If you are called for jury duty, we will permit you to take the necessary time off and we wish to help you avoid any financial loss because of such service. If you have been with us for more than 90 days, Alpine Construction Management Corp will reimburse you for the difference between your jury pay and your regular pay, not exceeding eight (8) hours per day, for a maximum of 10 business days. You most notify your manager within forty- eight (48) hours of receipt of the jury summons and provide a copy of the jury summons to your manager. On any day or half-day you are not required to serve, you will be expected to return to work. In order to receive jury duty pay, you must present a statement of jury service and pay to your manager. This document is issued by the court. Military Leave If you are a full-time employee and are inducted into the U.S. Armed Forces, you must notify your manager within 48 hours and provide a copy of your orders to your manager. You will be eligible for re-employment after completing military service, provided: 1. You show your order to your manager as soon as you receive them. 2. You satisfactorily complete your active duty service. 3. You enter the military service directly form your employment from Alpine Construction Management Corp. 4. You apply for and are available for re-employment within 90 days after discharge form active duty. Military Reserve or National Guard Leave Employees who serve in U.S Military organizations or state militia groups may take the necessary time off without pay to fulfill this obligation, and will retain all of their legal rights for continued employment under existing laws. These employees may apply accrued personal leave and unused earned vacation time to the leave if they wish; however they are not obliged to do so. •7005 N. You must provide a copy of your orders to your manager. Payment in Lieu of Vacation The purpose of a vacation is to provide you with a time to rest and relax; therefore, no additional salary will be paid to you in lieu of vacation. Personal Days/ Sick Leave On January 1st of each year, after completion of your introductory period, you will be eligible for five (5) personal/ sick days per calendar year. This time may be used for personal business, illness, or any other way the employee wishes to utilize their five (5) days each year. To qualify for sick/ personal time leave, you must be a full-time employee and in our employ for at least (90) days. Time taken off before this will be "docked" from your pay. If you have not been employed for a full year with Alpine Construction Management Corp, you will be eligible for paid sick days, upon completion of your (90) days introductory period as follows: Half day (4 hours) for each full month from the time that you complete your ninety day introductory period through the end of the calendar year. For example, if you complete your introductory period on April 15th, you will be eligible to use four (4) paid sick days (32) hours between April 15th and December 31St. Thereafter you will be eligible for the normal five (5) days paid sick days per calendar year. Sick/ personal time may accumulate from year to year, not to exceed 240 hours banked at the end of each calendar year. Sick and personal time in excess of 240 hours will reimbursed on the first pay period of the new year at the same rate as straight time pay. If you are required to take an extended disability leave of absence, any accrued sick leave will be paid at the time the leave commences; should the leave extend beyond thirty (30) days, sick leave will not continue to accrue. Under certain circumstances you may be eligible for an unpaid leave of absence. An unpaid leave of absence may be granted for a minimum of thirty (30) days and a maximum of six (6) months. You must apply in writing for an unpaid leave of absence, setting forth the reason for the leave, the date on which you wish the leave to begin, and the date on which you will return to active employment with Alpine Construction Management Corp. Submit your application to your manager, who will bring your request before the proper members of management for approval. A leave will be granted only when operating conditions at Alpine Construction Management Corp permit. The needs of Alpine Construction Management Corp will determine the number of employees allowed out on unpaid leave at any time. You most adhere to all requirements set forth in the following sections. Failure to do so may result in your employment status with Alpine Construction Management Corp being terminated of altered. Disability (Includina Preanancv/ Maternitvl Leave Employees, who develop an illness or physical condition which requires treatment or restrictions and precautions as to their health, will be required to submit a physician's statement. The statement must give approval that continued, full-time employment in their present position, will not jeopardize their health or the safety of others, in the event that they continue to work. Alpine Construction Management Corp will grant an unpaid leave of absence for illness or pregnancy. To request a medical leave of absence from your manager, you should submit, or have someone submit for you, a statement of ill health from your doctor. Pregnancy is treated, for the purposes of policy, similarly as an illness or disability. In the event such employees require a disability leave of absence, an approved medical leave will be granted for up to ninety (90) days. If necessary, you may request extension in thirty (30) day increments for maximum of one (1) year. Whenever possible, you are required to give as much notice as possible of your pending need for medical leave of absence. *7005 N. In the case of emergency, please inform your manager as soon as possible of the date you and your doctor anticipate that you will begin your leave. Employees who must remain away from work for more than the period of time allowed above will be considered terminated from employment. They are welcome to re -apply subject to Alpine Construction Management Corp's usual hiring policies. Should any of these people be re-employed, they will not lose seniority, provided the time away does not exceed 180 consecutive calendar days. At this time the disability leave begins, any accrued personal or sick leave will be paid Vacation time previously earned (but not used) at that time will also be paid if the employee so desires. These benefits do not continue to accrue during a leave of more than thirty (30) days calendar days. This policy applies to all employees. Should your attendance or job performance suffer during the period preceding and/or following a disability leave, we will accommodate you to the extent provided by law. We are under no obligation to reduce or alter your workload, or to assign fewer than the usual hours of work. A written statement by a physician is required, r-- authorizing you to perform your former duties upon returning after a disability leave. Educational Leave. An educational leave of absence may be approved if the desired curriculum is of mutual benefit to you and Alpine Construction Management Corp. Apply in the same manner you would for a personal leave. Personal Leave In very special circumstances we may grant a leave for a personal reason, but never for taking employment elsewhere or going into business for you. Returnina From a Leave of Absence You must notify Alpine Construction Management Corp. at least fifteen (15) days prior to your expected return date, that you intend to return from a leave of absence. When you return, you will be placed on your regular job if such position remains. If Alpine Construction Management Corp. has had to fill your position while you were on leave, you will be assigned to an open position for which you are properly qualified. If no position exists, you will be placed on layoff status. If you do not return from your leave of absence on the day indicated in your original application, or in any approved extension, or within three (3) days of release by your doctor (if you have been on a medical leave of absence), you will be considered to have voluntarily resigned from employment with Alpine Construction Management Corp as of the day on which you began your leave of absence. If you have been on medical leave of absence, you will be required to submit a statement from your doctor indicating that you are fit to return to your normal duties. Under the provision of the law, if you are injured while at work, you are eligible to apply for Worker's Compensation. What is Worker's Compensation? Florida's Worker's Compensation law was passed to guarantee prompt, automatic benefit to workers injured on the job. Before Worker's Compensation, an injured worker had to sue his employer to recover r medical costs and lost wages. Lawsuits took months and sometimes years. Juries and judges had to decide who was at fault and how much, if anything, would be paid. In most cases, the injured worker got nothing. It was a costly, time-consuming, and unfair system. In response to questions and requests for additional information received by prospective bidders relative to the bonding requirement, the following clarification/amplification is hereby provided: 1. Bid Guaranty or Bid Bond. A bid bond or an alternative form of guaranty (i.e., certified check, cashier's check, corporate check, or money order), in the amount of $25,000, must be included as part of your bid submission, for each ITB that you are responding to. If you are electing to submit a bid bond, you may utilize your surety company's standard form. Please note that your bid bond or alternative form of guaranty will be returned to you immediately (within one business day) after one of the following two conditions: a. You are not approved for a contract award; or b. You are approved for a contract award and you execute (sign) the contract. If for any reason, a decision relative to the contract award is delayed and the above aforementioned conditions (whether to award or not award) cannot be applied, then City will return all bid bonds or alternative forms of guaranty within 180 days. The bid bond or guaranty shall be forfeited if the successful bidder (contract awardee) fails to execute a contract, or fails to furnish the required performance bond and payment bond, or fails to furnish the required certificate(s) of insurance after being notified of the award of the Contract. 2. Performance and Payment Bond. A performance bond and a payment bond are required only when notified by the City that you are the successful bidder(s) and the City Commission has awarded a contract(s). When notified in writing by this Office that the City Commission has awarded a contract(s) to your company, you must submit a payment bond and performance bond each in the amount of $1 million. Each bond shall be in effect for a period of one year. Each contract will have an initial term of 12 months. The contract may be renewed at the mutual agreement by the contracting parties (Le., your company and the City). If mutually agreed to renew the contract term beyond the first and subsequent renewal options, a new performance bond and payment bond will be required to be submitted in the amount of $1 million. There are four one-year renewal options. On an annual basis (one year from the effective date of the contract), the City and successful (contract awarded) Contractors will sit down to discuss at a minimum: 1) any increase to the adjustment factors bid (i.e., profit and overhead) pursuant to the Engineering News Record's 20 City average report; and 2) whether the contract(s) should be renewed for an additional year.
