A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, ACCEPTING THE CONTRIBUTION OF REPLACEMENT
UNINTERRUPTIBLE POWER SUPPLY (UPS) EQUIPMENT FROM MOTOROLA,
INC. IN LIEU OF, AND AS SATISFACTION FOR, PENALTIES PROVIDED IN THEIR
RADIO MAINTENANCE CONTRACT.
WHEREAS, the Motorola maintenance contract provides for Motorola to repair the UPS system located
at Tower 41 within twenty-four hours of failure; and
WHEREAS, the UPS equipment located at the Tower 41 radio site failed on February 12, 1995; and
WHEREAS, due to the lack of parts, Motorola was unable to repair the system; and
WHEREAS, Motorola, Inc. requested, and the City agreed, that in lieu of penalties, they be permitted to
replace and donate to the City an equivalent or better UPS system; and
WHEREAS, the replacement of the UPS equipment was installed on April 13, 1995.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein accept the contribution of the
uninterruptible power supply equipment at Tower 41 radio site from Motorola, c. In lieu of, and as satisfaction
for, penalties provided in their radio maintenance contract.

SUPPLY (UPS) VALUED AT $23,340 FROM MOTOROLA, INC. IN LIEU OF PENALTIES
AS PROVIDED IN THEIR RADIO MAINTENANCE CONTRACT FOR EQUIPMENT AT
TOWER 41

The Administration recommends adoption of the Resolution.
BACKGROUND
On February 12, 1995, the UPS equipment located at the radio site at Tower 41, 4101 Pine Tree Drive
failed. Under the agreement with Motorola, Inc. for the provision of maintenance and repair services,
the UPS was to be repaired within twenty-four hours or penalties would be assessed. The original UPS
was installed in 1987 and is no longer being manufactured. Due to this, Motorola was unable to obtain
parts to repair the equipment.
As an alternative to repairing the UPS, Motorola requested that the City permit them to replace the
equipment with a current model of equivalent Or better value and waive any penalties that were
incurred as a result of the repair not being completed within twenty-four hours. The City agreed and
signed an agreement with Motorola (attached) on March 19, 1995.
A new 15 kva UPS (Best Unity I Model UT315) was installed on April 13, 1995. Warranty records at
Best Power Technology now list the City of Miami Beach as the owner of the unit. The value of this
equipment is $23,340.00 not including electrical hook-up and installation.
CONCLUSION
Adoption of this Resolution recognizes the contribution of the UPS from Motorola, Inc. and confirms
the City of Miami Beach as the owner of the equipment.
