2008-26786 ResoRESOLUTION NO. 2008-26786 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA OPPOSING FLORIDA SENATE BILL 2432 THAT WOULD PROHIBIT COUNTIES AND MUNICPALITIES FROM CHARGING FEES OR SEEHING REIMBURSEMENT FOR THE USE OF EARLY RESPONDER SERVICES. WHEREAS, local governrnents provide many emergency first responder services to the public with regazd to motor vehicle accidents, fire, and other life threatening emergencies; and WHEREAS, local governments currently aze permitted to seek reimbursement for the costs and expenses that may be incurred involving the use of police, fire, and other emergency responder services, including personnel, supplies, or equipment in responding to emergencies; and WHEREAS, proposed Senate Bi112432 would prohibit counties and municipalities from chazging fees or seeking reimbursement for expenses incurred for early responder emergency services; and WHEREAS, the Mayor and the City Commission of the City of Miami Beach oppose Senate Bi112432 and direct the City Administration to instruct the City's State lobbyists to seek the defeat of this proposed legislation and, alternatively, if Bill 2432 is passed, urge the Florida legislature to allow local governments to seek reimbursement for early responder services and expenses from other sources including Medicare, Medicaid, and private insurance companies. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that Senate Bill 2432, which would prohibit counties and municipalities from charging early responder fees or seeking reimbursement for the expenses incurred for early responder services, is hereby opposed and the City Administration is hereby directed to instruct the City's lobbyists to seek the defeat of this legislation and, alternatively, if Bill 2432 is passed, urge the Florida legislature to allow local governments to seek reimbursement for early responder services and expenses from other sources including Medicare, Medicaid, and private insurance companies. Section 125.01045, Florida Statutes, is created 11 to read: 12 125.01095 Prohibition of fees for police, fire, and other 13 emergency responders.--A county may not charge a fee or seek 14 reimbursement for any costs or expenses that may be incurred 15 involving the use of police, fire, and other emergency responder 16 services, personnel, supplies, motor vehicles, or equipment in 17 responding to a motor vehicle accident, fire, or other emergency. 18 Section 2. Section 166.0946, Florida Statutes, is created 19 to read: 20 166.0496 Prohibition of fees for police, fire, and other 21 emergency responders.--A municipality may not charge a fee or 22 seek reimbursement for any costs or expenses that may be incurred 23 involving the use of police, fire, and other emergency responder 29 services, personnel, supplies, motor vehicles, or equipment in 25 responding to a motor vehicle accident, fire, or other emergency. 26 Section 3.
