SUBJECT: Normandy Shores Golf Course Pesticide Application
The purpose of this LTC is to provide the Mayor and City Commission with an update on the
results of a Florida Department of Agriculture and Consumer Services investigation that was
initiated as a result of an allegation of pesticide exposure, by a Normandy Shores
neighborhood resident, during the on-going construction of the Normandy Shores Golf
Course (NSGC).
Following an Invitation-to-Bid (ITB) and contractor evaluation and selection process,
construction of the NSGC was awarded to the top-ranked firm of QGS Development Inc., a
contractor with extensive golf course construction experience. A construction notice to
proceed was issued to QGS on May 17, 2007 and construction of the NSGC proceeded.
The contractor's scope of work included: the eradication of existing turf using herbicide
applications as defined on the architect's turf eradication plan; removal of invasive tree and
shrub vegetation identified on the tree removal plan; removal of existing golf cart paths and
installation of a new cart path; renovation of 18 tee complexes and practice range tee;
renovation of 19 greens, including practice putting green; installation of various golf course
drainage systems, including drainage wells and enlargement of lake areas for storage;
installation of a new irrigation pump station, including pump house structure, and irrigation
system; and sprigging of Paspalum grass for all areas where existing turf was eradicated.
The investigation by the Florida Department of Agriculture was initiated on August 1, 2007
and the final report received by the Capital Improvement Projects Office the week of
December 2, 2007. Following a thorough investigation, including sampling and testing, the
final determination by the State agency was that no violations could be identified and the
case was closed. Attached for reference are copies of the letter from the Florida
Department of Agriculture's Environmental Manager, which is self-explanatory, and the
accompanying Pesticide Analysis Report.

On August 1, 20307, the Department of Agriculture and Consumer Services
{"Department"} initiated an investigation in response to a report from Ms. Rebecca Kohn, of an
alleged pesticide exposure. The report indicated that the Normandy Shores Ga#f Course had
applied a pesticide in which the active ingredient was believed to be 2, 4-D and that her family
was having ill health effects from the exposure. During this investigation, addt#onal a#legations
were received from Ms. Rebecca Kohn regarding pesticide activities at Normandy Shores Golf
Course. Ms. Kohn a1#eged that the applicators did not wear required personal protective
equipment, that landscape workers did na# wear personal protective equipment while working in
the treated areas, that the pesticide tank was improperly stored, that the boom height on the
application equipment was greater than specified by the lobe#, that there was no water available
for decontamination, that the firm operated pesticide application equipment in a dangerous
manner and that there was an overall decrease in wildlife activity in the immediate area. It was
a#so alleged that applicators used the pesticide paraquat and that some of the product had
sp##led by a trailer across the street from a children's playground leaving a blue residue.
During the investigation, the Department documented the use of the following pesticides:

The pepartment also collected twenty-one physical samples, seventeen samples from
the Kohn's property and four samples from Normandy Shores Golf Coarse. The enclosed
Pesticide Analysis Reports regarding the samples from the Kohn's property indicate that no
pesticides were detected. However, two of the samples taken from the Nom~iandy Shores Golf
Course indicate the presence of glyphosate and arninomethyl phosphoric acid, the active
ingredients in Nu#arm Credit Systemic E~ctra Herbicic and Roundup Pro Herbicide. It was
detemained that the area in which the positive samples were collected was treated by Mr.
Maurice S. Greenwood, Fame Manager and licensed applicator with Quality Turf, L.C., with
Nufarm Credit Systemic Extra Herbicide, Roundup Pro Herbicide and Fusilade Il Turf and
{lmamental Herbicide in preparation for the construction of a golf cart garage. Therefore, the
allegation of pesticide drift could not be c.~onfirmed.
®uring the investigation, Mr. Greenwood indicated that some blue marker dye was
spilled near the trailers, however, no pesticides were spilled. It was noted Chart Quality TurF, L.C.
does not use any products containing paraquat and the analysis results of the eight vegetation
samples d9d nOt indicate the presence of paraqua#. In addition, we wefe unable to Obtair4
medical records regarding the ill health effects suffered by members of the Kohn family that
would indicate a direct causal effect from pesticide e sure.
After a complete review of the case file regarding this investigation, no violations were
identified and the cause cif the Kohn family's ill health effects was inconclusive. Enctosed, per
