A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING AND
APPROPRIATING THE FIRST AMENDMENT TO THE POLICE
CONFISCATION TRUST FUND BUDGET FOR FISCAL YEAR
2007/08 IN THE AMOUNT OF $73,890 TO BE FUNDED FROM THE
PROCEEDS OF STATE CONFISCATED FUNDS.
WHEREAS, Section 932.7055, Florida Statutes, addresses the purpose and procedures to
be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and
WHEREAS, the Chief of POlice of the City of Miami Beach has determined that the need for
appropriation and expenditures exist and the appropriation and expenditure of forfeiture funds is in
compliance with Section 932.7055, Florida Statutes, and the Guide to Equitable Sharing of Federally
Forfeited Property for Local Law Enforcement Agencies; and
Fund.
WHEREAS, funds in the amount of $73,890 are available in the Police Confiscation Trust

NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission for the City of
Miami Beach hereby adopt the First Amendment to the Fiscal Year 2007/08 Police Confiscation
Trust Fund Budget in the amount of $73,890, to be funded from the proceeds of State Confiscated
Funds as reflected in the attached Exhibit "A".

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
Florida Statute 932.7055 provides for expenditures of forfeiture funds for law enforcement
purposes.
The Miami Beach Chief of Police, Carlos Noriega, has reviewed and identified the need for
the appropriation and has established that the expenditures of forfeiture funds are in
compliance with Section 932.7055, Florida State Statutes, and the Guide to Equitable
Sharing of Federally Forfeited Property for Local Law Enforcement Agencies. These
forfeiture funds have been deposited in the Police Confiscation Trust Fund. The City has
complied with all statutory procedures involved in the transaction of these funds.
CONCLUSION
The Administration recommends that the Mayor and City Commission adopt the First
Amendment to the operating budget for the Police Confiscation Trust Fund for Fiscal Year
2007/08 in the amount of $73,890, to provide for the expenditures listed in Exhibit "A"

ACCREDITATION for operating expenses, travel and initiatives related $ 5,000
to both State and National re-accreditation.
AYUDA- Contribution $ 10,000
The Family Empowerment Program is designed to help first time misdemeanor
offenders 9-18 years of age. We teach youth and families, in apsycho-educational
group setting, how to enhance their communication skills, positively resolve
conflicts, anger management skills, and learn self-esteem enhancement skills,
among others. We serve families in the Miami Beach, Hialeah, and Overtown areas.
DRUG -FREE YOUTH IN TOWN. DFYIT. Contribution to Community $ 5,000
Drug Free Programs.
TWENTY (20), ADDITIONAL TASERS AND LESS THAN LETHAL $ 22,000
MUNITIONS for sworn officers.

GRANT MATCHES:
BULLETPROOF VEST PARTNERSHIP GRANT, Year 2008 $ 10,000
These funds represent additional grant match funds required due to projected,
increased recruitment initiatives throughout Fiscal Year 2007/08.
BYRNE GRANT: Electronic ticketing initiatives $ 4,726
Remaining Match Funds (See also Resolution No. 2006-26264)
for the BYRNE Grant.
VOCA (Domestic Violence) $ 17,164
Includes the portion of the employees salary which is not funded
by the grant, and projected COLA and merit increases.
