A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, FOLLOWING A DULY NOTICED
PUBLIC HEARING TO HEAR PUBLIC COMMENT ON SAME, AND
HAVING CONSIDERED THE CITY ADMINISTRATION'S
RECOMMENDATION AND THE CRITERIA FOR GRANTING
REVOCABLE PERMITS PURSUANT TO SECTION 82-94 OF THE
MIAMI BEACH CITY CODE, GRANTING AN AFTER-THE-FACT
REVOCABLE PERMIT TO STERLING BUILDING, INC., AS THE
APPLICANT AND OWNER OF THE PROPERTY LOCATED AT 901
LINCOLN ROAD, MIAMI BEACH, FLORIDA, FOR TWO (2)
ARCHITECTURAL ENTRANCE TOWER ENCROACHMENTS, EQUAL
TO A TOTAL AREA OF 3.56 SQ. FT, ON THE CITY-OWNED RIGHT-OF-
WAY ON LINCOLN ROAD MALL, ADJACENT TO SAID PROPERTY.
WHEREAS, the Sterling Building, Inc. a Florida corporation (Applicant), owns
the property located at 901 Lincoln Road, legally described as Lots 5 and 6, Block 37 of
Commercial Subdivision, as recorded in Plat Book 6, Page 5 of the Public Records of
Miami-Dade County, Florida (the Property); and
WHEREAS, on June 13, 2000, the Historic Preservation Board (HPB) granted a
Certificate of Appropriateness (HPB File No. 1140), for the demolition and alteration of
the east portion of the Property (which currently houses Victoria Secret's as the tenant),
which was included with, and made part of, the final building permit plans; and
WHEREAS, a building permit for this portion of the Property was issued, and the
partial restoration was substantially completed in 2001; and
WHEREAS, as a condition of the HPB's order, the Applicant submitted a master
plan to restore the west end of the Property, which was included with and made part of
the final building permit plans for the aforestated renovation; and
WHEREAS, this master plan was required to be effectuated when the current
tenant's lease of the western portion or the Property (Pacific Time) expired; and
WHEREAS, now that the aforestated tenant has vacated the western portion of
the Property, the entrance is required to be replaced with a storefront, and the western
tower restored to match the original conditions; and
WHEREAS, the Applicant is proposing to substantially reconstruct the existing
facade tower entry with stone veneer that requires the use of an approximately 3.56 sq.
ft. of the public right-of-way on Lincoln Road Mall; and
WHEREAS, in order to construct upon said public right-of-way, the Applicant is
requesting that the City grant it a Revocable Permit for use of the aforestated 3.56 sq. ft.
on Lincoln Road Mall; and
WHEREAS, in accordance with the City's criteria/standards for granting of said
Revocable Permit, the Mayor and City Commission are required to set a public hearing
to consider the aforestated request; accordingly, at its regular meeting on October 17,
2007, the Mayor and City Commission adopted Resolution No. 2007-26681, setting the
public hearing for December 12, 2007; and
WHEREAS, a duly noticed public hearing to hear comment on Applicant's
request for the subject Revocable Permit was held on December 12, 2007; and
WHEREAS, the Mayor and City Commission has also considered the
Administration's analysis and recommendation relative to the Revocable Permit
application, based upon the factors set forth in Section 82-94 of the City Code.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission, following a duly noticed public hearing to hear public comment on same,
and having considered the City Administration's recommendation and the criteria for
granting Revocable Permits, pursuant to Section 82-94 of the Miami Beach City Code,
hereby grant an After-the-Fact Revocable Permit in favor of Sterling Building, Inc., as
the Applicant and owner of the Property located at 901 Lincoln Road, Miami Beach,
Florida, for two (2) architectural entrance tower encroachments, equal to a total area of
3.56 sq. ft, on the City-owned right-of-way on Lincoln Road Mall, adjacent to said
Property.

PUBLIC HEARING.
Pursuant to City Code, Chapter 82, Article III, Division 2, upon receipt of a Revocable Permit application,
the City Commission shall schedule a public hearing to consider the granting of a revocable permit.
The Sterling Building, Inc, owner of the property located at 901-915 Lincoln Road has completed an
application for an after-the-fact revocable permit to occupy an approximately 3.56 sq.ft of City right ofway
for two (2) entrance towers encroachment adjacent to the property located at 901 Lincoln Road (Victoria's
Secret) Miami Beach, Florida.
Based on permit records, the partial restoration project at 901 Lincoln Road was substantially completed in
2001.The applicants purchased the property in 1999.
The Administration recommends approving the resolution.

ADMINISTRATION RECOMMENDATION
The Administration recommends approving the resolution.
BACKGROUND
The structure located at 901 Lincoln Road is designated as part of the Miami Beach Historic
Properties Database, the structure is located within the Flamingo Park Local Historic District and
the National Register Architectural District.
Originally known as the Mead Building, the subject structure was designed by architect Russell T.
Pancoast and constructed by the Mead Brothers Construction Company in 1928. The Mead
Brothers built commercial buildings on Lincoln Road, Collins Avenue, and North Bay Road. In
addition to the subject structure, there were several other Mead Buildings on Lincoln Road, such
as 1000 Lincoln Road, which was also designed by Pancoast. There were at least 20 projects,
most of which were homes, designed by Pancoast for the Mead Brothers.
The Mead Building at 901 Lincoln Road was originally designed in the Mediterranean Revival
style of architecture, which was popular during the first development period of Miami Beach in the
1920's. The one-story commercial structure featured two (2) entrance tower portals with gothic
arched openings and pyramidal roofs with clay barrel tiles and carved wooden brackets. The
facade of the building sat on a stone base, and it was articulated by a Corinthian pilastrade
framing large windows with leaded glass transoms. The eastern portion of the structure was
occupied by the prominent fashion house, Bonwit Teller, from 1937 until 1947.
The west tower of the Mead Building was demolished sometime between 1937 and 1945. In
1955, the existing south and east elevations were remodeled by the original architect, Pancoast,
and cone-story addition with a mezzanine was added to the north side of the building. The new
facade design was modern with streamlined stucco surfaces, brick and the details, smaller
storefront windows, and angular recessed vestibules. The original curved corner was modified to
cantilever over the new angular entrance. The eastern portion of the Mead Building was
occupied by the Miami City Ballet from 1986 until 2000, when it moved to its new location facing
Collins Park.
On June 13, 2000, the Historic Preservation Board (HPB) granted a Certificate of
Appropriateness (HPB File No. 1140) for the partial demolition and alteration of the east portion
of the subject structure in order to renovate and restore a portion of the original 1928 facade of
the Mead Building, and accommodate a new retail use (Victoria's Secrets). A Building Permitfor
the same project was issued and the partial restoration project was substantially completed in
2001. Although both Victoria Secret and 901 Lincoln Road improvements are being done in
separate time frames, the HPB order sought to recreate the original facade within the same June
13th, 2007 HPB order. The Applicant's request for a revocable permit for two (2) architectural
entrance tower encroachments within the City's right of way (Lincoln Road Mall) equating a total
area of 3.56 sq. ft. will satisfy the historic preservation board final order to restore the vacant retail
(Pacific Time) facade to match the original conditions previously approved on June 13, 2000 in
addition to bring the proposed entrance towers with arch openings into alignment with the
completed (Victoria's Secrets) entrance towers. The new facade will match the Historic District
conditions as required of which this structure resides within. The Owner has prepared a Hold
Harmless Affidavit releasing the City from any liability in the event the City Commission grants a
denial.
ANALYSIS
The application and Letter of Intent dated August 15, 2007 (Attachment 1), was submitted by Mr.
Gerald Schwartz, of Beloff & Schwartz the law firm retained by the Sterling Building Inc for
representation. The portion of the right of way for which the Revocable Permit is being requested
as depicted in the legal description of a sketched prepared by the applicant's surveyor, the
encroachments encompasses a total area of 3.56 Square Feet. (Attachment 2).
The Application for the Revocable Permit has been reviewed by City Administration pursuant to
Section 82.94 of the City Code and was discussed at a meeting held between the City Staff and
the owner's legal representatives.
On August 3, 2007, pursuant to Section 82-38 of the City Code, the Planning Department
prepared an analysis from a planning perspective of the property in question, so that the City
Commission and Public be fully apprised on all conditions relating to the proposed impacts to the
Right-of-Way (ROW) (Attachment 3).
The administration's conclusions following the request of the Revocable Permit Application are as
follows:
1) That the Applicant's need is substantially satisfied.
Satisfied. The Applicant is in substantial need of a revocable permit to comply with the
requirements of the HPB Final Order. (HPB File No. 1140)
2) That the Applicant holds title to an abutting property.
Satisfied. The Applicant is the Fee Simple Owner of the property located at 901-915
Lincoln Road adjacent to Lincoln Road Mall.
3) That the proposed improvements comply with Applicable codes, ordinances, regulations,
and neighborhoods plans and laws.
Satisfied. The Applicant's architect has submitted plans which fully comply with the HPB
Certificate of Appropriateness (June 13, 2000) to match the completed entrance towers at
Victoria's Secret. Therefore this structure new facade will match the Historic District
requirements and conditions of the final order .
4) That the grant of such application will have no adverse effect on governmental/utility
easements and uses of the property.
Satisfied. The granting of the Revocable Permit will have no adverse effect on utility
easements; as no such easement exist and granting such uses of the City ROW will
afford the Applicant the opportunity to restore the property to its original fagade satisfying
the HPB Final Order.
5) Alternatively:
A) That an unnecessary hardship exists that deprives the applicant of a reasonable use
of the land, structure or building for which the Revocable Permit is sought arising out of
special circumstances and conditions that exist and were not self-created and are
peculiar to the land, structures or buildings in the same zoning district and the grant of the
application is the minimum that will allow reasonable use of the land, structures or
building.
Satisfied. City staff recognize that the intended use of the City's ROW is in noway self-
created and that the special circumstances such as an unnecessary hardship do not exist
and that granting the After-the-Fact Revocable Permit will comply with the City required
restoration of this historic structure.
B) That the granting of the Revocable Permit will enhance the neighborhood and/or
community by such amenities as, for example, enhanced landscaping, improved
drainage, improved lighting and improved security.
Satisfied. Granting the Revocable Permit will enhance the building facade and is
consistent with the requirements of the HPB in terms of the renovation and preservation
of the existing structure within the assigned Historic District
6) That granting the Revocable Permit requested will not confer on the applicant any special
privilege that is- denied to other owner of land, structures or buildings subject to similar
conditions.
Satisfied. Granting this permit will foster and serve the City's public purpose in retaining,
preserving and restoring this historic structure.
7) That granting the Revocable Permit will be in harmony with the general intent and
purpose of Article III of the City Code, and that such revocable permit will not be injurious
to surrounding properties, the neighborhood, or otherwise detrimental to the public
welfare.
Satisfied. Granting a Revocable Permit will maintain the aesthetic harmony established
by the City's HPB within the Flamingo Park Local Historic District.
CONCLUSION
The Administration's analysis above shows that the 7 criteria's are satisfied and hence the
Administration recommends the granting of an After-the-Fact Revocable Permit for the use of
3.56 square feet of City ROW within (Lincoln Road Mall) at 915 Lincoln Road (Pacific Time) to
construct two (2) architectural entrance tower.
The Administration recommends that the City Commission adopt the attached Resolution.

Dear Mr. Beckmann:
This office represents The Sterling Building Inc., the owner of the above referenced property (the
"Applicant"). The Property consists of two store fronts, one presently occupied by Victoria's Secret
and the other formally occupied by the Pacific Time restaurant.
Several years ago, with the approval of the City, the facade of the Victoria's Secret building was
remodeled, renovated and restored to its original design. In doing so, a small portion of the
entranceway of the building was extended approximately four (4") inches into the Lincoln Road Mall
right-of--way.
Now that Pacific Time has vacated the adjoining building that it occupied, the owner of the property is
required by the City, pursuant to a Declaration of Restrictions, to restore that building to its original
facade on Lincoln Road. To do so will require the same approximate four (4") encroachment at the
entrance.
To obtain a Revocable Permit as required to accomplish our objective, we hereby confirm the
following as required by Sec. 82-94 of Article III, Division 2 of the Code of the City of Miami Beach
we hereby confirm that:
(1) "The Applicant is in substantial need of the Revocable Permit to comply with the
requirements•of the Declaration of Restrictions.
(2) The Applicant holds title to the abutting property.
(3) I'he proposed improvements will comply with applicable codes, ordinances, regulations,
neighborhood plans and laws.

(4) The grant of the application for the Revocable Permit will have no adverse effect on

The City of Miami Beach has a substantial interest in maintaining and restoring historic buildings to
their original design and facade. It is the intention of our client to see that is accomplished for these
two properties. To accomplish the historic restoration, the City must grant the revocable permit for
the approximate four (4") inches at the entrance to the buildings.

RE: 901 Lincoln Road
Pursuant to Section 82-38 of the City Code, pertaining to the sale or lease of public property, this
memorandum will serve as an analysis of the above noted property. The applicant is proposing a
modest encroachment into the north side of the Lincoln Road right-of-way, in order to accommodate
the reintroduction of an original architectural tower element on the south elevation of the subject
structure. The reintroduction of this tower element is a significant component in the rehabilitation
and restoration of the subject structure, which is designated contributing and is located in the
Flamingo Park Local Historic District and the National Register Architectural District.
Section 82-38 of the Code of the City of Miami Beach requires that any proposed sale or lease of
city-owned land be analyzed from a planning perspective in order that the City Commission and the
public are fully apprised of all conditions relating to the proposed sale or lease. What follows,
herein, are each of the eight criteria in Section 82-38 of the Code:
1. Whether or not the proposed use is in keeping with City goals and objectives and
conforms to the City Comprehensive Plan.

Historic District and the National Register Architectural District; the existing building on site is
designated contributing in the Miami Beach Historic Properties Database. The Future Land
Use Map of the City's Comprehensive Plan designates the property as CD-3, Commercial
High Intensity.
The proposed reintroduction of the original tower element on the south elevation of the
subject structure would conform to the land use designation contained in the
Comprehensive Plan.
2. The impact on adjacent property, including the potential positive or negative impacts
such as diminution of open space, increased traffic, noise level orenhanced property
values, improved development patterns and provision of necessary services. Based
on the proposed use of the property, the City shall determine the potential impact of
the project on City utilities and other infrastructure needs and the magnitude of costs
associated with needed infrastructure improvements. Should it become apparent that

further evaluation of traffic impact is needed, the proponent shall be responsible for
obtaining a traffic impact analysis from a reputable traffic engineer.
The subject property contains existing retail space, and the proposed reintroduction of the
original tower element on the south elevation of the existing structure would not have any
negative impact on the surrounding area.
3. A determination as to whether or not the proposed use is in keeping with a public
purpose and community needs, such as expanding the City's revenue base, reducing
City costs, creating jobs, creating a significant revenue stream and improving the
community's overall quality of life.
The existing building is designated contributing and located within a local historic district.
The reintroduction of the original tower element on the south elevation of the subject
structure will maintain the building's purpose in an active manner, and this will foster and
serve the City's public purpose in retaining, preserving and restoring this important historic
structure.
4. Determination as to whether or not the development is in keeping with the
surrounding neighborhood, will block views, or create other environmental
intrusions, and evaluation of the design and aesthetic considerations of the project.
The proposal to reintroduce the original tower element on the south elevation of the subject
structure will not negatively impact the surrounding area, and is consistent with the
requirements of the historic preservation board in terms of the renovation and preservation
of the existing structure.
5. The impact on adjacent properties, whether or not there is adequate parking, street,
and infrastructure needs.
There is no negative impact on adjacent properties. While parking is a problem throughout
the City, the proposed reintroduction of the original tower element on the south elevation will
not increase the need for parking nor require additional infrastructure.
6. A determination as to whether or not alternatives are available for the proposed
disposition, including assembly of adjacent properties, and whether the project could
be accomplished under aprivate-ownership assembly.
There are no alternatives for the location of the original tower element on the south elevation
because the structure exists in its current location and cannot be moved.
7. Within the constraints of public objectives, the department should examine financial
issues such as job generation, providing housing opportunities, and the return to the
City for its disposition of property.

The proposed reintroduction the original tower element on the south elevation of the subject
structure, in conjunction with the rehabilitation and restoration of the existing structure, may
moderately increase the job base of the City. No housing opportunities are created under
the current facility.
8. Such other items as the Planning Department may deem appropriate in analysis of the
proposed disposition.
Planning Staff has not identified any further items.
