2008-26774 ResoRESOLUTION NO. 2008-26774 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, GRANTING AND AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE AN EASEMENT IN FAVOR OF FLORIDA POWER AND LIGHT, FOR THE PLACEMENT OF A TRANSFORMER AND ASSOCIATED UNDERGROUND ELECTRICAL CONDUITS THAT SERVE THE NEW CART BARN BUILDING AT THE NORMANDY SHORES GOLF COURSE. WHEREAS, on May 10, 2006, in accordance with Resolution 2006-26197, the Mayor and City Commission approved an agreement for pre-construction services with Coastal Construction Company (Coastal), to provide value engineering, constructability, and cost estimating assistance to Architeknics, Inc. for the construction of the new Normandy Shores Golf Course cart barn building; the renovation of the maintenance building and the construction of a new chemical storage building and sand containment bins; the construction of two restroom buildings; and the renovation of the club house (the Project); and WHEREAS, on June 6, 2007, in accordance with Resolution No.2007-26570, the Mayor and City Commission approved an agreement between the City, and Coastal for construction management at risk services (for a negotiated guaranteed maximum price) for the Project; and WHEREAS, this work required coordinating power requirements with FPL for the new cart barn building; and WHEREAS, FPL determined that the power requirements were such that a new transformer would be needed adjacent to the cart barn building and as a result, FPL has requested that the City grant an easement to it in order to service this transformer and it's associated electric conduits; and WHEREAS, it was determined that no easements had ever been recorded for the placement of a transformer and the associated underground electrical conduits adjacent to the new cart barn; and WHEREAS, the Administration would accordingly recommend that the Mayor and City Commission approve the granting, and execution by the Mayor and City Clerk, of an easement to FPL, for the placement of the transformer and associated underground electrical conduits that serve the new cart barn building at the Normandy Shores Golf Course. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission hereby grant and authorize the Mayor and the City Clerk to execute an easement in favor of Florida Power and Light, for the placement of a transformer and' underground electrical conduits that serve the new cart barn building at the Normandy Shores Golf Course. This work required coordinating power requirements with FPL for the new cart barn building. FPL determined that the power requirements were such, that new transformers would be needed adjacent to the cart barn building. As a result, FPL requires the City to record an easement in order to service this transformer and their associated electric conduits. FPL is requiring the City to record an easement over for this facility. The CIP Office had a survey prepared that describes the easement to be recorded per FPL requirements, attached as Attachment I and Attachment II. CONCLUSION The Administration recommends that the City record the easement for FPL in order to power the cart barn facility.
