As there is no specific job or type of job, the schedule impact(s) and preliminary schedule are not applicable. Risk No. land 2 Construction spikes in terms of prices and subcontractor availability. More significantly in a potential five year contract. The construction industry has demonstrated a history of peaking which has lead to a lack of availability of subcontractors and a lack of reasonable stable pricing. During these periods there is also the potential scarcity of materials such as concrete. These spikes can have a devastating effect to a JOC contractor as a JOC contractor typically has many active jobs simultaneously and the lack of one trade or material can impact all its jobs. Solution We have a proven solution as we have experienced these construction spikes and have successfully completed our ongoing jobs on time and on budget. During our 10 years as a JOC contractor we have acquired and maintained apre-qualified subcontractor base. This subcontractor pool has agreed to maintain prices according to the JOC Construction Task Catalog and availability through construction spikes in return for stable, consistent long term work and favorable payment terms such as payments within 30 days regardless of payment by owner and not withholding retention. We typically have three to five subcontractors per trade available and on notice under this program. In order to help assure availability of materials our company has two other divisions aside from our JOC operations, Capital Construction and Flat Work (sidewalks, curbs and gutters) which provide us with the purchasing power leverage to be issued priority in times of scarce materials. For example, about two years ago there was a shortage of concrete and most contractors would not have concrete available when necessary thus delaying projects. As we essentially were VIP customers with our concrete vendors we were always provided concrete as required. This was because we were purchasing an average of $60,000.00 of concrete per month. We have similar relationships with other material suppliers thanks to our combined purchasing power leverage. 1 of 2 ppL Risk No. 3 Providing accurate and timely proposals. One of the benefits of the JOC system is the ability to procure and produce projects in a short period of time. Solution We have an in house estimator dedicated to JOG His principle responsibility is turning over JOC proposals that are scnrtinized and checked for compliance to JOC standards and general conditions. JOC standards and general conditions are a set of policies which describe what is to be included in the pricing of the Construction Task Catalogue line items and what is included on the applicable bid factor. Above and beyond the scrutiny of our JOC estimator, an advantage of our pre-qualified subcontractor pool (as described in the previous risk) is that each subcontractor is given and has on hand a JOC Construction Task Catalogue in order for their estimators to produce accurate and timely JOC line item proposals for our estimating department. Risk No. 4 Maintaining quality and workman like standards through multiple, simultaneous and fast paced projects which are inherit to JOC. Solution Our principals and project managers are all either licensed State Certified General Contractors or in the process of obtaining their license. As licensed general contractors we are required to attain continuing education courses which we gear towards quality control. All our subcontracts are performance based and we have therefore set policies that reward good on time and on budget projects to subsequent subcontracts and where two consecutive failed inspections disqualify the subcontractor from further subcontracts for a period of 90 days. This policy is part of our subcontract agreements (contracts). Risk No. 5 Potential of an adversarial professional relationships as JOC projects provide for the continual interaction with the same representatives in multiple projects for and extended period of time, in this case up to 5 years. Solution We avoid these potentially adversarial relationships and actually nurture and maintain strong relationships by having a strong understanding and execution of the JOC system All our JOC staff is experienced and well versed in our obligations under JOC. It is easy for a contractor not intimately familiar with the JOC general conditions to feel exploited or pushed and have that feeling reflected upon the owner representative.
