2008-26763 ResoRESOLUTION NO. 2008-26763 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE AMENDMENT NO. 3 TO THE EXISTING AGREEMENT WITH ARCHITEKNICS, INC., FOR DEMOLITION DESIGN, DESIGN, AND CONSTRUCTION ADMINISTRATION OF A REPLICA CLUB HOUSE AT THE NORMANDY SHORES GOLF COURSE, IN A NEGOTIATED AMOUNT NOT TO EXCEED $145,500; WITH FUNDING AVAILABLE AS FOLLOWS: $62,000 FROM CAPITAL RESERVE ACCOUNT 304-2273-061357 APPROPRIATED IN THE CAPITAL BUDGET FISCAL YEAR 2007/2008 FOR DESIGN; $83,500 FROM CAPITAL RESERVE ACCOUNT 304-2273-000356 APPROPRIATED IN THE CAPITAL BUDGET FISCAL YEAR 2007/2008 FOR CONTINGENCY TO BE TRANSFERRED TO DESIGN. WHEREAS, the Fiscal Year (FY) 2006-2007 Capital Budget appropriated funding for the construction of the new Normandy Shores Golf Course cart barn building; the renovation of the maintenance building and construction of a new chemical storage building and sand containment bins; the construction of two restroom buildings; and the renovation of the club house; and WHEREAS, on May 10th, 2006, in accordance with Resolution No. 2006-26198, the Mayor and City Commission approved an Agreement with Architeknics, Inc. for design services for the aforestated work; and WHEREAS, on May 10th, 2006, in accordance with Resolution No. 2006-26197, the Mayor and City Commission approved an Agreement for Pre-Construction Services with Coastal Construction Company, to provide value engineering, constructability, and cost estimating assistance to Architeknics, Inc.; and WHEREAS, on May 10th, 2006, in accordance with Resolution No. 2006-26197, the Mayor and City Commission approved Amendment No. 2-A to the Agreement with Coastal Construction Company for partial demolition services at the club house; and WHEREAS, this partial demolition exposed structural problems and existing conditions that differed from record drawings; and WHEREAS, additional inspections that involved removing walls, cutting holes in the floor, and exposing structural elements determined that the structural integrity of the building is substandard; and WHEREAS, the City believes it to be more cost effective and less subject to delay if the existing structure is completely demolished and a replica structure is built; and WHEREAS, at its February 5, 2008 meeting, the Design Review Board approved the demolition of the existing structure and the construction of a replica; and WHEREAS, the CIP Office seeks authority to negotiate and execute the Amendment for a negotiated amount not to exceed $218,500, with Architeknics, Inc., for design and construction administration of a replica club house, inclusive of the $73,000 remaining in the Purchase Order, for a total maximum new fee of $145,500. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission hereby approve and authorize the Mayor and the City Clerk to execute Amendment No. 3 to the Agreement with Architeknics, Inc., dated August 2, 2007, for design of new restrooms, a cart barn, and renovation of the club house and maintenance facility at the Normandy Shores Golf Course; said Amendment for design and construction administration of the club house, in a negotiated amount not to exceed $145,500; with funding available as follows: $62,000 from the Capital Reserve Account 304-2273-061357 appropriated in the Capital Budget Fiscal Year 2007/2008 for design, and $83,500 from Capital Reserve Account 304-2273-000356 appropriated in the Capital Budget Fiscal Year 2007/2008 for contingency to be transferred to design. The Agreement with Architeknics, Inc. was amended to include further investigation of the structural condition of the Club House, while the Agreement with Coastal Construction Company was amended to include the partial demolition of the Club House. The City executed an Amendment with Coastal Construction Company for the partial demolition of the portions of the Club House that did not conform to the original building and for the interiors. It was during this partial demolition that several unexpected conditions and deficiencies were identified. Further and more detailed inspections, that involved removing existing walls and ceilings, cutting holes in the floor slab, and exposing structural elements, determined that the stability and overall structural integrity of the building are substandard. It was also discovered that many of the required structural elements were never constructed in accordance with the existing documents at the time. In addition, the demolition exposed significant deterioration in many areas that require rehabilitation or replacement. At the December 12, 2007 Commission meeting, the Commission referred this issue to the Finance and Citywide Projects Committee where the various options were discussed. The Committee recommended staff proceed to the Design Review Board (DRB) with a proposal to construct a replica Club House and to omit the planning phase if approved. On February 5, 2008, the DRB approved the plan put forward by the City to demolish the Normandy Shores Club House and build a replica. The value of the amendments is still being negotiated and should be lower than the not to exceed amounts presented in this memorandum. Funding for these additional services will be allocated from previously appropriated funds in the Capital Budget. FUNDING Funding is available as follows: $62,000 from Capital Reserve account 304-2273-061357 appropriated in the Capital Budget Fiscal Year 2007/2008 for Design; $83,500 from Capital Reserve account 304-2273- 000356 appropriated in the Capital Budget Fiscal Year 2007/2008 for Contingency to be transferred to Design; $130,000 Capital Reserve account 304-2273-067357 appropriated in the Capital Budget Fiscal Year 2007/2008 for Construction. A request to replenish the Contingency and Construction will be part of the Fiscal Year 2008-2009 Capital Budget. Amounts on the proposals are not to exceed and are currently being negotiated. ANALYSIS The existing Normandy Shores Golf Course Club House is a one-story structure built on concrete piles with an elevated concrete slab floor and joist construction. The walls are of masonry construction, and the roof has wood trusses and rafters with tongue and groove decking. Both the Clubhouse and golf course have been closed for several years. The golf course is presently being renovated and is expected to be ready for play in the fall of 2008. Several ancillary buildings on the Commission Memorandum -Normandy Shores Club House February 13, 2008 Page 2 of 3 golf course are now being built or renovated in anticipation of the fall of 2008 opening of the golf course. The City intended to have the existing Club House renovated in time for a fall 2008 opening, as well. To that end, On May 10, 2006, the City of Miami Beach executed an Agreement with Architeknics, Inc. (Architeknics) to design the renovation of the Club House and executed an Agreement with Coastal Construction Company (Coastal) for pre-construction services for the Club House. Working as the Construction Manager at Risk (CMR), Coastal would collaborate with Architeknics during the project design phase, provide value engineering, and prepare constructability reviews. The City would then issue a request for a Guaranteed Maximum Price (GMP) from Coastal Construction Company that would be negotiated and placed before the City Commission for its approval. To meet this schedule, on May 7, 2007, the City also executed an Amendment with Coastal for the partial demolition of the portions of the Club House that did not conform to the original building and for the interiors. It was during this partial demolition that several unexpected conditions and deficiencies were identified. It should be noted that these deficiencies were unknown before the demolition as the existing record drawings for the building do not match the field conditions and did not show the deficiencies discovered. Typically, plans are produced at the end of a project to reflect "as-built" field conditions. In this case, the "as-built" records do not match what was built and do not reveal the deficiencies that were found. Based on further and more detailed inspections that involved removing existing walls and ceilings, cutting holes in the floor slab, and exposing structural elements, it was determined that the stability and overall structural integrity of the building are substandard. These inspections determined that the majority of the existing structural elements in the Club House do not comply with minimum requirements of the high velocity hurricane zones sections of the Florida Building Code. It was also discovered that many of the required structural elements were never constructed in accordance with the existing documents at the time. In addition, the demolition exposed significant deterioration in many areas that require rehabilitation or replacement. Staff first proposed renovating the Club House with a design that would restore the original footprint. This would also address concerns about expanded scope resulting from additional public comment and restrict the scope to a level that could be accommodated by the project budget. Previous public requests included a large community room, a gymnasium, and greatly expanded kitchen and restaurant facilities. The proposed replica Club House will accommodate a pro shop, locker rooms, a dining room, a bar area, a grand foyer, a kitchen, and offices. When the renovation proposal was presented at the December 12, 2007 City Commission meeting, the City Commission referred this issue to the Finance and Citywide Projects Committee where various available options were discussed. The Committee then recommended that staff proceed to the Design Review Board (DRB) with a proposal to demolish the existing facility completely, construct a replica Club House, and to omit a new planning phase if approved. On February 5, 2008, the DRB approved the proposed plan put forward by the City to demolish the Normandy Shores Club House and build a replica. Should the City Commission approve this new scope of work, it is estimated that the modified project cost for the new building will be +/-$3,650,000. This includes the not-to-exceed fee for Architeknics, Inc. for the design of the demolition, for the design of the replica, and for additional construction administration services in the not to exceed amount of $218,500, which is currently being negotiated by staff and should be lower in total (Attachment). This amount includes a fee for the preparation of documents to obtain a demolition permit and for the preparation of construction documents to obtain the construction permit. The not to exceed amount is also inclusive of the Commission Memorandum -Normandy Shores Club House February 13, 2008 Page 3 of 3 remaining funds in the Architeknics Purchase Order for the Club House, in the amount of $73,000, therefore lowering the total new fee required to a maximum of $145,500 for a total new proposed fee of $218,000 which will be negotiated. The total cost for the project also includes the not-to-exceed fee for Coastal for the complete demolition of the facility and additional pre-construction services in the amount of $130,000, which is also being negotiated by staff and should be lower in total as well. Construction value of the replica is estimated at this time to be +/-$3,200,000 with completion of the facility in the fall of 2009. The final construction schedule and value will not be fully determined until the consultant provides a final set of construction documents which will then be used by Coastal to provide an initial GMP proposal that will be negotiated prior to recommending it to the City Commission for award. The consultant has stated that the final set of construction documents could be submitted to the City in three months for review and comments by the CIP Office and the appropriate regulatory agencies. After the review is completed and the GMP negotiations finalized and approved by the City Commission, a Notice to Proceed to construction will be provided to Coastal. The complete demolition of the facility will commence upon approval by the City Commission of the proposals presented in this memorandum. CONCLUSION The Administration recommends approval of these Amendments for design, in the not to exceed amount of $145,500, and, in the not to exceed amount of $130,000, for pre-construction services and complete demolition, which require the continued services of Architeknics, Inc. and Coastal Construction Company in accordance with the order of the Design Review Board for the complete demolition of the existing Club House and construction of a replica at the Normandy Shores Golf Course. Funds have been previously appropriated in the Capital Budget.
