OF MIAMI BEACH, APPROVING THE 1997 LEGISLATIVE AGENDA TC
BE PRESENTED TO THE CITY'S STATE REPRESENTATIVES FOB
THEIR CONSIDERATION DURING THE 1997 LEGISLATIVE SESSION.
WHEREAS, As part of the City of Miami Beach legislative agenda,
the City Administration has prepared a list of concerns an I
legislative issues of the various departments of the City; and
WHEREAS, the City Administration has presented the legislat:.v ~
priorities to different community and business groups of the C:,_tl
for review and comment; and,
WHEREAS, the City Administration has met with the Cit~" 3
Representatives in the Florida State House of Representatives Clni
the City's Legislative consultants.

SUBJECT: A RESOLUT THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING THE 1997
LEGISLATIVE AGENDA TO BE PRESENTED TO THE CITY'S STATE
REPRESENTATIVES FOR THEIR CONSIDERATION DURING THE 1997
LEGISLA TIVE SESSION.
ADMINISTRATION RECOMMENDATION:
To adopt the resolution
BACKGROUND:
At the Commission Meeting on January 8, 1997, the City Commission was provided with a list of
legislative priorities prepared with the input of various City Departments, the Office of the Ma) or
and City Commission, the Miami Beach Chamber of Commerce and the Miami Beach Ho':el
Association. In accordance with the recommendation of the Administration, the City Commissi,)n
ranked those priorities in order of importance to the City which needed to be addressed during the
1997 Legislative Session. The City Commission subsequently directed the Administration to re-
structure the list of priorities accordingly, bring back additional information on two proposals ald
to reject one proposal. The City Attorney was also asked to work with the Administration to
strengthen language regarding the undergrounding of utilities.
The City Commission ranked the following Priority Issues in order of importance:
1. Amendments to the Bert J. Harris Act
2. Undergrounding of utilities
3. Beach renourishment
4. Historic preservation issues
5. Code enforcement liens

Priorities which were deferred by the Commission, pending further information and discussion to
occur prior to this Commission meeting included:
1. Eviction of hotel guests occupying transient premises
2. Exemption of all real property used by municipal government from property taxes
The one item which was rejected from the list concerned the increasing of construction costs of
qualifying project from $500,000 to $1,000,000, for the acquisition of professional architectUlal,
engineering, landscape architectural, or land surveying services.
ANALYSIS
The Administration has prepared a revised list of legislative priorities, clearly reflecting the top
priorities recommended by the City Commission. The balance of the priorities from the previous 1: st,
with the exception the one deleted priority, are not listed in any particular order, other than by area
of concern.
Further explanations concerning two of the priorities (items' 1 and 6), as well as one of the defened
items pertaining to the exemption of real property used by municipal government from propeiy
taxes (under un-ranked priorities), are provided in the attached memorandums from the Office of
Management and Budget and the Legal Department.
The priorities were again reviewed with the Miami Beach Chamber of Commerce Government
Affairs Committee, and the list which they have endorsed is attached. The Chamber's list v'as
endorsed by the full Board of Governors at their meeting on January 14, 1997. It should be noted 1:1 1at
they do not concur with some of the City's priorities.
CONCLUSION
The Administration recommends that the City Commission review and approve the revi~,ed
legislative package, to enable the Administration to present it first to the Dade County Delegation
at their 1997 meeting and to pursue its full implementation with our Florida State Legislators fOI
the 1997 Legislative Session.
