2001-24296 RESO RESOLUTION NO. 2001-24296 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RETROACTIVELY APPROVING AND AUTHORIZING THE PLACEMENT OF ONE HUNDRED AND FORTY (140) BANNERS FOR THE WINTER PARTY, IN MIAMI BEACH FROM MARCH 8, 2001, TO MARCH 12, 2001, AS REQUESTED BY THE APPLICANT AT THE FOLLOWING LOCATIONS: MCARTHUR CAUSEWAY, FROM THE COAST GUARD STATION TO ALTON ROAD; ALTON ROAD, EXIT SOUTH (CORNER TRAFFIC LIGHT); 5TH STREET, BETWEEN ALTON ROAD AND OCEAN DRIVE; COLLINS AVENUE, BETWEEN 12TH AND 18TH STREET; WASHINGTON AVENUE, BETWEEN 8TH AND 15TH STREET; 17TH STREET; BETWEEN WASHINGTON AVENUE AND ALTON ROAD; ALTON ROAD, BETWEEN 17TH STREET AND 13TH STREET; SAID BANNERS TO BE AFFIXED TO LIGHT POLES IN THE PUBLIC RIGHT-OF-WAY, MEASURING 3'X7' AND HAVING A COpy AND DESIGN AS SHOWN ON THE ATTACHED DRAWING; TO BE INSTALLED AND REMOVED IN ACCORDANCE WITH ALL OTHER APPLICABLE CITY REQUIREMENTS; THE ADMINISTRATION FURTHER RECOMMENDS THAT THESE BANNERS BE INSTALLED NO EARLIER THAN MARCH 2, 2001, AND REMOVED BY MARCH 13,2001. WHERE;\S, the Winter Party (Applicant) was held on March 8, 2001, through March 12, 2001, III the City of Miami Beach; and WHEREAS, in order to publicize the event and draw attention of the media and the pubhc at large, the Applicant has requested light pole banners measuring 3 feet by 7 feet; and ' . I no ... , NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein retroactively approve and authorize the placement of one hundred and forty (140) banners for the Winter Party, to be held in the City of Miami Beach, March 8,2001, to March 12, 2001, as requested by the applicant at the following locations: McArthur Causeway, from the Coast Guard Station to Alton Road; Alton Road, exit south (comer traffic light); 5th Street, between Alton Road and Ocean Drive; Collins Avenue, between 12th and 18th Street; Washington Avenue, between 8th and 15th Street; 17th Street; between Washington Avenue and Alton Road; Alton Road, between 17th and 13th Street; said banners to be affixed to light poles in the public right- of-way, measuring 3'xT and having a copy and design as shown on the attached drawing; and to be installed and removed in accordance with all other applicable City requirements; the Administration further recommends that these banners be installed no earlier than March 2,2001, and removed by March 13, 2001. Ronnie Singer, Executive Assistant to th~ ~i~Manager ~ Maggie Fernandez, Special Events Liais~ March 2, 2001 Winter Party Light Post Banners The City of Miami Beach Code requires that the City Commission approve, via resolution, the number, placement and design of all citywide light post banners. Since its codification, no banner resolution has ever been denied by the City Commission. Due to miscommunication between the Winter Party and AAA Banners, the Winter Party light post banner paperwork, after approval of the City's Design Review, was not submitted to the Special Events Office and the resolution approving the banners was never placed on the Commission agenda. The Winter Party event is on March 11, 2001 and the next Commission meeting is on March 14, 2001. Therefore, there is no way of getting a resolution approved by the Commission before the event. After consulting with the Legal Department, a possible solution was found. Legal recommended that the City Manager, if he/she deemed appropriate, could administratively approve the light post banners for the Wmter Party and place it on the next Commission meeting for retroactive approval. The Winter Party, a fundraising dance party for the Dade Human Rights Foundation, has been produced in Miami Beach for the past seven years and began placing light post banners throughout the City last year. ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS The City Code Section 82-411 (d) requires that the City Commission approve the installation of temporary banners which reads, in part: (1) The right to install, as well as the number, location and method of installation of banners shall be subject to the design review process and approved by the City Commission and the Public Works Department. AGENDA ITEM C 7 M DATE 3.(1'-01 Commission Memorandum March 14, 2001 The Winter Party Page 2 (2) Banners shall not exceed three feet in width by seven feet in length. Banners may be double- sided. The color, design and material of all banners shall be approved under the design review process. (3) Banners announcing special events either to be held in city or to be associated in some manner with the city, as determined by the City Commission, may be erected up to 30 days prior to the event being announced and must be removed within seven days after such event. Special event banners shall require approval by the City Commission. (4) A perfonnance bond shall be required to ensure the removal of the banners in case of advanced deterioration of the banners, or if a dangerous condition presents itself, the city may at its sole discretion direct banners to be removed at any time. The purpose of the banners is to promote and welcome participants of The Winter Party. The Wmter Party is the signature fundraiser for the Dade Human Rights Foundation. The Winter Party is celebrating its 8th year in the City of Miami Beach, and relies on these banners to help publicize the event. Due to miscommunication between the Winter Party and AAA Banners, the Winter Party light post banner paperwork, after approval of the City's Design Review, was not submitted to the Special Events Division and the resolution approving the banners was never placed on the Commission agenda. The City Commission should retroactively approve the installation of the subject light pole banners for The Winter Party, previously held in the City of Miami Beach, from March 8,2001 to March 12, 2001.
