2008-26733 ResoRESOLUTION NO. 2008-26733 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, GRANTING AND AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE EASEMENTS IN FAVOR OF FLORIDA POWER AND LIGHT, AS REQUIRED, FOR THE PLACEMENT OF TRANSFORMERS AND ASSOCIATED UNDERGROUND ELECTRICAL CONDUITS THAT SERVE THE EXISTING MAINTENANCE BUILDING AND WASTEWATER PUMP STATION AND WILL SERVE THE PROPOSED IRRIGATION PUMP STATION AND THE PROPOSED STORMWATER PUMP STATION AT THE NORMANDY SHORES GOLF COURSE. WHEREAS, on October 21, 1997, pursuant to Request for Qualifications No. 79-96/97, the Mayor and City Commission adopted Resolution No. 97-22575, authorizing the Mayor and City Clerk to execute an Agreement with the firm of Arthur Hills and Associates, for Professional Services for the design, construction, bidding documents, construction observation, project administration, scheduling, and cost estimating necessary for the renovation and improvement of three City golf courses: Miami Beach Country Club (Bayshore Golf Course), Bayshore/Par 3, and the Normandy Shores Golf Course; and WHEREAS, on September 8, 2004, the Mayor and City Commission adopted Resolution No. 2004-25665, authorizing the Mayor and City Clerk to execute Amendment No. 2 to the Arthur Hills and Associates Agreement for additional services necessary for the renovation of the Normandy Shores Golf Course Project, which included services relative to the drainage and irrigation system improvements including a stormwater pump station and an irrigation pump station; and WHEREAS, on March 14, 2007, the City approved Invitation to Bid No. 21-06/07, authorizing the Mayor and City Clerk to execute an Agreement with the firm of QGS Development, Inc. to reconstruct the Normandy Shores Golf Course; said Agreement included the drainage and irrigation system improvements and required coordination of power requirements with FPL for the stormwater pump station and irrigation pump station; and WHEREAS, FPL determined that the power requirements were such that new transformers would be needed adjacent to each pump station; and WHEREAS, it was determined that no easements had ever been recorded for the placement of transformers and the associated underground electrical conduits adjacent to the existing maintenance facility and the existing wastewater pump station; and WHEREAS, the City and FPL must now execute easements, in favor of FPL, as the grantee, in order to service these transformers and their associated underground electric conduits; and WHEREAS, the Administration would accordingly recommend that the Mayor and City Commission approve the granting and execution by the Mayor and City Clerk of such easements, for the placement of transformers and associated underground electrical conduits that serve the existing maintenance building and wastewater pump station and will serve the proposed irrigation pump station and the proposed stormwater pump station at the Normandy Shores Golf Course. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission hereby grant and authorize the Mayor and the City Clerk to execute easements in favor of Florida Power and Light, as required, for the placement of transformers and underground electrical conduits that serve the existing maintenance building and wastewater pump station and will serve the proposed irrigation pumps station and the proposed stormwater pump station at the Normandy Shores Golf Course. Item SummaryiKecommenaation: The Administration recommends approval of this resolution since FPL requires that the City record easements for the transformers and the associated underground electrical conduits at the existing maintenance facility, existing wastewater pump station, proposed irrigation pump station, and proposed stormwater pump station at the Normandy Shores Golf Course. During the reconstruction of the golf course, FPL determined that power requirements of the proposed irrigation pump station and the proposed stormwater pump station required that transformers be located adjacent to them. An easement is required over these transformers and their associated electrical conduits. During this work, it was also determined that an easement had never been recorded for the transformers and their associated underground electrical conduits at the existing maintenance facility and existing wastewater pump station.
