2008-26734 ResoRESOLUTION NO. 2008-26734 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, GRANTING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN EASEMENT IN FAVOR OF FLORIDA POWER AND LIGHT FOR A TRANSFORMER AND ELECTRICAL CONDUITS TO SERVE THE NEW BUILDINGS INCLUDED AS PART OF THE SOUTH POINTE PARK IMPROVEMENT PROJECT. WHEREAS, on March 14, 2007, pursuant to Invitation to Bid (ITB) No. 26-06/07 for Construction Services for the South Pointe Park Improvement Project (the Project), the Mayor and City Commission awarded a construction contract to Magnum Construction Management Corporation (MCM); and WHEREAS, the City issued First Notice to Proceed to MCM on June 4, 2007; and WHEREAS, the City issued Second Notice to Proceed to MCM on August 6, 2007; and WHEREAS, as part of the Project, a new pavilion and maintenance building are being built east of Ocean Drive; and WHEREAS, a new FPL transformer providing electrical service to both buildings is to be installed adjacent to the proposed maintenance building; and WHEREAS, FPL requires that the City grant a utility easement in order to service this transformer and its associated electric conduits. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby grant and authorize the Mayor and City Cterk to execute an easement in favor of Florida Power and Light (FPL) for a transformer and electrical conduits to serve the new buildings included as part of the South Pointe Park Improvement Project. The Mayor and City Commission authorized the Administration to enter into negotiations with MCM, and upon successful negotiations, further authorized the Mayor and City Clerk to execute an Agreement with MCM. First Notice to Proceed was issued on June 4, 2007 and Second Notice to Proceed was issued on August 6, 2007. As part of the Project, a new pavilion and maintenance buildings are being built East of Ocean Drive and a new FPL transformer feeding both buildings is to be installed adjacent to the proposed maintenance building. As a result, FPL requires the City to record a utility easement in order to service this transformer and its associated electric conduits. The CIP Office had a survey prepared that describes the easement to be recorded per FPL requirements, attached as Attachment I. The Administration recommends that the City record the easement for FPL in order to power the proposed buildings and adjacent areas.
