A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, RETROACTIVELY AUTHORIZING THE
ACCEPTANCE OF A GRANT AWARD, IN THE AMOUNT OF $45,000.00, FROM
THE OFFICE OF THE GOVERNOR, OFFICE OF DRUG CONTROL, FOR
IMPLEMENTATION OF A YOUTH ALCOHOL PREVENTION PROGRAM BY
THE MIAMI BEACH POLICE DEPARTMENT; AND AUTHORIZING THE
BUDGETING AND EXPENDITURE OF THE FUNDS.
WHEREAS, the Office of the Govemor, Office of Drug Control, has funds available for youth alcohol
prevention programs and the Miami Beach Police Department submitted a proposal for consideration for funds;
and
WHEREAS, the Office of Drug Control notified the Police Department on January 31, 2001, that they
would be awarded a $45,000 grant and that the grant documents had to be prepared, signed and returned to
the Office of Drug Control no later than February 9, 2000; and
WHEREAS, the Mayor and City Commission did not meet until February 21,2001, retroactive
approval is now necessary; and
WHEREAS, the Miami Beach Police Department has created a Youth Alcohol Prevention Program
that will target the sales and/or consumption of alcoholic beverages by underage persons; and
WHEREAS, the Miami Beach Police Department will conduct undercover operations to determine
if alcoholic beverages are being sold to underage persons by licensed premises, or whether underage persons
are consuming alcoholic beverages; and the Police Department will print and distribute literature to licensed
premises regarding sales and/or consumption of alcoholic beverages to underage persons; and
WHEREAS, the funds will be used for overtime payments to undercover informants; purchases of
alcoholic beverages; club admissions; and printing and mailing of literature; and
WHEREAS, there are no matching funds required by the City; and
WHEREAS, the grant will be from the date of acceptance and end September 30, 2001.
NOW THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission
herein, retroactively authorize, the acceptance of a grant of $45,000.00, from the Office of the Governor,
Office of Drug Control, for implementation of a Youth Alcohol Prevention Program by the Miami Beach
Police Department; and authorize the budgeting and expenditure of the funds.

First, let me thank you for your response in development of a proposal targeted to youth alcohol
prevention. Secondly, let me congratulate you on your proposal. I am pleased to be in a position to
allocate $45,000 for the continuing development and delivery of your program focused on youth alcohol
prevention. Thl!nk you for your patience. in getting this informatIOn to you. Enclosed is the necessary
paperwork that IS needed to start processmg your grant.
Because this grant is only for a nine-month period, there are some guidelines that must be
followed:
I. There will be no 10% advance.
2. Financial Reimbursement Reports must be filed quarterly. We realize that this might
create a cash flow problem until the first reimbursement is received, but arrangements
need to be made to get you through this period. The first reimbursement will De for the
peri9d of January tlfrough March. The reimbursement must be submitted by the 30th of
Apnl.
In order to expedite the processing of your grant, we need the following returned to us as soon
as possible: the new contract With the Acceptance and Agreement Section (M), signed Signature Page
IN), a budget narrative (K), and the budget schedule (L) reflecting the amount that you were awarded:

to generate a contract number for your grant and send out the signeo contract and the Project

Problem Identification and need for services. Present an overview of the problem and need for
alcohol prevention services that the organization intends to address through the grant funds.
Include data to support the contention of need, such as: juvenile arrests; juveniles needing
and/or receiving treatment; school disciplinary action statistics that directly or indirectly relate
to violence and/or drug abuse inciuding truancy, suspensions and expulsions; or local studies.
Definition of TarDet Population. Clearly state the population(s) and the area(s) the program
intends to serve. Identify children and youth who are not normally served by state or local
education agencies or populations that need special services or additional resources (such as
preschoolers, youth in juvenile detention facilities, runaway or homeless children and youth,
pregnant and parenting teenagers, and school dropouts). Specify the number of youth to be
served and their ages. Describe the method used to identify the targeted populations(s) and
how your program intends to recruit and retain targeted populations.

The protective factor component of this approach requires programs to identify protective factors (state in
Objectives), describe methods to effectively address and enhance these protective factors (state in
Strategies), and apply these methods to buffer the effects of the identified risk factors (state in Strategies).
F. Professional Development! Volunteer TraininCl
The Drug-Free Communities program recognizes and emphasizes the importance of professional
development for staff, and training for volunteers implementing alcohol prevention programs.
Proposals should describe training needs and how these needs relate to the implementation of the
proposed program. Professional Development and Volunteer Training objectives and strategies
should be stated in the same format as described above.
G. Pro!lram Evaluation
Describe the method and procedures for evaluating each of the program objectives. Both process and
outcome evaluation must be included. Evaluation is an essential component of prevention efforts. In
addition, the department reserves the right to evaluate any program on a random basis by an
independent contract evaluator.
Process evaluation - measures the effort and efficiency of the program and is usually used to account
for the services provided. Examples of process indicators are: numbers of youth participating in each
activity; numbers of parents involved in specific activities; numbers and types of educational materials
provided; numbers and types of services provided; cost per person served.
Outcome evaluation - measures the effectiveness of the program in achieving its goals and
objectives. Indicators of outcome include changes in knowledge, attitude and/or behavior of the target
population. Usual methods for obtaining the data involve pre-tests and post-tests with control group
comparisons or time series analyses.
Each program shall be required to submit quarterly progress reports and an annuallfinal report designed
to determine the extent to which the strategies are implemented and the objectives are met. Quarterly
and AnnuailFinal Report forms will be provided to each grant recipient by the Drug-Free Communities
Program.
H. Coordination of Services
Describe how the program will coordinate its services and collaborate its activities with specific existing
service providers, community groups, community and neighborhood planning councils, juvenile justice
county councils, school districts, law enforcement, etc. Refer to these groups by name and function.
Provide evidence that the proposed services will not duplicate existing services.
NOTE: AT A MINIMUM, PROGRAMS MUST COORDiNATE SERVICES WITH THEIR LOCAL
SCHOOL DISTRICTS; DEPARTMENT OF CHILDREN AND FAMILIES ALCOHOL, DRUG ABUSE,
AND MENTAL HEALTH OFFICE; and JUVENILE JUSTICE COUNTY COUNCILS.
Examples of evidence that proposed services will not duplicate existing services are: a copy of a
comprehensive community service plan, letters of commitment from agency or system officiais, or both.
Examples of agency or system officials are: law enforcement officials; Department of Children and
Families representatives; local Juvenile Justice Advisory Councils, local advisory council chairpersons;
federal, state, and local government officiais; officers of parent groups; officers of business and civic
organizations; district school superintendents; and directors of other community-based programs.

Letters of commitment from agency or system officials should specify how their
programs will coordinate with, or provide services to this program, or both. Include
letters of commitment as an appendix rather than as part of the proposal narrative.
I. ProQram Continuation
The purpose of the funds awarded through the Drug-Free Communities Program is to assist
organizations in the successful start-up and implementation of alcohol prevention programs which
benefit Florida's communities. Applications requesting funding are awarded on a competitive basis and
continued funding is not guaranteed year after year. The maximum number of years a program will be
funded through the Drug-Free Communities Program without modification is five (5) years.
Describe how the program's services will be continued after the Drug-Free Communities Program funds
are no longer available.
J. Aaencv Qualifications
Include:
- a brief history of the agency/organization;
- a description of current services, staff, budget, and funding sources; (NOTE:
Continuation programs of 2 or more years are required to submit a copy of their last year's
annual/final report);
- names of current officers and staff (include staff credentials);
- a copy of the most current audited financial statements which shows the fiscal ability to operate
the program and fiscal accountability-this must be included in your proposal;
- a description of similar programs the agency/organization has successfully undertaken;
- names addresses, and telephone numbers of funding sources utilized who have contributed
greater than $1,000 for the past 2 years and the amounts received from each source.
- proof of applicant's non-profit status; and
- a copy of the latest Department of Children and Families Site Visit Report.
K. Proiect BudQet Narrative
List in detail a Budget Narrative which describes each line item in sequence, the purpose (i.e.
relevancy to the proposed project's objectives and strategies), and the manner in which the cost is
calculated. Please keep the budget categories separate as listed below (i.e. Materials needs to be
separate from Salaries and Benefits as these are very different categories).
FUNDING PROVIDED THROUGH THE DRUG-FREE COMMUNITIES PROGRAM IS
SUPPLEMENTAL AN'o IS TO BE USED TO BEGIN, EXPAND, AND IMPROVE PROGRAMS.
THESE FUNDS ARE NOT TO BE USED TO SUPPLANT EXISTING EFFORTS.
BUDGETS SHOULD NOT BE FOR MORE THAN $50,000.
ALLOWABLE COSTS
SALARIES AND BENEFITS:
(a) Salaries: Identify the number of program personnel, their job classifications. and the percentage of
each employee's time to be charged to the grant program. Calculations should be based on gross
salaries. Include a job description for each position funded, either fully or partially, by the grant
program.

(b) Benefits: Reflect employee benefits in the form of employers' compensation (FICA), expenses for
Social Security, employees' life and health insurance plans, unemployment insurance coverage,
workmen's compensation insurance, etc. Indicate the breakdown of individual category items and
manner in which costs are calculated.
CONTRACTUAL SERVICES: Reflect any professional services to the proposed project for the
purpose of fulfilling or enhancing the project's objectives and strategies. (An example of this would be
costs for consultants utilized for evaluation, professional development, accounting, etc.).
AUDIT SERVICES: Non-profit organizations that expend less than $300,000 a year in federal awards
are exempt from federal audit requirements for that year, except as noted in 215(a) OMB Circular A-
133, but records must be available for review or audit by appropriate officials monitoring the Drug-Free
Communities Program, pass through entity, and General Accounting Office (GAO).
FURNITURE AND EQUIPMENT: The purchase of office furniture or equipment under $5,000 is
allowable. (This includes the costof any modifications, attachments, accessories, or auxiliary apparatus
necessary to make it useable for the purpose for which it is acquired). Expense in this category must
be directly related to the efficiency of the proposed project. If used for a specific component of the
proposed project (Le., VCR for showing videos for TV Violence Prevention Training), then cost needs
to be justified in the budget narrative by referencing the appiicable objectives and strategies.
INTERNET ACCESS: MANDATORY Costs for access to Internet on-line services for existing
computer or purchase of a computer.
MAINTENANCE AND REPAIR: Costs incurred for the upkeep of property and equipment solely used
for the proposed project (in as much as such activity does not increase the value of said property).
MATERIALS: Reflect the cost of materials to carry out the proposed project's components. State
approximate cost type of material/supplies, project component, and reference the "Authorized Activity"
noted to justify the costs to be covered under the Drug-Free Communities Program.
Examples: $500.00 arts & crafts - Youth Incentive Program - #6 Artistic Activity for after school.
$300.00 sports supplies - Midnight Basketball - #9 Prevention of Illegal Gang Activity.
MEETINGS/CONFERENCES/SEMINARSITRAININGS: Reflect expenses incurred by the proposed
project's employees to attend meetings, conferences, seminars, and trainings for the purpose of
disseminating information or to increase the vocational effectiveness of the employee directly related
to the project. Include the following: Mileage(driving your own auto) not more than 29 cents per mile
(this includes fuel expense); lodging; automobile rental and fuel; airfare; registration fees; parking and
toll fees, and meals (not more than $21 per diem).
OFFICE SUPPLIES: Reflect costs forthe general administrative operation of the project (i.e. stationery,
envelopes, file folders, pens, pencils, staples, etc.)
OFFICE RENTAL: Reflect the name of the landlord or owner from whom the proposed project is
leasing office space, the square footage of the project's leased office space, and the cost per square
foot.
PARTICIPANT SUPPORT COSTS: Reflect costs for items such as stipends or subsistence
allowances, travel allowances (Subject to provisions in Section 112.061 Florida Statutes), registration
fees paid to participants (not employees) in connection with meetings, conferences, symposia, or
trainings.

PRINTING AND REPRODUCTION: Reflect costs associated with grant administration forms, reports,
manuals and informational and educational literature directly related to the proposed project.
TRAVEL: Reflect local travel expenses incurred to carry out the objective and strategies directly related
to the proposed project. NOTE: Do not include fund-raising trips or trips for transporting clients to and
from medical appointments. Local Mileage - not more than 29 cents per mile - this includes fuel
expense. The cost of all travel shall be reimbursed according to state regulations, but not in excess of
provisions in Section 112.061, Florida Statutes.
ADDITIONAL ALLOW ABLE COSTS: Include a brief description and calculation directly relating to any
additional allowable costs requested for the grant program.

All persons involved in or having administrative responsibility for the subgrant must read these
"Acceptance and Agreement" conditions. This "Acceptance and Aareement" must be
returned as part of the completed application.
Note Condition No. 13: Only project costs incurred on or after the effective date of this
agreement and on or prior to the termination date of a recipient's project are eligible for
reimbursement.
Conditions of Agreement. Upon approvai of this subgrant, the approved application and the following
terms of conditions will become binding. Non-compliance will result in project costs being
disallowed.
The term "department". unless otherwise stated, refers to the Office of Druq Control. Druq-Free
Communities.
The term "subgrant recipient" refers to the public or private not for profit (501-C-3) entities
"implementing agency" which is a subordinate agency of a city, county or Indian Tribe, or an
agency under the direction of an elected official (for example, Sheriff ).
1. Reports
a. Project Performance Reports:
There are a total of 5 reports to be submitted during the grant year-4 quarterly reports and the
Annual/Final Programmatic Report. They are due on or before the dates listed below. Monthly
reimbursements will not be made if there are reports that are delinquent.
The recipient shall submit department Quarterly Project Performance Reports to the Drug- Free
Communities Program by January 31, April 30, July 31 and October 31,2001.
The recipient shall submit an Annual Programmatic Report, for the "original" project period. This
report shall be submitted to the bureau within forty-five (45) days after the end of the original
project period (November 15, 2001). The "original" project period is generally for twelve (12)
months ending on September 30th.
b. Financial Reports:
The recipient shall submit Quarterly Financial Claim Reports (DFC-001 A-D) to the bureau.
Quarterly Reimbursement Claims (1-3) are due thirty-one (31) days after the end of the reporting
period. A final Financial Claim Report and Closeout Package (DFC-003)(shall be submitted to
the bureau within forty-five (45) days of the subgrant termination period (November 15, 2001).
Such claim shall be distinctly identified as "final".
Before the "final" claim will be processed, the recipient must submit to the department all
outstanding project reports and must have satisfied all special conditions. Failure to comply with
the above provisions shall result in forfeiture of reimbursement.

c. Other Reports:
The recipient shall submit other reports as may be reasonably required by the bureau. All
required reports, instructions, and forms shall be distributed with the subgrant award.
2. _Fiscal Control and Fund Accounting Procedures
The recipient shall establish fiscal control and fund accounting procedures that assure proper
disbursement and accounting of subgrant funds and required non-federal expenditures. All funds
spent on this project shall be disbursed according to provisions of the project budget as approved by
the bureau.
All expenditures and cost accounting of funds shall conform to the Drug-Free Communities Policies,
General Administrative Regulations and in federal Office of Management and Budget's (OMB's)
Circulars A-21, A-87, and A-110, in their entirety.
All funds not spent according to this agreement shall be subject to repayment by the recipient.
3. Allowable Costs
Allowance for costs incurred under the subgrant shall be determined according to the Drug-Free
Communities Program and federal OMB's Circular No. A-87, "Cost Principles for State and Local
Governments", OMB's Circular No. A-21, "Cost Principles for Educational Institutions" and OMB's
Circular No. A-133 "Audits of Institutions of Higher Education and Other Non-Profit Institutions.
All procedures employed in the use of federal funds to procure services, supplies or equipment, shall
be according to OMB's Circular No. A-110 and Florida Law to be eligible for reimbursement.
4. Travel
The cost of all travel shall be reimbursed according to state regulations, but not in excess of
provisions in Section 112.061, Florida Statutes.
All bills for any travel expenses shall be submitted according to provisions in Section 112.061, Florida
Statutes.
5. Written Approval of Changes in this Approved Agreement
Recipients shall obtain approval from the department for major changes. These include, but are not
limited to:
a. Changes in project activities, designs or research plans set forth in the approved agreement;
b. Budget deviations that do not meet the following criterion. That is, a recipient may transfer funds
between budget categories as long as the total amount of transfer (increase or decrease) does
not exceed ten (10) percent of the total approved budget category and the transfer is made to an
approved budget line item; or,
c. Transfers of funds above the ten (10) percent cap shall be made only if a revised budget is
approved by the department;

d. Under no circumstances can transfers of funds increase the total budgeted award. Transfers do
not allow for increasing the quantitative number of items documented in any approved budget line
item. (For example, in Expense categories or staff positions in the Salaries and Benefits
category.)
6. _Reimbursement Subject to Available Funds
The obligation of the State of Florida to reimburse recipients for incurred costs is subject to available
federal "Drug-Free Communities Alcohol Prevention funds.
7. Commencement of Project
If a project has not begun within sixty (60) days after acceptance of the subgrant award, the recipient
shall send a letter to the bureau indicating steps to initiate the project, reasons for delay and request
an expected project starting date.
If a project has not begun within ninety (90) days after acceptance of the subgrant award, the
recipient shall send another letter to the bureau, again explaining reasons for delay and request
another revised project starting date.
Upon receipt of the ninety (90) day letter, the department shall determine if the reason for delay is
justified or shall, at its discretion, unilaterally terminate this agreement and reobligate subgrant funds
to other department approved projects. The department, where warranted by extenuating
circumstances, may extend the starting date of the project past the ninety (90) day period, but only
by formal written amendment to this agreement.
8. Excusable Delays
The recipient shall not be in default by reason of any failure in performance of this agreement
according to its terms (including any failure by the recipient to make progress in the execution of
work here under which endangers such performance) if such failure arises out of causes beyond the
control and without the fault or negligence of the recipient. Such causes include but are not limited
to acts of God or of the public enemy, acts of the government in either its sovereign or contractual
capacity, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes, and unusually
severe weather, but in every case the failure to perform shall be beyond the control and without the
fault or negligence of the recipient.
9. Obligation of Recipient Funds
Recipient funds shall not under any circumstances be obligated prior to the effective date or
subsequent to the termination date of the grant period. Only project costs incurred on or after the
effective date and on or prior to the termination date of the recipient's project are eligible for
reimbursement. A cost is incurred when the recipient's employee or consultant performs required
services, or when the recipient receives goods, notwithstanding the date of order.
10. Performance of Agreement Provisions
In the event of default, non-compliance or violation of any provision of this agreement by the recipient,
the department shall impose sanctions it deems appropriate including withholding payments and
cancellation, termination or suspension of the agreement in whole or in part. In such event, the
department shall notify the recipient of its decision thirty (30) days in advance of the effective date of
such sanction. The recipient shall be paid only for those services satisfactorily performed prior to the
effective date of such sanction.

11. Access To Records
The Drug-Free Communities Program; and the Auditor General of the State of Florida, the U.S.
Comptroller Generai or any of their duly authorized representatives, shall have access to books,
documents, papers and records of the recipient, implementing agency and contractors for the
purpose of audit and examination.
The department reserves the right to unilaterally terminate this agreement if the recipient, or
implementing agency refuses to allow public access to all documents, papers, letters, or other
materials subject to provisions of Chapter 119, Florida Statutes, and made or received by the
recipient in conjunction with this agreement.
12. Audit
a. The recipient shall provide to the department one copy of an annual audit conducted in
compliance with The Single Audit Act of 1984, P.L. 98-502. The audit shall be performed in
accordance with the federal OMB's Circular A-128 and other applicable federal law. The contract
for this agreement shall be identified with the subject audit in The Schedule of Federal Financial
Assistance. The contract shall be identified as federal funds passed-through the Department of
Justice, Florida Department of Business and Professional Regulation, the Florida Division of
Alcoholic Beverages and Tobacco and Drug-Free Communities and include the contract number,
CFDA number, award amount, contract period, funds received and disbursed. When applicable,
the recipient shall submit an annual financial audit which meets the requirements of Sections
11.45 and 216.349, Florida Statutes; and, Chapters 10.550 and 10.600, Rules of the Florida
Auditor General.
b. A complete audit report which covers any portion of the effective dates of this agreement must
be submitted within 30 days after its completion, but no later than seven (7) months after the audit
period. In order to be complete, the submitted report shall include any management letters
issued separately and management's written response to all findings, both audit report and
management letter findings. Incomplete audit reports will not be accepted by the deoartment and
will be returned to the recipient.
c. The recipient shall have all audits completed by an independent public accountant (IPA). The IPA
shall be either a Certified Public Accountant or a Licensed Public Accountant.
d. The recipient shall take appropriate corrective action within six (6) months of the issue date of the
audit report in instances of noncompliance with federal laws and regulations.
e. The recipient shall ensure that audit working papers are made available to the department, or its
designee, upon request for a period of five (5) years from the date the audit report is issued,
unless extended in writing by the department.
f. If this agreement is closed out without an audit, the department reserves the right to recover any
disallowed costs identified in an audit completed after such closeout.

13. Procedures for Claim Reimbursement
All claims for reimbursement of recipient costs shall be submitted on the DFC-Q01 (A-D) and
Form DCF-003, Revised 01/01, prescribed and provided by the bureau. A recipient shall submit
either monthly or quarterly claims in order to report current project costs.
All claims for reimbursement shall be submitted in sufficient detail for proper pre-audit and post-audit.
14. Retention of Records
The recipient shall maintain all records and documents for a minimum of three (3) years from the
date of the final financial statement and be available for audit and public disclosure upon request of
duly authorized persons.
15. Ownership of Data and Creative Material
Ownership of material, discoveries, inventions, and results developed, produced, or discovered
subordinate to this agreement is governed by the terms of the U.S. Department of Justice or the
federal OMB's Circular A-110, Attachment N, Paragraph Eight (8).
16. Disputes and Appeals
The department shall make its decision in writing when responding to any disputes, disagreements
or questions of fact arising under this agreement and shall distribute its response to all concerned
parties. The recipient shall proceed diligently with the performance of this agreement according to
the department's decision.
If the recipient appeals the department's decision, it shall be made in writing within twenty-one (21)
calendar days to the secretary of the department, whose decision is final.
If the recipient appeais the department's decision, it also shall be made in writing within twenty-one
(21) calendar days to the department's clerk (agency clerk). The recipient's right to appeal the
department's decision is contained in Chapter 120, Fiorida Statutes, and in procedures set forth in
Rule 28-5.201, Florida Administrative Code. Failure to appeal within this time frame constitutes a
waiver of proceedings under Chapter 120, Florida Statutes.
17. Conferences and Inspection of Work
Conferences may be held at the request of any party to this agreement. At any time, a
representative of the Drug-Free Communities Program or its designee have the privilege of visiting
the project site to monitor, inspect and assess work performed under this agreement.
18. Publication or Printing of Reports
a. Before publication or printing, a final draft of any report required under or pertaining
to this agreement shall be sent to the bureau for its review and comment.
b. Publications or printed reports covered under a. above shall include the following statements
on the cover page:
(1) "This report was prepared for the Florida Office of Drug Control, Drug-Free Communities,
James R. McDonough, Director, in cooperation with the U.S. Department of Justice, and the
Florida Department of Business and Professional Regulation, Florida Division of Alcoholic
Beverages and Tobacco,." The next printed line shall identify the month and year the report was
published.

19. Equal Employment Opportunity (EEO)
No person, on the grounds of race, creed, color or national origin shall be excluded from participation

to Public Law 89-564, Non-Discrimination Requirements of the Anti-Drug Abuse Act of 1988; Title

The State of Florida will not intentionally award publicly-funded contracts to any contractor who
knowingly employs unauthorized alien workers, constituting a violation of the employment provisions
contained in 8 U.S.C. Section 1324a(e) (Section 274A(e) of the Immigration and Nationality Act
("INA")]. The Department shall consider the employment by any contractor of unauthorized aliens
a violation of Section 274A(e) of the INA. Such violation by the Recipient of the employment
provisions contained in Section 274A(e) of the INA shall be grounds for unilateral cancellation of this
Agreement by the Department.
20. Americans with Disabilities Act 1990
Subgrantees must comply with the requirements of the Americans with Disabilities Act (ADA),
Public Law 101-336, which prohibits discrimination by public and private entities on the basis of
disability and requires certain accommodations be made with regard to employment (Title I), state and
local government services and transportation (Title II), public accommodations (Title III), and
telecommunications (Title IV).
21. Non-Procurement, Debarment and Suspension
The recipient agrees to comply with Executive Order 12549, Debarment and Suspension (34 CFR,
Part 85, Section 85.510, Participant's Responsibilities). These procedures require the recipient to
certify it shall not enter into any lower tiered covered transaction with a person who is debarred,
suspended, declared ineligible or is voluntarily excluded from participating in this covered
transaction, unless authorized by the department.
A person or affiliate who has been placed on the convicted vendor list following a conviction for a
public entity crime may not submit a bid on a contract to provide any goods or services to a public
entity, may not submit a bid on a contract with a public entity for the construction or repair of a public
building or public work, may not submit bids on leases of real property to a public entity, may not be
awarded or perform work as a contractor, supplier, subcontractor, or consultant under a contract with
a public entity, and may not transact business with any public entity in excess of Category Two for
a period of 36 months for the date of being placed on the convicted vendor list.
22. Payment Contingent on Appropriation
The State of Florida's performance and obligation to pay under this agreement is contingent upon
an annual appropriation by the Florida Legislature.

23. Federal Restrictions on Lobbying
The recipient agrees to compiy with Section 319 of Public Law 101-121 set forth in "New
Restrictions on Lobbying; Interim Final Rule," pubiished in the February 26, 1990. Federal
Register.
Each person shall file the most current edition of this Certification And Disclosure Form, if appiicable,
with each submission that initiates agency consideration of such person for award of federal
contract, grant, or cooperative agreement of $100,000 or more.
This certification is a material representation of fact upon which reliance was placed when
this agreement was made. Submission of this certification Is a prerequisite to entering into this
agreement subject to conditions and penalties imposed by Section 1352, Title 31, United States
Code. Any person who fails to fiie the required certification is subject to a civil penalty of not less
than $10,000 and not more than $100,000 for each failure to file.
The undersigned certifies, to the best of his or her knowledge and beiief, that:
a. No federally appropriated funds have been paid or shall be paid to any person for infiuencing or
attempting to influence an officer or employee of any federal agency, a member of congress, an

24. Eligibility for Employment in the United States
Recipients must agree to complete and keep on file, as appropriate, the Immigration and
Naturaiization Service Employment Eligibility Form (1-9). This form is to be used by the recipient of
federal funds to verify that persons employed by the recipient, are eiigible to work in the United
States.
25. State Restrictions on Lobbying
In addition to the provisions contained in of Section M, Acceptance and Agreement, the expenditure
of funds for the purpose of lobbying the Legislature or a state agency is prohibited under this
contract. All recipients of a Drug-Free Communities Program grant will be in compliance with
Sections 216.347 and 216.349 of Florida Statutes.
26. Licensure Information and Background Check
In Florida, any entity which provides any prevention or early intervention service related to alcohol
or drug abuse must be licensed according to Chapter 397, Florida Statutes and Administrative

REPORT and any responses that were necessary. (A Statement of Intent may be used by any
agency that would need licenses only if the agency receive the grant award. Agencies in this
circumstance may seek licensure immediately after notification of the grant award). It is also strongly
recommended that all programs targeting juveniles, implemented by other than a sworn law
enforcement officers, conduct background checks on all personnel providing direct services.
Agencies or organizations not currently licensed should contact their Department of Children and
Families Alcohol, Drug Abuse, and Mental Health Program District Office for information prior to
applying forfunds. Application forms and information for licensure are available from the Department
of Children and Families District Prevention Coordinators (See Appendix). Parent groups, civic
organizations, and other interested groups may wish to apply in partnership with a licensed agency.
This would allow such groups to become involved without bearing full responsibility for a grant.
27. Equitable Participation
Describe how your program will overcome the barriers to equal participation and access to the
services offered by your program. This would include teachers, students, and other beneficiaries
of special needs (Le., non-English speaking, women and ethnic minorities, physically challenged
individuals, economically disadvantaged individuals, etc.).

The Office of the Governor, Office of Drug Control has awarded the Miami Beach Police
Department $45,000 for funding its Youth Alcohol Prevention Program.
The Police Department located this grant opportunity on the Internet and determined that a proposal
could be submitted. On January 31, 2001, the Police Department was notified that the Office of Drug
Control was impressed with the proposal and agreed to provide $45,000 in funding. The Office of
Drug Control required the Police Department to prepare a grant application and have it signed and
submitted to them by February 9, 2001. As the City Commission did not meet again until February
21, 2001, retroactive approval is necessary.
The Police Department's Youth Alcohol Prevention Program is designed to decrease the use of
alcoholic beverages by underage persons as well as enforce the laws regarding the unlawful sale of
alcoholic beverages by licensed vendors to underage youths.

The funds will be used to pay for overtime, investigative costs, and the printing and mailing of
literature. The grant will be for the period from acceptance until September 30, 2001. There are no
matching funds required by the City.
It is recommended that the Mayor and City Commission accept the award of $45,000 from the
Office of Drug Control for the Miami Beach Police Department Youth Alcohol Prevention Program.
