2007-26731 ResoRESOLUTION NO. 2007-26731 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, OPTING NOT TO EXERCISE THE RENEWAL TERM UNDER THE CITY'S AGREEMENT WITH STANDARD PARKING, INC., DATED DECEMBER 8, 2004, FOR PARKING COMPANIES/OPERATORS TO SUPPLY PARKING CASHIERS/ATTENDANTS AND SUPERVISORS FOR THE CITY OF MIAMI BEACH PARKING SYSTEM; AND, IN THE ALTERNATIVE, AUTHORIZING THE ADMINISTRATION TO ISSUE A NEW REQUEST FOR PROPOSALS (RFP) FOR PARKING CASHIERS/ATTENDANTS AND SUPERVISORS FOR THE CITY'S PARKING SYSTEM; AND FURTHER AUTHORIZING A MONTH TO MONTH EXTENSION OF THE CITY'S CURRENT CONTRACT WITH STANDARD PARKING, INC., FOLLOWING EXPIRATION OF THE INITIAL TERM OF THE AGREEMENT ON JANUARY 3, 2008, UPON THE SAME TERMS AND CONDITIONS, UNTIL SUCH TIME AS THE RFP PROCESS HAS CONCLUDED AND THE MAYOR AND CITY COMMISSION HAVE APPROVED AND AUTHORIZED THE EXECUTION OF A NEW AGREEMENT FOR PROVISION OF THE AFORESTATED SERVICES; PROVIDED FURTHER THAT THE MAYOR AND CITY COMMISSIONERS AND THEIR RESPECTIVE STAFF, AND THE CITY'S ADMINISTRATIVE STAFF INCLUDING, BUT NOT LIMITED TO, THE CITY MANAGER AND HIS STAFF, VOLUNTARILY AGREE TO IMPOSE AND BE BOUND BY THE PROVISIONS OF THE CITY'S "CONE OF SILENCE" ORDINANCE, AS CODIFIED IN SECTION 2-486 OF THE CITY CODE, WITH SAID "CONE" TO BE EFFECTIVE AS OF THE DATE OF ADOPTION OF THIS RESOLUTION, AND TERMINATING AT THE TIME THE CITY MANAGER MAKES HIS WRITTEN RECOMMENDATION AS TO THE SELECTION OF THE AFORESTATED RFP TO THE CITY COMMISSION, AND SAID RFP IS AWARDED. WHEREAS, on January 14, 2004, the Mayor and City Commission approved the issuance of Request for Proposals No. 18-03/04 for Parking Cashiers/Attendants and Supervisors for the City's Parking System; and WHEREAS, on December 8, 2004, the Mayor and City Commission approved an award to Standard Parking, Inc., and authorized execution of a new Agreement for an initial three year term, commencing on January 4, 2005, and expiring on January 3, 2008, with atwo-year renewable option; and WHEREAS, at its regular meeting on December 12, 2007, the Mayor and City Commission determined not to exercise the two (2) year renewal option provided under the current Agreement with Standard; and WHEREAS, in the alternative, the Mayor and City Commission would hereby authorize the City Administration to issue a new Request for Proposals (RFP) for parking companies/operators to supply parking cashiers/attendants and supervisors for the City of Miami Beach Parking System; and WHEREAS, as the City's Agreement with Standard Parking, Inc. will effectively expire on January 3, 2008, and following discussions with Standard Parking, Inc., Standard has agreed to continue to provide the services under the current Agreement, under the same terms and conditions, on a month to month basis; said extension commencing on January 4, 2008, and ending no later than the date on which the City has executed a new contract (pursuant to the award of the new RFP) for the provision of the aforestated services; and WHEREAS, in conjunction with the issuance of the new RFP, the Mayor and City Commissioners and their respective staff, and the City's Administrative staff including, but not limited to, the City Manager and his staff, voluntarily agree to impose and be bound by the provisions of the City's "Cone of Silence" Ordinance, as codified in Section 2-486 of the City Code, with said "Cone" to be effective as of the date of adoption of this Resolution, and terminating at the time the City Manager makes his written recommendation as to the selection of the aforestated RFP to the City Commission, and said RFP is awarded. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby elect not to exercise the renewal term under the City's Agreement with Standard Parking, Inc., dated December 8, 2004, for parking companies/operators to supply parking cashiers/attendants and supervisors for the City of Miami Beach Parking System; and, in the alternative, authorize the Administration to issue a new Request for Proposals (RFP) for parking cashiers/attendants and supervisors for the City's Parking System; and further authorize a month to month extension of the City's current contract with Standard Parking, Inc., following expiration of the initial term of the Agreement on January 3, 2008, upon the same terms and conditions, until such time as the RFP process has concluded and the Mayor and City Commission have approved and authorized the execution of a new Agreement for provision of the aforestated services; provided further that the Mayor and City Commissioners and their respective staff, and the City's Administrative staff including, but not limited to, the City Manager and his staff, voluntarily agree to impose and be bound by the provisions of the City's "Cone of Silence" Ordinance, as codified in Section 2-486 of the City Code, with said "Cone" to be effective as of the date of adoption of this Resolution, and terminating at the time the City Manager makes his written recommendation as to the selection of the aforestated RFP to the City Commission, and said RFP is awarded. Bower and M tubers of the City Commission FROM: Jose Smith, City Attorney ~' ~~ DATE: December 12, 2007 SUBJECT: CMB Agreement with Standard Parking for Parking Cashiers/Attendants and Supervisors for the City's Parking System The attached Resolution was prepared at the request of Commissioner Wolfson, who has requested that said Resolution be considered by the Mayor and City Commission as an alternative to the City Administration recommendation and Resolution (which requests that the City Commission refer the issue of whether to exercise the option for renewal of the Standard Parking Agreement, or whether to issue a new Request (RFP) for the contract, to the Finance and Citywide Projects Committee ,for further discussion). Commissioner Wolfson's proposed Resolution recommends declining the renewal option and authorizing the issuance of a new RFP (without going to Committee). Additionally, in the event that the City Commission elects to approve the attached Resolution, it should be noted that the current vendor, Standard Parking, has agreed to continue to provide the services, on a month to month basis, through the RFP process and until execution of a new contract (so there will be no disruption in services).
