A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA,
DETERMINING THAT CERTAIN SERVICES BE PROVIDED
PURSUANT TO THE CREATION OF THE WASHINGTON
AVENUE MANAGEMENT DISTRICT NO.1, AS DECLARED
BY RESOLUTION NO. 94-21244 ADOPTED ON JULY 27,
1994, AND FURTHER LEVYING SPECIAL ASSESSMENTS
AGAINST PROPERTIES IN THE DISTRICT BENEFITTED
BY THE PROVISION OF SUCH SERVICES, IN
ACCORDANCE WITH THE FINAL ASSESSMENT ROLL TO
BE FILED FORTHWITH WITH THE CITY CLERK.
WHEREAS, Chapter 170, Florida Statutes, as amended (Act),
provides that a municipality may levy and collect special
assessme~ts against property benefitted for the purpose of
stabilizing and 1mproving retail and/or wholesale business
districts and/or nationally recognized historic districts through
the promotion, management, marketing, and other similar services in
such districts of the municipality; and
WHEREAS, on July 27, 1994, by Resolution No. 94-21244, the
Mayor and City Commission of the City of Miami Beach, Florida,
declared the creation of a special assessment district known as the
Washington Avenue Management District No.1, for that area of
Washington Avenue, from Fifth through Sixteenth Street, and
Espanola Way, from Collins Avenue to Drexel Avenue (District), for
the provision of those certain services as set forth in Exhibit
"A", attached and incorporated (Services), all in accordance with
the applicable provisions of the Act; and
WHEREAS, a preliminary assessment roll has been filed with the
Office of the City Clerk indicating the lots and lands to be
assessed, the amount of the benefit to and the assessment against
each lot and/or parcel of land, all as required by the Act; and
WHEREAS, approval has been obtained by a majority of the
affected property owners within the District as to the levying and
collection of the assessments, as additionally required by the Act
and as evidenced in the petition attached and incorporated as
Exhibit "B"; and
WHEREAS, on July 27, 1994, by Resolution No. 94-21245, the
Mayor and City Commission scheduled and thereafter held a public
hearing on September 13, 1994 to hear testimony from all property
owners and any other interested persons regarding the propriety,
advisability and cost of providing the Services in the District;
and
WHEREAS, all affected property owners have received
appropriate notice of the public hearing, as prescribed by the Act;
and
WHEREAS, all complaints, comments and objections by interested
persons and affected property owners were received at the hearing
and thereafter treated on the basis of justice and right, as
reflected herein, with regard to the Services and the assessments.
NOW, THEREFORE, BE IT DULY RESOLVED by the Mayor and City
Commission of the City of Miami Beach, Florida:
Section 1: All findings and recitals contained in this
Resolution are hereby adopted and incorporated. Resolution No. 94-
21244, which ordered the creation of the Washington Avenue
Management District No.1, is hereby confirmed.
Section 2: A final assessment roll shall be promptly filed with
the Office of the City Clerk in accordance with this Resolution and
the applicable provisions of the Act. Such assessments contained
in the final assessment roll are hereby levied and stand confirmed
and remain legal, valid and binding special assessment liens upon
properties against which such assessments are made, until paid.
These assessments shall be recorded in the Improvement Lien Book
and the final assessment roll shall show the lots or lands
assessed, the amount of benefit as to each such lot or land, and
the manner of payment of such assessment.

Security
Security services will be provided initially by a combination of
private security and the Miami Beach Police Department until
adequate staffing allows for additional police officers to patrol
the District.
Sanitation

ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission adopt the
attached resolution levying a special assessment and providing for
creation of a final assessment roll to support improvements to the
special assessment district to be known as the Washington Avenue
Management District Number 1 which will encompass the area on
Washington Avenue from Fifth to Sixteenth streets and Espanola Way
from Collins Avenue to Drexel Avenue. The Administration further
recommends that the city Commission approve the changes to the
assessment roll based on the revised method of assessment and revised
budget as requested by the washington Avenue Association.

BACKGROUND:

The success of the Ocean Drive Special Services District has
encouraged property owners on Washington Avenue to desire similar
improvements on their street. Furthermore, a majority of the property
owners support the creation of a special assessment district to
provide for security, maintenance and related services. The
improvements to be provided through this special assessment district
are described below as follows:

Salary and fringe benefits for a District Manager and support

The City will enter into an agreement with the Miami Beach Development
Corporation, on behalf of the Washington Avenue Association, to
provide for sanitation, landscape maintenance, signage and management
services within the Special Services District. Private security will
be managed by the District. Security services provided by police
officers will be managed by the Miami Beach Police Department in
cooperation with the District Manager.

Method of Assessment
....
The total amount of the special assessment to fund these services has
been revised based on the new method of assessment and is $327,565 or
$465 less than the original amount of $328,000. This portion of the
cost of providing these services will be prorated according to the
front footage of the respective properties specially benefited by
these improvements. Owners of corner lots will be assessed an
additional one-half times the amount levied for a 50 foot frontage,
that is they will pay for an additional 25 feet of frontage. The
estimated annual cost of providing this benefit is $36.79 per front
foot.

The recommended, revised method of assessment for condominiums, will
eliminate the assessment levy per individual units and require that
condominium buildings be assessed on a front foot basis of the
respective lots and that the assessed be levied against the respective
management associations.

The City will fund the balance of costs for these services from the
proceeds of resort taxes.

Following the public hearing the City Commission shall meet as an
equalization board to consider the testimony of the affected property
owners and shall adjust and equalize the assessments on a basis of
justice and right. Upon adoption of the attached resolution the
special assessment shall be levied and the final assessment roll shall
be created.
