2007-26713 ResoRESOLUTION NO. 2007-26713 A RESOLUTION APPROVING AND AUTHORIZING THE APPROPRIATION OF FUNDS FROM PARKING OPERATIONS FUND 480, IN THE AMOUNT OF $540,011, FOR ADDITIONAL WORK SCOPE AND ASSOCIATED FEES NECESSARY TO COMPLETE THE RECONSTRUCTION OF SURFACE PARKING LOT 5-C, LOCATED WEST OF THE FILLMORE MIAMI BEACH THEATER. WHEREAS, in order to alleviate the impact of the parking space reduction caused by the construction of the Multi-purpose Municipal Parking Facility (MMPF), the Administration targeted Surface Parking Lot 5C, directly east of City Hall and located at the northeast corner of 17th Street and Convention Center Drive, for afast-track redesign and reconstruction; and WHEREAS, with the approved new layout, the Lot's capacity was increased from 89 spaces to 160, with a net 80% gain of 71 spaces; and WHEREAS, on April 2nd, 2007 F&L Construction, Inc., under CIP's Job Order Contract (JOC) No. 151.OO.CIP.14-03/04, in the amount of $462,227, started the renovation of Surface Parking Lot 5-C; and WHEREAS, this project was fast-tracked in order to have it built during the Summer months, when parking demand is the lowest in the City; and WHEREAS, at the time that the JOC contract was signed, it was understood that additional work would have to be added to the project; and WHEREAS, the City required additional work not included in the JOC contract, including landscaping, a lighting system, a soil stabilization system, and a number of unforeseen conditions; and WHEREAS, the Administration proposes to execute the previously mentioned work through the same JOC contractor, F&L Construction, Inc.; and WHEREAS, funding, in the amount of $540,011, is available from Parking Operations Fund 480. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby authorize the appropriation of funds, from Parking Operations Fund 480, in the amount of $540,011, for additional work scope and associated fees necessary to complete the reconstruction of Surface Parking Lot 5-C, located west of The Fillmore Miami Beach Theater. Issue: Should the City Commission adopt the Resolution? item Summary~lrcecommenaation: In order to alleviate the impact of the parking space reduction caused by the construction of the Municipal Multi- purpose Parking Facility (MMPF) west of City Hall, the Administration targeted Surface Parking Lot 5C, located directly east of City Hall, at the northeast corner of 17`h Street and Convention Center Drive, for afast-track redesign and reconstruction during the summer months, when parking demand is the lowest in the City. The fast-track construction schedule for Lot 5C was carefully coordinated to take advantage of the window of opportunity that preceded the anticipated closing of the NWS West Lot (between Pennsylvania and Drexel Avenues) in the Fall of 2007, and the subsequent closure of the NWS East Lot (east of Drexel Avenue); the low-event season at The Fillmore Miami Beach and the Convention Center; and the temporary closure of Macy's for renovations. During the Macy's renovation period, the parking demand at 17th Street Parking Garage was also reduced, which facilitated the reconstruction of Lot 5C. On April 2nd, 2007, F&L Construction Inc., under CIP's Job Order Contract (JOC) No. 151.OO.CIP.14-03/04, in the amount of $462,227, started the reconstruction of Surface Parking Lot 5C. At the time, CIP was still in the process of finalizing the technical specifications and negotiating the cost of the lighting system, which was modified to match the streetscape lighting fixtures that will be included in the future City Center ROW improvement project. The landscape design was also being developed. In order to complete the project within the requested time frame, the contract was signed with the understanding that additional work scope would have to be added. This is one of the flexibilities afforded by the JOC system. This request for funds in the amount of $540,011 covers the cost of additional work scope and unforeseen conditions that include: 1) Additional work scope: a. Landscaping b. Installation of Poulsen lights (regulatory requirement) c. Increase in asphalt thickness to accommodate heavy load traffic access to The Fillmore . d. Increase of longitudinal and transverse slopes of paved areas to improve drainage. e. Additional sidewalks, fencing and irrigation resulting from layout modification to improve large truck access to The Fillmore loading area. 2) Unforeseen conditions.: a. Replacement of broken storm water drainage pipes. b. The street lights for Convention Center Drive were in the same Circuit with the parking lot and needed to be in an independent circuit. c. Placement of alayer of geo-textile fabric, as directed by the geotechnical engineers, after borings and rebounding indicated the presence of low bearing soil. d. Replacement and relocation of shallow-buried water service line to the 555 Building. 3) Soft costs -The Gordian Group fees for the JOC contract. ADMINISTRATION RECOMMENDATION Adopt the Resolution. FUNDING Funding in the amount of $540,011 to be appropriated from Parking Operations Fund 480. ANALYSIS On September 10, 2003, the Mayor and City Commission approved Resolution No. 2003- 25332 authorizing the execution of a Development Agreement between the City of Miami Beach and the New World Symphony (NWS) for the development of a portion of the surface parking lot, bounded by 17th Street to the north, North Lincoln Lane to the south, Washington Avenue to the east and Pennsylvania Avenue to the west, for construction of the NWS Campus Expansion Project, which includes an educational performance and Internet broadcast facility, a public parking garage, and certain other public streetscape improvements, including a park. In approving the execution of the Agreement, the Commission also directed that the Administration should proceed with developing a new Multi-Purpose Municipal Parking Facility (MMPF) on the site of the existing City Hall surface lot. The construction of the MMPF started in late December 2006, taking over the surface parking lot behind City Hall, which resulted in a net parking deficit of one hundred thirteen (113) spaces. Incoordination with the closing of the City Hall lot, the Administration directed the re-striping of the on-street parking spaces along the drop-off lane south of City Hall (17tH Street), in order to create designated parking for the Mayor and Commissioners, as well as additional ADA parking spaces on Convention Center Drive. In order to alleviate the impact of the parking space reduction caused by the construction of the MMPF, the Administration targeted Surface Parking Lot 5C, directly east of City Hall and City Commission Memorandum Surface Lot 5C Dec 12, 2007 Page 2 of 3 located at the northeast corner of 17th Street and Convention Center Drive, for afast-track redesign and reconstruction during the summer months, when parking demand is the lowest in the City. The increased parking capacity that would be gained with the renovation of Lot 5C in an accelerated schedule would alleviate the parking demand in the City Center neighborhood, as well as offer visitors to Lincoln Road an additional parking option once the NWS lots were closed for construction. This project has since been completed. With an inefficient eighty-nine (89) space parking layout, numerous surface irregularities, and drastic changes in elevation, Lot 5C was user-unfriendly and notADA compliant. Anew configuration, designed by the Capital Improvement Projects Office (CIP), was presented to the Administration and approved. This new layout increased the number of parking spaces to one hundred sixty (160), with a net increase of seventy-one (71) spaces. The more efficient parking arrangement accommodated 80% more spaces than the existing lot, reduced the lot's paved area, and increased the green area by 5,600 square feet. The fast-track construction schedule for Surface Parking Lot 5C was carefully coordinated to take advantage of the window of opportunity that preceded the anticipated closing of the NWS West Lot (between Pennsylvania and Drexel Avenues) in the Fall of 2007, and the subsequent closure of the NWS East Lot (east of Drexel Avenue); the low-event season at The Fillmore Miami Beach and the Convention Center; and the temporary closure of Macy's for renovations. During the Macy's renovation period, the parking demand at 17th Street Parking Garage was also reduced, which facilitated the reconstruction of Lot 5C. On April 2, 2007, F&L Construction Inc. commenced construction, under CIP's Job Order Contract (JOC) No. 151.OO.CIP.14-03/04, in the amountof $462,227. Given the urgencyto initiate construction as soon as possible, the construction notice to proceed was issued for a work scope that excluded lighting and landscaping. At the time, CIP was still in the process of finalizing the technical specifications and negotiating the cost of the Poulsen lighting system, which was modified to match the streetscape lighting fixtures that will be included in the future City Center ROW Improvement Project. In addition, the lighting levels had to be increased because the existing system, consisting of 20 cobra-type heads, did not meet current minimum foot-candle levels, as mandated by code. The landscape design was also being developed at the same time in a fast track mode to take advantage of the window of opportunity. In order to complete the project within the requested timeframe, the contract was signed with the understanding that additional work scope would have to be added. This is one of the flexibilities afforded by the JOC system. During the time the project was being developed the Public Works Department, in coordination with the CIP Office, performed a couple of excavations in the surface lot to explore the conditions of the sub-grade. Consequently, a layer of low bearing capacity material was encountered just four feet below the surface, which may have been one of the causes of the pavement surface's excessive settlement. CIP then proceeded to hire a soil consultant, Professional Service Industries, Inc. (PSI), to evaluate the soil conditions and complete the design of the lot. Once the results of the PSI study were received, their recommendations were implemented, including the installation of alayer of geo-textile fabric. Once the project started construction, the contractor dealt with unforeseen conditions such as existing clogged and /or collapsed storm drainage pipes which had to be replaced. The water line servicing the 555 Building was too shallow and had to be replaced and relocated to a depth that met code requirements. It was also found that the street lights at Convention Center Drive were connected to the same electrical circuit as the existing parking lot lights and the street lights had to be reconnected to a newly installed independent circuit. Cost savings to the City were achieved for the civil design of the lot, prepared by CIP in coordination with the Public Works Department,as well as for the landscape design, elaborated by the Parks and Recreation Department, by utilizing in-house professionals.
