2008-26752 ResoRESOLUTION NO. 2008-26752 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, GRANTING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A UTILITY EASEMENT IN FAVOR OF FLORIDA POWER AND LIGHT (FPL), TO PROVIDE ELECTRICAL SERVICE FOR AN UNDERGROUND DUCT BANK TO SERVE THE NEW STORMWATER PUMP STATION, INCLUDED AS PART OF THE BELLE ISLE NEIGHBORHOOD RIGHT OF WAY IMPROVEMENT PROJECT, BID PACKAGE NO. 13B. WHEREAS, in August 2005, construction documents prepared by Jacob Edwards and Kelcey (formerly known as Edwards and Kelcey), were issued by the City, along with a request for a cost proposal from the Job Order Contractor (JOC), Alpine Construction Management Corporation (Alpine), for the construction of the Belle Isle Neighborhood Right of Way (ROW) Improvement Project, Bid Package No. 136 (Project); and WHEREAS, the scope of services that were outlined in the proposal for the Project included the installation of water mains; storm drainage system and pump station; street lighting; roadway reconstruction, including milling and resurfacing; parking; traffic signage and pavement marking; and landscape and irrigation; and WHEREAS, the scope of services for the improvements to the Belle Isle Park included re-grading of the entire Park, landscaping, irrigation, site furnishings, pedestrian lighting, a "bark- park", and new walkways within the park; and WHEREAS, on December 2, 2005, following extensive negotiations, the final cost proposal for the construction of the Project, in the amount of $5,603,638, was accepted by the City; and WHEREAS, on May 16, 2006, the City issued the Second Notice to Proceed (NTP) on the Project which allowed Alpine to mobilize on the site; and WHEREAS, the right-of-way improvements were completed prior to the end of November 2007, and the stormwater system, comprised of numerous stormwater structures, piping, drainage wells, and pump station, is ninety percent (90%) complete; and WHEREAS, Alpine is currently working toward completing the improvements within the Park, and placing the pump station into operation by July of 2008; and WHEREAS, the pump station constructed at the northwest corner of Belle Isle Park, requires an electrical service point of connection; and WHEREAS, it will be necessary to provide a new electrical service to the stormwater pump station through the Park, via a transformer serving the existing sanitary pump station, located at the northeast corner of the Park; and WHEREAS, the survey of the proposed location, including the legal description, have been completed; and WHEREAS, the City needs to grant FPL a utility easement to install the pumps, and place the stormwater system into service at Belle Isle, prior to the start of the rainy season; and WHEREAS, no funding is required to grant FPL the required easement. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby grant and authorize the Mayor and City Clerk to execute a utility easement in favor of Florida Power and Light (FPL), to provide electrical service for an underground duct bank to serve the new stormwater pump station, included as part of the Belle Isle Neighborhood Right-of-Way Improvement Project, Bid Package No. 13B. The Right- of-Way improvements were completed prior to the end of November 2007, and the stormwater system is ninety percent complete. The contractor is currentlyworking towards completing the improvements within the park, and placing the pump station into operation by July of 2008. The pump station constructed at the northwest corner of Belle Isle Park, requires an electrical service point of connection. Consequently, it will be necessary to provide a new electrical service point to the stormwater pump station through the park, via an existing transformer serving the existing sanitary pump station located at the northeast corner of the Park. The proposed location of the duct bank has been identified, and the survey of the location, including the Legal Description, completed. FPL requires that the City record the easement prior to their scheduling and placement of their electrical service. Therefore there is a need to grant FPL the utility easement. This work is critical to the installation and "start-up" of the pumps, and placement of the stormwater system into operation at Belle Isle prior to the start of the rainy season. The Right-of-Way improvements were completed priorto the end of November 2007, and the stormwatersystem, comprised of numerous stormwaterstructures, piping, drainage wells, and pump station, is ninety percent (90%) complete. The remaining work is associated with the connection of 24-inch stormwater lines to the east and west outtalls, located in the vicinity of the Venetian Causeway, and the start-up of the pumps. The contractor is currently working toward completing the improvements within the Park, and placing the Pump Station into operation by July of 2008. Belle Isle -FPL easement February 13, 2008 Page 2 of 2 The Pump Station constructed at the northwest corner of Belle Isle Park, requires an electrical service point of connection. The service point of connection originally contemplated is via an FPL manhole located within the Island Avenue South Right-of-Way. However, during the process of coordinating with FPL, it was determined that this point of connection was not feasible. Consequently, it will be necessary to provide a new electrical service to the stormwater Pump Station through the park, via a transformer serving the existing sanitary pump station located at the northeast comer of the Park. Therefore there is a need to grant FPL the utility easement. The proposed location of the duct bank has been identified, and the survey of the location, including the Legal Description, completed (Attachment 1). Although the excavation for the placement of the conduits has commenced, FPL requires the City to record the easement prior to their scheduling and placement of their electrical service. The placement of the electrical service is critical to the installation and "start-up" of the pumps, and placement of the stormwater system into service at Belle Isle prior to the start of the rainy season. CONCLUSION The Administration recommends that the Mayor and City Commission of the City of Miami Beach, Florida, approve and authorize the Mayor and City Clerk to record a utility easement in favor of Florida Power and Light, within the Belle Isle Park, for the placement of an electrical duct bank to serve the stormwater Pump Station, included as part of the Belle Isle Neighborhood Right of Way (ROW) Improvement Project, Bid Package No. 136.
