG through amendments of its Management Agreement with the City for the Miami Beach Convention Center (and formerly the Jackie Gleason Theater). Since the opening of the Byron Carlyle in the fall of 2004, and the opening of the Colony Theater in January 2006, there have been no revisions to the rate schedules for other related activities, to include front of house charges, stagehand labor rates, or other labor and equipment rates for users of the venues. On September 14, 2006, SMG was notified in writing of a Request for Recognition by the International Alliance of Theatrical Stage Employees, et al., (IATSE) Local 500 for the stagehand labor at the Colony and Byron Carlyle Theaters. As SMG has been a signatory to an Agreement for stagehand, production and general staff labor at the Miami Beach Convention Center and Jackie Gleason Theater since 1991, it entered into negotiations with IATSE Local 500 for representation of the workers at the two small theaters. With the assistance of the City's TCD Department, it has negotiated what it feels to be a fair agreement that will allow for a broader pool of qualified labor to provide services at the venue, provide an opportunity for that casual labor at the venue to access benefits from the union offerings not available with their part-time status with SMG, while still providing acost- effective production labor solution to the users of the venue. Lauderdale area from August 2004 to August 2007, which shows an increase of 15.14%. It should be noted that, at the current time, there is no contemplation of adjustment of any of the venue rental rates for the theaters or for any of the other fees or charges as set forth. However, this resolution would allow for future revisions of any rates or fees associated with the theaters, excepting venue rental rate charges, through administrative action and would not require action by the City Commission. This policy is in keeping with the policy in place for the City's largest rental venue, the Miami Beach Convention Center and formerly at the Jackie Gleason Theater. It should also be noted that since the inception of the new discount rental rates in July, the Colony Theatre and Byron-Carlyle Theater have received many inquiries and a number of productions have booked the venues. The following is an example of the bookings: Byron Carlyle Mid-Week Film Discount rate • Miami Gay and Lesbian Film Festival: This organization has presented two monthly screenings on the last Wednesday of each month, and Intend to continue on a monthly basis. Summer Discount Rates • Me Basta Produccion: Extended their production of Descarado for two weekends presenting four shows Theater Repertory Rates • Dramarama: This Spanish/English Theater Company has proposed to be the repertory theater company of the Byron Carlyle Theater, presenting three weeks of shows (four shows a week) in the Winter of 2008, as well as Fall 2008, Winter 2009 and Spring 2009. Page 3 of 3 Colony/Byron Labor Rates Week Long Guaranteed Six Show Run Rental • Playground Theater: Due to unforeseen delays in the renovation of their home at the Miami Shores Theater, Playground Theater may take advantage of our new discount rate and move their 18 shows to the Byron for three weeks in November. Colony Theatre Mid Week Film Discount rate: • 48 Hour Film Festival (two Screenings) • Generation Engage (one Screening) • Miami Beach Film Society (two Screenings) • Teri Hines and Associates (one Screening) Summer Discount Rates • Beyond The Silence (music concert) • 48 Hour Film Festival (two Screenings) Mid Week (non-film) Discount Rates: • Animated Objects Physical Theater (additional Wednesday Load In) • Miami Contemporary Dance (additional Wednesday Load In) FISCAL IMPACT As the current labor rate schedule has been incorporated into the Lease Agreements for approximately twenty-three future events over the next 12 months with no provision for escalation, we anticipate that the revenue collected will trail the expenses incurred for these services by approximately $2000. This will be more than offset by proposed organizational revisions brought about that will reduce full time staff. It should be noted that there would be no further anticipated fiscal impact to the City, as this is a reimbursable item charged to users of the venues.
