RESOLUTION NO. 2000-24189
A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA,
AUTHORIZING THE ADMINISTRATION TO ENTER INTO
NEGOTIATIONS WITH RESPECT TO THE TERMS OF THE
CONTRACT WITH FIRM OF JORDEN BURT, TO PROVIDE
GOVERNMENTAL REPRESENTATION AND CONSULTING
SERVICES IN WASHINGTON, D.C. FOR THE 2001/2002 AND
2002/2003 CONGRESSIONAL SESSIONS, PURSUANT TO
REQUEST FOR PROPOSAL (RFP) NO. 65-99/00.
WHEREAS, the City must avail itself of all potential sources of funds; and
WHEREAS, Federal legislation may need to be enacted to protect and enhance the City's
interests; and
WHEREAS, the City's numerous Federal-level needs have been assessed and prioritized to
produce the most effective use of its legislative team; and
WHEREAS, the City's current contract with the firm of Jorden, Burt, Berenson and Johnson
LLP for Governmental Representation and Consulting Services in Washington, D.C. will expire on
February 18, 2001; and
WHEREAS, on February 9,2000, the City issued Request For Proposal (RFP) Number 65-
99/00, seeking proposals for Governmental Representation and Consulting Services in Washington,
D.C.; and
WHEREAS, on April 17, 2000, two proposals were received in response to RFP No. 65-
99/00; and
WHEREAS, a five-member Selection Committee was created and met to evaluate the two
proposals on August 24, 2000; and
WHEREAS, the Selection Committee met on October 12, 2000 and heard oral presentations
by the two proposers; and
WHEREAS, the Selection Committee debated the merits of both proposals and
recommended by a vote of three (3) to two (2) the selection ofthe firm of Alcalde & Fay; and
WHEREAS, on November 29, 2000, the Mayor and City Commission heard and considered
testimony from the number-one ranked firm of Alcalde & Fay, and from the number-two ranked firm
of Jorden Burt; and
WHEREAS, on November 29, 2000, the Mayor and City Commission directed the
Administration to enter into negotiations with the firm of Jorden Burt.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Administration is
authorized to enter into negotiations with respect to the terms of the contract with firm of Jorden
Burt, to provide governmental representation and consulting services in Washington, D.C. for the
2001/2002 and 2002/2003 Congressional Sessions, pursuant to Request For Proposal (RFP) No. 65-
99/00.

THE SELECTION COMMITTEE OF PROPOSALS RECEIVED PURSUANT
TO REQUEST FOR PROPOSAL NO. 65-99/00 AND AUTHORIZING THE
ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH RESPECT
TO THE TERMS OF THE CONTRACT WITH THE NUMBER-ONE
RANKED FIRM, ALCALDE AND FAY, TO PROVIDE GOVERNMENTAL
REPRESENTATION AND CONSULTING SERVICES IN WASHINGTON,
D.C. FOR THE 2001/2002 AND 2002/2003 CONGRESSIONAL SESSIONS.
ADMINISTRATION RECOMMENDATION:
Adopt the Resolution.
ANALYSIS:
On November 8, 1996, the City issued Request for Proposals No. 13-96/97, in order to provide
governmental representation and consulting services in Washington, D.C. On December 19, 1996,
a Selection Committee comprised of the City Attorney, Deputy City Manager, and representatives
from the Office of the Mayor and City Commission, the Miami Beach Chamber of Commerce, and
a citizen-at-large from the City, convened to review all proposals submitted in response to the RFP,
with ten (10) proposals evaluated for compliance with submission requirements, documentation of
qualifications, and experience and capability to provide the necessary services.
At its regular meeting on January 22, 1997, the Mayor and City Commission accepted the
recommendations of the Selection Committee, finding the firm of Jorden, Burt,' Berenson and
Johnson LLP (JordenBurt) to be the top-ranked proposer. The Administration and City Attorney's
Office negotiated a Professional Services Agreement with this firm to provide governmental
representation and consulting services in Washington, D.C. This Professional Services Agreement
was approved by the Mayor and City Commission at its February 19, 1997 meeting.
On February 3, 1999, the Mayor and City Commission approved Resolution No. 99-23051,
extending the Professional Services Agreement with JordenBurt for one year at an annual amount
of $81 ,588.

On February 9, 2000, the Mayor and City Commission approved Resolution No. 2000-23794,
extending the Professional Services Agreement with JordenBurt for one additional year at an annual
contract amount of $90,000. At the same City Commission meeting, the Mayor and City
Commission also authorized the issuance of Request For Proposal No. 65-99/00 for Governmental
Representation and Consulting Services in Washington, D.C. for the 200112002 and 2002/2003
Congressional Sessions.
On April 17, 2000, the City received responses to the RFP from two (2) firms, Alcalde & Fay, and
JordenBurt. The following Selection Committee was appointed to evaluate the two proposals
received:
· Murray Dubbin, City Attorney
· Christina Cuervo, Assistant City Manager
· Max Sklar, Chief of Staff, Mayor and Commission Office
· Joy Malakoff, Colonial Bank, Chair of the Selection Committee
· Roberto Datorre, Miami Beach Community Development Corporation
The Selection Committee met on August 24,2000 to review all proposals submitted. Each of the two
proposals was evaluated for compliance with submission requirements, and documentation of
qualifications, experience and capability to provide the necessary services for this assignment. Both
firms were determined to have met the submission requirements, and were invited to attend a
meeting on October 12, 2000 to give oral presentations and to address specific questions and
concerns.
The Selection Committee based its recommendation on the following factors:
1. Personal and professional background and history of Proposer's principals and personnel
(15 points).
2. Location, experience and qualifications of the Proposer (5 points).
3. Experience in providing legislative lobbying services, especially for local governments in
Washington, D.C. (35 points).
4. Qualifications and accomplishments of the personnel who would be assigned to work with
the City (20 points).
5. Proposal fees (5 points).
6. References and degree of satisfaction of present and former clients (20 points).
Following the presentations, additional discussion by the Selection Committee dealt with the City's
previous experience with JordenBurt, as well as the positive and/or negative impact on the City of
a fil111 representing several other municipalities, with particular concern on the potential conflict that
could arise by a firm's representation of both Miami Beach and Miami-Dade County. The firms
addressed this concern adequately and the Selection Committee deliberated on the strengths and
weaknesses of each proposal.

weaknesses of each proposal.
The Selection Committee felt that both firms were qualified, and unanimously expressed that they
would give the same number of points to each firm. Discussion centered on the additional benefits
that would enure to the City if a firm such as Alcalde & Fay was selected. While unanimous support
of JordanBurt was expressed, the majority deemed that Alcalde & Fay would provide additional
exposure and access to funding due to their established relationships amongst the elected
congressional delegation. At this point, the Selection Committee decided that each member would
vote for the firm of their preference, with Alcalde & Fay receiving three (3) votes and Jorden Burt
receiving two (2) votes, subject to receipt of favorable references:

· Joy Malakoff: Alcalde & Fay
· Roberto Datorre: Alcalde & Fay
The Administration contacted the references provided as well as the Florida Delegation members
and their staff, and both firms received favorable remarks. While many delegation members
expressed concern regarding making a recommendation in favor of one firm or the other, they
expressed favorable remarks with respect to either firm's representation of the City at the Federal
level.
It is recommended that the Mayor and City Commission authorize the Administration to enter into
negotiations with the top ranked firm for this project, Alcalde & Fay, with the negotiated contract
to be brought back before the Commission for approval.
