A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND THE CITY CLERK
TO EXECUTE AMENDMENT NO. 2 TO THE AGREEMENT WITH OGS DEVELOPMENT,
INC., DATED MAY 30, 2007, TO RE-CONSTRUCT THE NORMANDY SHORES GOLF
COURSE; SAID AMENDMENT PROVIDING FOR THE CONSTRUCTION OF DRAINAGE
INFRASTRUCTURE ON FAIRWAY DRIVE, IN AN AMOUNT NOT TO EXCEED $451,435.00;
USING PREVIOUSLY APPROPRIATED 2000 STORMWATER BOND (428-2323) FUNDS
FOR THE NORMANDY SHORES RIGHT-OF-WAY INFRASTRUCTURE IMPROVEMENT
PROJECT.
WHEREAS, on March 14, 2007, the Mayor and City Commission authorized the Mayor
and City Clerk to execute an Agreement with the firm of QGS Development, Inc. to reconstruct
the Normandy Shores Golf Course, including irrigation and new sod in the swale south of the
pavement in Fairway Drive, pursuant to Invitation To Bid No. 21 -06/07; and
WHEREAS, on May 30, 2007, the City approved Amendment No. 1 to the Agreement
authorizing an alternate irrigation system and an alternative means for draining the greens; and
WHEREAS, the Normandy Shores Right-of-Way Infrastructure Improvement Project
(Project) includes enhanced landscaping, street lighting, repair and extension of existing
sidewalks to comply with ADA requirements, street resurfacing/pavement markings, and
improved stormwater drainage collection, including drainage work and re-grading in the Swale
south of the pavement in Fairway Drive, that overlaps the Golf Course work; and
WHEREAS, the City authorized construction activities for the Project on January 23,
2007, hiring one of the City's Job Order Contract (JOC) contractors; and
WHEREAS, the JOC contractor was scheduled to complete its work in the Fairway Drive
swale before OGS Development was to begin its work in the Swale; and
WHEREAS, the City has since replaced the original JOC contractor for the Project,
which has resulted in a delay of several months to that Project; and
WHEREAS, QGS Development is now ready to work in the Fairway Drive Swale and the
new JOC contractor is not ready; and
WHEREAS, the City and OGS Development have agreed upon a price for the drainage
work and re-grading in the Swale, south of the pavement in Fairway Drive, that is a part of the
Project and overlaps the Golf Course work; and
WHEREAS, the City believes it to be in its best interest to transfer this portion of the
work, along with the necessary funding, from the Project JOC contractor to QGS Development.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission hereby approve and authorize the Mayor and the City Clerk to execute
Amendment No. 2 to the Agreement with QGS Development, Inc., dated May 30, 2007, to re-
construct the Normandy Shores Golf Course; said Amendment providing for the construction of
drainage infrastructure on Fairway Drive, in an amount not to exceed $451,435.00; using
previously appropriated 2000 Stormwater Bond (428-2323) funds for the Normandy Shores
Right-of-Way Infrastructure Improvement Project.

Item Summa /Recommendation:
The City has an Agreement with the firm of QGS Development, Inc. to reconstruct the Normandy Shores
Golf Course including the drainage and irrigation system improvements. This work requires the installation
of irrigation and grass sprigs in the Swale on the south side of Fairway Drive.
The City is using the JOC method for constructing the Normandy Shores Right-of-Way Infrastructure
Improvement Project, which includes enhanced landscaping, street lighting, repair and extension of
existing sidewalks to comply with ADA requirements, street resurfacing/pavement markings, and improved
stormwater drainage collection, including drainage work and re-grading in the Swale south of the pavement
in Fairway Drive that overlaps the golf course work.
The drainage work and re-grading in the Swale, that is part of the JOC work, needs to be completed before
the installation of irrigation and grass sprigs that is part of the Golf Course contract.
As the Right-of-Way Infrastructure Improvement Project has been delayed, the City wishes to transferthe
drainage work and re-grading in the Fairway Drive Swale to the Golf Course contract.
The previously appropriated funding in the Normandy Shores Right-of-Way Improvement Project will still
be used to construct these improvements.

ADMINISTRATION RECOMMENDATION
Approve and authorize execution of the amendment.
FUNDING
$451,435 in 2000 Stormwater Bond Account number 428-2323-060357 previously
appropriated for the Normandy Shores Right-of-Way Infrastructure Improvement Project.
ANALYSIS
On March 14, 2007, the City approved Invitation to Bid No. 21-06/07, authorizing the Mayor
and City Clerk to execute an Agreement with the firm of QGS Development, Inc. to
reconstruct the Normandy Shores Golf Course including the drainage and irrigation system
improvements. This work requires the installation of irrigation and grass sprigs in the swale
on the south side of Fairway Drive.
On January 23, 2007, the City selected a Job Order Contractor (JOC) for the Normandy
Shores Right-of-Way Infrastructure Improvement Project and authorized construction, which
included enhanced landscaping, street lighting, repair and extension of existing sidewalks to
comply with ADA requirements, street resurfacing/pavement markings, and improved
stormwater drainage collection, including drainage work and re-grading in the Swale south of
the pavement in Fairway Drive that overlaps the golf course work.
The JOC contractor was scheduled to complete its work in the Fairway Drive Swale before
QGS Development was to begin its work in the Swale. This was necessary as the installation
of drainage structures and re-grading needed to occur before the installation of the intgation

and grass sprigs. However, the City replaced the original JOC contractor for the Normandy
Shores Right-of-Way Infrastructure Improvement Project, which resulted in a delay of
several months to the infrastructure work.
OGS Development is now ready to work in the Fairway Drive Swale. The irrigation system
has been installed on the golf course except for the segments that are in the Swale on the
south side of Fairway Drive. The new JOC contractor for the Right-of-Way Infrastructure
Improvement Project is just beginning work. Additionally, the new JOC Contractor has been
asked to focus its efforts on South Shore Drive first. Therefore, the City wants to transferthe
work in the Swale on the south side of Fairway Drive from the JOC Contractor to QGS
Development.
The City and OGS Development have negotiated and agreed upon a price for the drainage
work and re-grading in the Swale south of the pavement in Fairway Drive that is a part of the
Right-of-Way Infrastructure Improvement Project and overlaps the golf course work.
A direct cost comparison, line item byline item for the proposal is not possible, due to the
JOC pricing methodology and the manner in which OGS, which was awarded the project
through a competitive bid, presents their pricing. However, the CIP Office has thoroughly
reviewed OGS' total proposal and compared it to the total value established in the original
JOC contractor schedule of values forthe work in question. This review and evaluation has
shown that the two total values are similar and that to the cost for the work would be the
same had the installations been completed by the original JOC Contractor or the
replacement contractor for the ROW project.
The JOC contract format includes hundreds of line items, since each material and labor cost
is broken down to many specific units and therefore is not really possible to compare them to
a detailed level with a standard bid proposal. However, CIP staff evaluated the total scope
by taking into account the number of linear feet of drainage pipe for different sizes, the
number of drainage structures involved, the cost of trenching, base material for piping,
backfilling and restoration for the trenches, the amount of labor involved, equipment, etc.
and using industry standards, experience and other estimating means, determined what the
value in the JOC proposal should be if described in a number of line items that would be
comparable to a standard construction schedule of values.
CIP also evaluated this total cost and determined its validity priorto then evaluating the OGS
proposal. It is important to note that the original JOC proposal had been thoroughly
evaluated also by CIP staff and the staff of the City's Program manager, Hazen & Sawyer
and found to be acceptable. Finally, CIP evaluated the OGS proposal and negotiated a
value that is comparable in total to the accepted JOC proposal and within industry standards
for the type of work. The original proposal from OGS was for $496,578 which was close to
the value in the JOC proposal. CIP then negotiated with OGS and obtained the final value
of $451,435 which is presented in this memo and is deemed acceptable for the proposed
installations.
CONCLUSION
The Administration recommends that the City transfer this portion of the work along with the
necessary funding, in the amount of $451,435, from the Right-of-Way Infrastructure
Improvement Project to the Golf Course Reconstruction Project.
