96-21969 RESO RESOLUTION NO. 96-21969 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A FIRST AMENDMENT TO THE CONTRACT BETWEEN THE CITY AND THE JOINT VENTURE OF LAW ENFORCEMENT PSYCHOLOGICAL AND COUNSELING ASSOCIATES, INC. AND FORENSIC PSYCHIATRIC AND PSYCHOLOGICAL ASSOCIATES OF FLORIDA; SAID AMENDMENT EXTENDING THE CONTRACT UNTIL MAY 5, 1997. Whereas, the City wishes to continue to evaluate the psychological suitability of applicants for employment in specific job classifications within the City to provide psychological services for employees; and Whereas, in 1992, the City, through the competitive bidding process, received only two (2) proposal responses and two (2) "No Bid" responses; and Whereas, the proposal selection committee unanimously recommended the Joint Venture of Law Enforcement Psychological and Counseling Associates, Inc. and Forensic Psychiatric and Psychological Associates of Florida based upon responsiveness, qualifications, experience in psychological services and in public safety and reputation; and Whereas, on May 6, authorized the award of a Enforcement Psychological Forensic Psychiatric and (Contract); and 1992, the Mayor and City Commission contract to the Joint Venture of Law and Counseling Associates, Inc. and Psychological Associates of Florida Whereas, the original Contract was awarded for an initial two (2) year term with an option for a third, fourth, and fifth year, at the City's discretion; and Whereas, the Joint Venture of Law Enforcement Psychological and Counseling Associates, Inc. and Forensic Psychiatric and Psychological Associates of Florida has continued to perform these services since the Contract was awarded; and Page Two Whereas, the primary users of this Contract, the City's Fire and Police Departments, have been pleased with the quality of service and have requested that the Contract be extended; and Whereas, the Mayor and City Commission deem it to be in the best interest of the City to exercise the option to extend the Contract until May 5, 1997; and Whereas, funding for the extension of the available from the budgets of the Fire and Police respectively, and other affected departme~ts. Contract is Departments, NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby authorize the Mayor and City Clerk to execute the attached First Amendment to the Contract between the City and the Joint Venture of Law Enforcement Psychological and Counseling Associates, Inc. and Forensic Psychiatric and Psychological Associates of Florida; said Amendment extending the Contract through May 5, 1997. ADMINISTRATION RECOMMENDATION: It is recommended that the Mayor and City Commission authorize the First Amendment to the May 06, 1992, Contract with the Joint Venture of Law Enforcement Psychological and Counseling Associates, Inc., and Forensic Psychiatric and Psychological Associates of Florida, said amendment extending the Contract through May 05, 1997. COST OF CONTRACT AND FUNDING: $38,341.00 (Annual Estimate) Funds are available from Budget Accounts of various departments, such as Police and Fire Departments, subject to OMB approval. (This estimate is approximate only, and is based on expenditures during Fiscal Year 1994/95 of $10,965 by the Fire Department and $27,376 by the Police Department.) BACKGROUND: In 1992, the City of Miami Beach sought a psychological service provider to supply comprehensive pre-employment evaluations and employee counseling. Notice of Request for Proposals (RFP) Number 73-91/93 was issued on February 25, 1992. Twenty-four (24) specifications were mailed by the City. On March 19, 1992, the Purchasing Division opened two (2) proposal responses and two (2) "No Bid" responses. Proposal Responses were received from: International Assessment Systems, Inc. Joint Venture: Law Enforcement Psychological and Counseling Associates Inc. and Forensic Psychiatric and Psychological Associates of Florida "No Bid" Responses were received from: David Santisteban, Ph.D. Barbara R. Sherry, Ph.D. AGENDA ITEM c.'lE. 5-I-q~ DATE May 01,1996 Page - two - The City Manager appointed the following selection Committee to evaluate the proposals: The Fire Chief, the Chief of Police, the Acting Personnel Director, the Acting Assistant Personnel Director, and the Assistant Purchasing Agent, who was a non-voting chairman. The Selection Committee reviewed the proposals for responsiveness to the RFP, experience in the field, experience with similar clients, proposed methodology for conducting evaluations, and qualifications. The Selection Committee unanimously recommended that the Contract be awarded to the Joint Venture. On May 6, 1992, the Mayor and the City Commission authorized the award of the Contract to the Joint Venture of Law Enforcement Psychological and Counseling Associates, Inc., and Forensic Psychiatric and Psychological Associates of Florida to provide psychological services for applicants and employees. The original Contract was awarded for an initial two (2) year term with an option for a third, fourth, and fifth year at the City's discretion. The Joint Venture has continued to perform these services since the Contract was awarded. The amendment would carry the Contract through May 5, 1997. It is estimated that the annual cost of this Contract will be $38,341, with the majority of the applicants evaluated being potential police officers, firefighters, dispatchers, communications operators, and other civilian positions within the Police Department. The firm will continue to identify whether or not individuals are psychologically suited for each classification, through testing and clinical interviews. ANALYSIS: As indicated by the fact that there were only two (2) responses to the RFP, psychological screening of public safety applicants is a highly specialized field, requiring familiarity with all the subtleties, ramifications, and legal issues involved with this type of screening. The committee evaluated the proposals as follows: 1. The Joint Venture had over 50 years of experience in administering psychological services. 2. The Joint Venture had screened over 20,000 applicants in the last 15 years. 3. The Joint Venture listed 41 law enforcement agencies to which it supplied psychological screening and counseling services. 4. The Joint Venture was recognized as a leader in the field, as evidenced by its list of references, which includes every major Police agency in Dade County. 5. The Joint Venture employed four consultants with doctorate degrees, and had minority participation in its staff. 6. The Joint Venture voluntarily designed an early warning program for the Miami Beach Police Department to deal with excessive use of force. May 01,1996 page - three - CONCLUSION: After careful evaluation of both proposals, it was a unanimous decision to select the Joint Venture of Law Enforcement Psychological and Counseling Associates, Inc. and Forensic Psychiatric and Psychological Associates of Florida, based on their excellent qualifications, experience, reputation, and references. Since the Contract was awarded in 1992, the primary users, the Fire Chief and the Police Chief, have been very pleased with the quality of the services provided by the Joint Venture and have requested that this Contract be extended.
