A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE ISSUANCE OF
A REQUEST FOR QUALIFICATIONS FOR THE COMPLETION OF
FINAL DESIGN/ENGINEERING PLANS FOR A MODIFIED ROADWAY
PROJECT ON COLLINS A VENUE, FROM 5TH TO 15TH STREETS, IN AN
AMOUNT NOT TO EXCEED $134,480, TO BE FUNDED AS PART OF A
JOINT PARTICIPATION AGREEMENT (JPA) BETWEEN THE CITY AND
THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT), IN THE
AMOUNT OF $2,568,676.61, IN STATE AND FEDERAL FUNDS, AS
APPROVED BY RESOLUTION NO. 2000-23944, DA TED MAY 24, 2000;
AND FURTHER AUTHORIZING THE APPROPRIATION OF $134,480
FROM THE GENERAL FUND UNDESIGNA TED FUND BALANCE, FOR
SUBSEQUENT REIMBVRSEMENT BY FDOT, UNDER THE PROVISIONS
OF THE JPA.
WHEREAS, approximately one year ago, the City assumed the lead role in final design and
implementation of a to-be-modified roadway project for A1NCollins Avenue, from 5th to 15th
Streets (the Project), which impetus is to minimize impacts to, and better serve the needs of the Art
Deco Historic District and its stakeholders; and
WHEREAS, this mutual agreement between the City and the Florida Department of
Transportation (FDOT) was made official by Resolution No. 2000-23944, dated May 24, 2000,
which also approved both a Joint Participation Agreement (JP A) for the State funds, in the amount
of $2,055,610.61, and a Local Agency Program Agreement (LPA) for the Federal funds, in the
amount of $513,066.00, to be transferred to the City for the purposes of the Project; and
WHEREAS, the Project is fully funded by State and Federal sources, with no local match
requirements; and
WHEREAS, as part of the mutual agreement, the Project's construction was rescheduled
from Fiscal Year 2000-01 to 2002-03, in order to return the original FDOT plans from the present
65% completion level back to the 30% level, to incorporate the changes and additions required by
the City; and
WHEREAS, in order to meet the new construction schedule, the Administration wishes to
issue a Request for Qualifications (RFQ) for the Project's final design/engineering phase, which also
includes a public involvement component; and
WHEREAS, City funds, in the amount of $134,480, need to be appropriated for the purposes
of this RFQ, for subsequent reimbursement by FDOT, under the provisions of the JP A.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby authorize the issuance of a Request for Qualifications (RFQ) for the completion
of final design/engineering plans for a modified roadway project on Collins A venue, from 5th to 15th
Streets, in an amount not to exceed $134,480, to be funded as part of a Joint Participation Agreement
(JP A) between the City and the Florida Department of Transportation (FDOT), in the amount of
$2,568,676.61, in State and Federal funds, as approved by Resolution No. 2000-23944, dated May
24,2000; and further authorize the appropriation of $134,480 from the General Fund Undesignated
Fund Balance, for subsequent reimbursement by FDOT, under the provisions of the JPA.

SUMMARY SCOPE OF SERVICES
FOR CONSULTING ENGINEERING SERVICES
COLLINS A VENUE ROADWAY PROJECT, FROM 5TH TO 15TH STREETS
THE MAJOR ELEMENTS OF THE SCOPE OF SERVICES ARE AS FOllOWS:
1. Preparation of construction plans for a drainage, milling, resurfacing, lighting, signalization
and signage, and minor landscaping project for Collins A venue, from 5th to 15th Street, per
City specifications.
2. The consultant will return the existing FDOT plans to the 30% level, and complete the plans
according to the Scope of Services to be provided by the City, as part of the RFQ packet.
3. A minimum of sixteen (16) deep wells will be included in the plans to address poor drainage
conditions at critical intersections.
4. New traffic signals will be planned and designed for the intersections of Collins A venue at
7th Street and 13th Street, due to the presence of public parking garages and intense
pedestrian activity. Plans will also be prepared for the existing signals in order to ensure
proper synchronization.
5. Special lighting will be planned, reflective of the historic district's character.
6. The plans will incorporate the limited one-way scheme developed by the City for the crossing
streets, in order to a) improve traffic flow in the area by complementing the approved Ocean
Drive traffic management plan; b) increase pedestrian safety; and c) help maximize on-street
parking opportunities.
7. The plans will include minimum streetscaping of the corridor, where feasible.
8. Consultant will also submit the plans for approval by all pertinent permitting agencies.
9. The entire process shall not take longer than twelve (12) months to complete.

THE MAYOR AND CITY CLERK TO EXECUTE BOTH A JOINT
PARTICIPATION AND REIMBURSEMENT AGREEMENT AND A LOCAL
AGENCY PROGRAM AGREEMENT WITH THE FLORIDA DEPARTMENT
OF TRANSPORTATION, TRANSFERRING THE IMPLEMENTATION OF
A ROADWAY PROJECT AND ITS LIGHTING COMPONENT TO THE
CITY, ALONG WITH A COMBINED $2,568,676.61 IN STATE AND
FEDERAL FUNDS, FOR THE FINAL DESIGN, CONSTRUCTION, AND
CONSTRUCTION INSPECTION PHASES OF AlA/COLLINS AVENUE,
FROM 5TH STREET TO 15TH STREET; AND FURTHER
ACKNOWLEDGING THAT CITY FUNDS WILL BE APPROPRIATED FOR
THE PROJECT, IN THE RESPECTIVE FISCAL YEAR(S) THE FUNDS
WILL BE NEEDED, FOR SUBSEQUENT REIMBURSEMENT BY FDOT,
IN ACCORDANCE WITH THE PROVISIONS OF THE AGREEMENTS.
WHEREAS, the Florida Department of Transportation (FOOT) programmed a roadway
reconstruction project for AlA/Collins Avenue, from 5th to 15th Street (the Project); and
WHEREAS, the Project was supposed to be constructed in Fiscal Year 2000-01 and take
approximately fourteen (14) months to complete; and
WHEREAS, the City requested that major changes and additions be made to the Project
plans, to minimize impacts to and better serve the needs of the Art Deco Historic District; and
WHEREAS, the City also requested that the Project construction be rescheduled to Fiscal
Year 2002-03; and
WHEREAS, after negotiations between the City and FOOT, it was mutually agreed that, in
the best interest ofall stakeholders and to ensure timely completion of the Project, the City should
assume the lead role in the design and implementation of same; and
WHEREAS, in order for the dedicated State and Federal funds to be transferred to the City
for the purposes of the Project, a Joint Participation and Reimbursement Agreement, and a Local
Agency Program Agreement for its lighting component, respectively, must be executed by the City
and FOOT, prior to June 30, 2000; and
WHEREAS, at future City Commission meetings, the City shall appropriate and advance
funds for the Project, in the respective fiscal year(s) the funds will be needed, for subsequent
reimbursements by FOOT; and
WHEREAS, such reimbursements shall be made by FOOT within forty (40) days of
receiving appropriate invoices from the City, for the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission approve and authorize the Mayor and City Clerk to execute both a Joint Participation
and Reimbursement Agreement and a Local Agency Program Agreement with the Florida
Departmcnt of Transportation, transferring the implementation of a roadway project and its lighting
component to the City, along with a combined $2,568,676.61 in State and Federal funds, for the final
design, construction, and construction inspection phases of AlA/Collins Avenue, from 5th Street
to 15th Street; and further acknowledge that City funds will be appropriated for the project, in the
respective fiscal year(s) the funds will be needed, for subsequent reimbursement by FDOT, in
accordance with the provisions of the Agreements.

Milling and Resurfacing Agreement for Collins Avenue
This AGREEMENT, made and entered into this day of 2000, by and
between the State of Florida, Department of Transportation, hereinafter referred to as the
DEPARTMENT, and the City of Miami Beach, a political subdivision of the State of
Florida, hereinafter referred to as the CITY.
WITNESSETH
WHEREAS, the DEPARTMENT has a roadway project scheduled for Collins
Avenue between the limits of 5th to 15th Street consisting of: new signing and pavement
markings and improvements to existing drainage system including the installation of deep
wells; milling and resurfacing the pavement; reconstruct the broken sidewalk and curb
and gutter; update all pedestrian ramps to meet ADA standards; coordinate utility
relocation; new landscaping; new signalization and signalization improvements; updating
of street lighting and public involvement, all elements hereinafter referred to as the
"PROJECT", See Exhibit A, Project Description and Itemized Cost Estimate; and
WHEREAS, the PROJECT is within the DEPARTMENT'S right of way and
shall be constructed in accordance with the DEPARTMENT'S standards and
specifications; and
WHEREAS, the CITY has agreed to complete the PROJECT design, let the
consultant and construction contracts, administer and supervise the construction of \lie
PROJECT, within the rules and guidelines outlined in this Agreement and the governing
laws and ordinances; and
WHEREAS, the DEPARTMENT estimated the PROJECT cost as $2,055,610.61
million dollars, See Exhibit A; and
WHEREAS, the DEPARTMENT has agreed to reimburse the CITY for
PROJECT costs in accordance with procedures outlined in this Agreement and the
documentation submitted by the CITY; and
WHEREAS, the DEPARTMENT and the CITY have determined that it would be
to the best interest of the general public and the citizens of Miami Beach to enter into this
Agreement; and

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
Approximately one year ago, as a result of extensive negotiations between the Administration and
the Florida Department of Transportation (FDOT), it was decided that the City should assume the
lead role in final design and implementation of a roadway project for AlA/Collins A venue, from
5th to 15th Streets (the Project), which includes drainage, milling, resurfacing, striping, lighting,
signage and signalization, plus minor landscaping.
By assuming the lead role, the City will be able to modify the Project in order to minimize the
impacts to, and better serve the needs of the Art Deco Historic District and its stakeholders.
Accordingly, Resolution No. 2000-23944, dated May 24, 2000, approved both a Joint Participation
Agreement (JP A) and a Local Agency Program Agreement (LP A) for the transfer of Project funds
to the City. No local matching funds are required.

The City reasoning for taking over this particular Project was based on the following facts:
o FDOT had scheduled a full roadway reconstruction project for Collins A venue, from 5th to
15th Streets, to begin this fiscal year (2000-01), take approximately 14 months to complete,
and coincide with its northern counterpart project, from Lincoln Road to 26th Street.
\) The original FDOT reconstruction plans also included only minor drainage and lighting
components, and a one-way plan for the crossing streets that failed to meet the City
requirements and special needs for the project.
o In order to incorporate the substantial changes requested by the City, the Project's final
design and engineering plans would have to be returned to the 30% completion level (from
the present 65%). FDOT did not agree to revise the plans and offered, instead, to turn the
Project over to the City.
The benefits to the City from a transferred and modified Collins A venue Project, from 5th to 15th
Streets will be as follows:
1. A Collins A venue Project that will be planned and constructed by City specifications, but
100% funded by State and Federal sources, via the reimbursement method.
2. The original roadway reconstruction will become a drainage/millinglresurfacingllighting and
minor landscaping Project, due to the newly-defined neighborhood collector nature of this
narrow two-lane corridor, and the intensive pedestrian activity in the area. This less-
intensive Project, will involve manageable construction impacts and will be done quickly by
a qualified contractor to be hired by the City, in the appropriate fiscal year.
3. A consulting engineering firm will be hired by the City to return the existing FDOT plans to
the 30% level, and complete the plans according to the Scope of Services provided by the
City, and attached hereto as part of the RFQ packet.
4. A minimum of sixteen (16) deep wells will be included in the plans to address poor drainage

8. The Project construction will be rescheduled to FY 2002-03, or as convenient to the City.
FUNDING. All funds to be appropriated/fronted by the City for this Project, as a multi-year
packet, will be reimbursed by FDOT within 45 days of invoice receival, in accordance with the
provisions of two (2) funding documents, which were jointly approved by Resolution No. 2000-
23944, dated May 24,2000. Combined, these documents approved $2,568,676.61 in State and
Federal funds for the Collins A venue Project, from 5th to 15th Streets, as follows:
1. Joint Participation Ar:reement (JPA) for the State funds. This JP A, already fully executed
by the City and FDOT, will fund the following Project categories:
Final design/engineering/permitting (from 30% level):
PIP during design (25%) and construction (75%) phases
Roadway, signing, signalization, landscaping construction:

The $2,055,610.61 does not include the cost of installing deep wells, which will be added
to the lPA by FDOT, after the Project's Final Design phase reaches the 90% level, and a
final cost estimate is available.
2. Local Agenc:v Pror:ram Af{reement (LPA}for the Federalfunds. The LPA for the lighting
component of the Project, was executed by the City, and will be executed by the appropriate Federal
agency only after the lighting plans are completed, as part of the Project's Final Design phase, which

Subsequent appropriations will front the funds for other specific Project phases, such as a public
involvement program, Project construction, and construction inspection.
It is essential that the Final DesignlEngineering phase of the Collins A venue Project, from 5th to
15th Streets, be completed early in 2002, in order for the City to meet the projected construction
schedule of 2002-03. The Administration recommends approval of the Resolution.
